iOS is not original. It is based on Mac OS which is essentially NEXT/UNIX OS with cute icons in front end. And Apple did not invent UNIX.

Apple had to copy UNIX facing dead end with its original Mac OS 9.

Now Apple copied notification system from Google Android.

They actually copied an independant developer fo iOS. They copied the idea but got the whole thing from someone else. It was pointed out on gsmarena.com when they reviewed iOS 5.

Idk why courts ruled this I find that "Samsung" written on the front is a dead give away that it is not an iPad...

For design patents, things like company symbols don't count. And for a person who wants to buy an iPad and doesn't know who actually makes it, how would "Samsung" on the front be a give away? Or how would they know that there aren't several companies making iPads? Not everybody reads MacRumors every day, and these people are what Samsung is aiming at.

Yap, people us blind, stupid and spend more than 450 € without even knowing what they buy.

/sarcasm off

Look at the pictures FFS

1) Apple had been working on a Phone OS
2) Two employees leave iOS project to join Google
3) Android changes from a clone of Blackberry, to a clone of iOS

And that's the story

Man, you're worse than LTD, atleast he doesn't lie.
1. Google had also been working on Android before Schmidt joined the Apple board, and work on Android had been going on for years before Google bought it
2. Describing Schmidt as an employee who left to join Google is just crazy when he was employed by Google before, during and after he was at the Apple board. Schmidt was invited by Jobs and Jobs never accused Schmidt of using any knowledge improperly
3. Those images simply show a pre-release Android version running on a phone with physical keys and without a touch screen. There's still Android phones like that and they don't look all that different from the prototype.

Why is everyone so hateful against Google? Where would the iPhone be now if it didn't have Google Maps and location services?

I stand corrected. Any links to what kinds of phones they were? But in any case, that's two primary designs iPhone killed, instead of one. Doesn't really change anything.

Both Apple Ping and Google+ failed so far. But who knows what'll happen in 5 years.

So the iPhone "killed" this design?:

That's a pretty big assumption. That Samsung is purposely trying to confuse people. I'm not saying they are or aren't. I just think that's a huge leap from creating a tablet which looks similar because that's really what a tablet should look like. Your statement takes it a few steps further to imply that Samsungs desire is to confuse.

Truth is - there are very few ways to make a tablet and for it to BE a tablet. I had a tablet in the early 90s which although much thicker was pretty much similar in design to the ipad in that it was rectangular, had a bezel, rounded corners, etc.

Just stating the reality of the situation.

Android tablets simply aren't making the cut, even after all this time. The test of the real mettle of an OS is in the tablet segment, where the requirements go far beyond just a "smartphone" OS.

Apple is running away with the segment. Things are rapidly turning into an iPod situation.

Whatever you say...I would say I respect your opinion but I wouldn't want to lie to you ;)

(I do however honestly respect that you use facts and sources to back your agreements up, unlike the other trolls!)

So, what you're saying is a company logo isn't enough to tell devices apart, as soon as a company make a product no other company is allowed to make something that can even be compared to it?
If there are people who wants an iPad but doesn't know which company makes it, they obviously only want it because of the hype, and I think they would be perfectly happy and oblivious with getting a Galaxy Tab

Again;

if its a bad copy, why has apple gone apewild over the design?

Is it because it looks too much like the iPad, thus also making the iPad ugly? Or because Apple simply doesnt want competition?

That is COMPLETELY false. Is this your first day on Macrumors? The forum is actually overrun by Apple fanboys, and its been so for years. My favourite example;

And then...

Image

Haa! You again?

Like I corrected you last time. That's from 2006. It's been five years. The whole world has changed in five years.
But yeah, keep beating that.

----------

Up till iOS 5 you do realize the iOS 4 was missing many features Android 1.0 had. Multitasking, notification bar, voice activation; not only that I can choose which app stores I want to use, I can also choose to change every single part of my phone if I wanted, and finally Apple doesn't dictate to me what I should or shouldn't put on a phone that I own. Why don't I own an iPhone? Because the iPhone has been the same damn thing since it came out. If the iPhone 5 is as radically redesigned like they say it is, then it will be my next phone. I see no reason why anyone would continue to shell out money on iphones for basically point updates.

You know which features Android was missing and is still missing? Lets not make a comparison of that. It's just stupid. The argument was about the UI and not about the feature list.

not only that I can choose which app stores I want to use, I can also choose to change every single part of my phone if I wanted, and finally Apple doesn't dictate to me what I should or shouldn't put on a phone that I own.

Right. I am pretty sure, you will be repeating that for the rest of your life. Honestly, most people don't care. And now because of multiple-app stores, multiple devices and what not, we can easily see the state of the Android market. But yes, you would never even talk about that.

Remember I said, you only have praise for Android? No wonder you can criticise iOS all you but just be honest; you use Android and don't be ashamed of it.

"Because the iPhone has been the same damn thing since it came out."

That is some strong RDF. Careful mate.

" I see no reason why anyone would continue to shell out money on iphones for basically point updates."

Showing true colours? eh? But anyway, I can point a number of flaws in Android and this can go on. But hey, nice one deviating from the actual topic.

Maybe if they changed it up in some ways, it wouldn't be so much of a copy?

Not so much of a copy? If Ford invented the assembly line and then Chevy decides it's a great idea, but implements it in a completely different way, Chevy still copied the idea of an assembly line.

So using logic they built the phone and OS in less than 6 months? If they did than Ill go Android because they built an entire ecosystem and hardware in less than 6 months.

If by "less than 6 months", you mean 10 months, yes, it is completely reasonable to assume that Google could add an alpha version of a multitouch UI to their OS and put together the hardware prototype in that time frame. I have no idea what ecosystem you are talking about that existed in Nov 2007.

People also forget the Google purchased Android. Google didn't just say in 2007 Apples making a phone lets copy it!

Now you are just making up arguments.

For design patents, things like company symbols don't count.

For design patents, no. But you're talking about trade dress, which is different: for the situation you presented about confusing a buyer, it definitely counts.

An example I've given before is the "Tylenol PM" vs "Excedrin PM case". Both have similar suffixes ("PM"), box shapes and color shading on the boxes. Seemed like an open and shut case of copying.

However, the court ruled that the brand names "Tylenol" and "Excedrin" were enough to let a buyer know which one is which.

Yap, people us blind, stupid and spend more than 450 € without even knowing what they buy. /sarcasm off

That's another test courts use. The more expensive an item, the less they believe the idea of consumers blindly buying the wrong thing.

"copy" UNIX and +5?

I am kind of getting this whole downranking/upranking **** just to make it clear how diluted this community has become. Unbelievable.

Yeah, it's a copy. Maybe even an improvement, depending on what Chevy decided to add to the process. Question is, why do people care who copied who? Bragging rights? Justification? Satisfaction?

Personally, I don't care who copied who. Android might've aped some of iOS. iOS might've turned around and aped back some from Android. Whatever. It's all a moot point to me. These big, impersonal, multibillion dollar companies can rip each other off til they're blue in the face. As long as I get a better product from all of it, I don't care.

Now the usual inevitable response to this is "shouldn't Apple be allowed to profit off their own hard work without someone stealing their IP". Uh, aren't they worth 40 billion these days? Don't they control a good 90% of the tablet market, despite all the quote unquote cheap ripoff tablet clones out there stealing their ideas? Are they not profiting enough for you as is?

So once again, why do some of you even care who rips of who?

I honestly think the problem lies in people (perhaps like yourself) believing that this site is for fan(atics) only instead of people who own Apple products. This message boards isn't for Apple evangelists (only) but for anyone who wants to discuss Apple and their products.

I am not suggesting trolls (on both "sides") don't exist. I'm saying that just because one says something disparaging or seemingly disparaging doesn't make them anti-apple, a fandroid, a troll, etc.

Life isn't black and white. Yet some people on here want to pretend that the only people that should be reading about Apple or posting about Apple are people who can't be objective. Or have a differing viewpoint at the very least.

I myself criticise Apple on a number of forums here. But I do have my opinions. But the constant hate on this forum, especially these kind of threads, is unbelievable.

You yourself resort to name calling and all kinds of hate; its just astonishing. But whatever.

They definitely do. If a person is constantly bitching about a company, then there is obviously an issue. Some trolls come in and say: "I don't hate Apple, but Apple fans". Feels like, they are on some kind of a mission.
Criticism is great but the way people post here, is just sad.

All kinds of hate? Hyperbole much? I don't hate any member on here - even the ones that annoy me. And I don't hate Apple or any of the products I own.

So what is this "all kinds of hate" you are referring to. I'm baffled.

Are you serious? Just read this goddamn thread. Just read posts by Divinox or Thenedral or Mattie Num... or the guy who just posted above you.

And why not, we should now argue about the degree of hate. I am so not gonna argue on this.

Please bitch all you want; I have much better things to do.

Look at the tone of your post vs mine. You come across as very angry. Very.

You didn't mention the other posters in your comment. You "attacked" me with the comment of "all kinds of hate."

It seems if threads like these bother you so much - perhaps you shouldn't click into them. I would never tell you what to do or not to do. Just worth thinking about.

Happy Holidays.

This is the place for them. What did you expect?

Yes. But this isn't the place for ONLY them.

Yes. But this isn't the place for ONLY them.

I am angry. I don't particularly hate people; but whatever...

I'll find my way to some of the better forums. Maybe the developer forums. Cheers.

EDIT: Oh! I'm really sorry –*"all kinds of hate" was supposed to be a general comment and it definitely does not apply to you. My bad.

Happy Holidays to you too. :)

Exactly. Hell without copying music would be boring. How many bands tried to sound like Led Zepplin or Black Sabbath and in turn morphed into something different. As long as things aren't carbon copies I think its good for the industry. Android and iOS are very different and people that use both daily can tell you they both do great things. They realistically don't even look the same its just those crafty pictures presented to the German courts that make it look the same.

Apparently you've never heard of Braun?

Or Bauhaus.

...speaking of which, anyone recognize them tables?

If you consider me one of the "haters", then I have to say that you are almost shockingly oversensitive, and your definition thereof must be someone who doesn't applaud Apple for every single move they make.

Sigh. Whatever. Have fun down in the more smarterer boards.
