Yay soon the iPad is gonna be the only tablet on the market unless it has no brezel and is round. How is this good for the customer again? I for one like to have a choice even tho i went for an iPad.

Its like telling a company to stop making a plasma tv bc it looks like their flatscreen

Depends if those patents are EU patents or not. They can't have a EU court enforce US patents (and yes, the HTC patents you refer to are US patents).

Except that Apple actually invented the tech that they accused HTC (and Google) of stealing. HTC and Google, however, have accused Apple of violating patents they purchased way after the fact.

The only joke here are Apple's flat-footed competitors who were either too dumb, stupid, or downright uninterested in innovating a June 2007 or January 2010 like Apple did. And now they're scrambling to answer Apple's challenges while consumers are clamouring for more Apple gear.

it doesn't look too good for the also-rans. Apple can keep doing this and keep serving up goodies for the market while everyone else tries to figure out how to dodge Apple. Chances are, Apple is already working on redefining yet another segment of the market.

And you know what else? Apple did all of this via perfectly legal means. They patented everything of theirs they could, and have been doing it from the get-go. It didn't start in 2007. They're old and wise dogs when it comes to court. They've been doing it since the early days. Apparently the also-rans weren't as prescient. And now they're in the fish-tank with an Apex Predator who also seems to have the law on their side in some key instances (and a few key instances are all Apple needs.)

Solution? Beat Apple at their own game and pull off an amazing keynote that totally changes the status quo with a game-changing product. Do you think the also-rans *right now* are busy thinking of doing it differently and doing it better? Think the also-rans have what it takes? All that can be said is you'd better bet money you're willing to lose.

In reality, very little has changed since Apple's early days. Anyone recall their insistence on the trash-can desktop icon being a copyrighted concept? (To this day, Windows has to use the "Recycle Bin" to indicate the same function, instead of a trash can.)

I'm not even trying to focus on Apple here, specifically. I think this patent trolling is a disease the ENTIRE tech. sector is plagued with, really. It's become a big game of "Sue a competitor whenever you can, because surely, they'll eventually sue you for something similar too."

If they'd worry about INNOVATION instead of all the LITIGATION, everyone would be better off (except the attorneys).


Apple went from being the cute fruity underdog to a completely fascist corporation that competes by patent trolling and using local law enforcement to do its muscle work. Congrats Apple you did the impossible by out douch bagging Microsoft.

No it isn't. I would not class Germany as the biggest market in Europe I'm afraid. I'm pretty sure us in the UK spend plenty of cash on electronics...! But it won't wash here in the UK, stupid rulings like that. We have more sense.

We also don't have the Euro crashing!

Germany is Europe's largest market, and is home to 82 million, far more than England, France, Italy. They each have a population of around 60 million. Germany has a very healthy per capita income, and consumer spending is also very healthy.

Germany is also the most economically viable country in Europe, with excellent infrastructure. It is the largest economy in Europe and is third-largest worldwide. This is fact. If you want to be part of any market in Europe these days, it'll be the German one.

Any product kept out of Germany is a huge win for whoever is able to pull it off.

None of this is anti-competitive, because it has nothing to do with competition. Samsung just isn't making the cut.

The integrity of products must stand up to legal scrutiny.

Then why did the dutch court toss out and even invalidated Apple claims? What is your though on that one? The one thing they kept is a cake walk for Samsung to get around and they were given plenty of time to fix it.

There is no actual abuse going on. This is what these courts are here for. Different countries have different laws when it comes to intellectual property. Neither one is more right or wrong than the other.

If a party thinks (Apple, in this case) that they have a legitimate claim, they're going to pursue it in as many jurisdictions as possible. That is no guarantee of success. Also, the defendant has to defend each claim in each of the markets in which they operate.

The same mechanisms that are open to Apple are open to every other party in the industry, including Samsung.

Why has no one successfully blocked Apple products? I don't see any injunctions against Apple. Seems at this time Apple's claims are certainly valid to whatever degree in certain key markets.

Next time the competition should work a little harder on becoming an innovative and successful first-mover in key markets and patent accordingly.

What's going on now in the courts is very good. Everyone's position is becoming clarified. We're seeing who has what and who needs to make some changes. The wheat is getting separated from the chaff, so in due course we'll see where everyone stands.

No one else is really trying to abuse the courts to Apple's degree. Apple started this MAD and it is sad.

I have no opinion on the issue. It is what it is. Samsung has some re-thinking to do.

Maybe they should get on that and get busy with some key innovations that will redefine up-and-coming markets. You know, do the kinds of things that Apple manages to do all the time.

It coulda been the Samsung CEO giving that watershed keynote in June 2007. It could have been them in January 2010, too.

New market realities are in play. Some people are still busy lacing up rather than busy playing the game.

Utter rubbish mate. It has everything to do with Apple using an excuse to kill the competition by banning a product from sale. Nothing else. It is the most anti competitive thing you can do, you will never see this though as your a complete Apple fan boy. Apple can do no wrong according to you and that's going by your previous history on this site.

This has everything to do with Apple being scared and knowing full well it is going to loose market share to Android, it cannot control the market for ever, instead of generating an effective business plan to compete, innovate products, it has decided to sue everybody, it has already had cases thrown out of court.

It is easily one of the most arrogant companies going and even Cisco stated this, CISCO! When Steve STOLE the iPhone name from them.
Well karma is a bitch and Apple is going to have their's if they continue.

Amazon can't launch their tablet soon enough. Because that changes the rules, Google, Amazon, HTC, Samsung, vs Apple. I think we can all guess who is going to eventually loose.

I see people getting the Galaxy to replace their iPhones every day, the Galaxy is rated higher then the iPhone. And the same will happen with the iPad in time.

This is why this German decision seems quite subjective (and by the same count, so does the Dutch decision). Same claims, Same registration (good old '607), Same products, Same laws (EU wide for this IP), different decisions.

Ok, now I'm oficially confused. Did the galaxy tab get banned from sale because its infringing on the design registration even if the registration doesn't have anything to do with its competitor the ipad? Does this mean that it doesn't matter what kind of device it is, if it looks like the design apple registered it will get banned?
