Nor has there been one that has said the opposite (to be fair, they HAVE said that broadcasting over the network from a centralized location IS violative of copyright). ANd my point was that this invites a lawsuit. I have not opined on the result of the lawsuit.

Steve Jobs is trying to milk the platform for everything it's got. He sees big bucks in media and apps, and in advertising.

Make no mistake about it, that's why he keeps the platform so tightly closed.

Absolutely.. All the while letting his iSheep believe that he is doing it in their best interest.. you know, to keep "the user experience" pure and holy and porn-free.

It just reminds me of that infamous televagelist preaching " the holy word" all the while stuffing his pockets with millions and living in a house on the hill with 20 cars and hookers.

Streaming my music collection, Simplify had its app in App Store for a few months now, so well check that, too... (By the way, does that mean I need to keep my home computer on and leave some ports open in my routers? If so, I don't see this as a big deal for many people.)

Android already has bogstandard OTA app downloads as well through the marketplace...using your phone :)

The OTA app install people are excited about relates to buying apps on a PC/laptop... then having that automatically pushed to your Android.

The excitement about the OTA music is related to the natively supported 'web-based iTunes' streaming.

And last i heard Simplifymedia pulled iphone developement to join Android.. so not really a check there anymore is it???

Youre right though in that Google did copy apple in spending $140MILLION on a codec and then opensourcing it. Also on adding Flash 10.1 and HTML5 support to their mobile OS. Google are such copycats :rolleyes:

Did you hear they added Chrome's V8 Javascript engine to the Froyo browser :eek:

(Saying all that it does sound like they have added an iPad-style pinch gesture to peak at stacks of pictures... lol :D)
 
Since you keep bringing it up, I am well aware of the extent of your knowledge: a junior attorney in an obscure firm, with a degree from a third-rate law school. I wouldn't wave that flag around. Particularly since one of your partners may notice the frequency of your posts. :D

How is what Google is doing different from Sling, or Orb, or any cloud-syncing scheme?

And who said anything about Google's lawyers being idiots? I think they're quite smart. They probably (and correctly) think they would win any such lawsuit on the basis of fair use. That doesn't mean that there won't be a lawsuit.

No I haven't - you missed the semantics. Not every copyright violation (i.e. infringement of 17 USC 106) is actionable. For example, most such infringements probably fall under fair use, and hence no one can win a lawsuit over them.

Just like if I infringe a patent I may not lose a lawsuit - the patent may be invalid or unenforceable.
 
Google isn't innovating. They are simply buying companies and copying Apple ideas.
And a lot of the "amazing" applications that Apple provides, were actually once applications that were created by other companies. Apple purchased said companies and re-branded/re-worked the existing application(s) and ideas into Apple-branded apps, and then released them.

How is that any different from what Google does?

I have no problem with Apple branching out into other markets.

I do have a problem when branching out essentially reduces focus on what was (and I believe actually still is) their traditionally "core" business: computer hardware and the Mac OS.

It's kinda sad really: things were getting exciting when they switched to Intel... and then they began dropping the ball. Admittedly this is from an enthusiast's perspective, and rarely impacts the average computer "user".

I use google. Plain and simple, but they are collecting too much information on me now.

By then Apple will have a much better system in place and running.

Sorry but Simplify Media was a great idea with spotty implementation. Try streaming from a library with over 8000 tracks and see how it takes over an hour to update the library data before you can play a track. I stopped using it a while ago. Honestly, sync and change and get more capacity each revision, but OTA streaming of music catalogs is unnecessary, network dependent and straining, relies too much on having a consistent signal which isn't easy while driving. Not to mention the battery drain of streaming.

I have their stuff installed on 3 boxes, with a combined total of 9,339 tracks available. One, an old Dell laptop with a PIII dedicated to Simplify, has over 8,000 tracks on an external drive. It may take several moments to update after a change on the larger one, but once set, it's fine.

I think Simplify is/was on its way to becoming a great, mature product.

You do realize that Mac OS X 10.5 and above has a transparent menu bar similar to Vista's use of transparent windows? So in retrospective, Apple copied Microsoft; just executed differently due to the interface. But the most obvious is Mac OS X's subtle use of the maximize, minimize, and close buttons. Windows has had that since 95. ;)

Look and feel? That's the best you can come up with? In case you missed it, that was settled back in 1994 (before your precious window buttons were even introduced). Anything Apple borrowed after that was fair game thanks to the court's decision. Tough how that works out, huh?

I'm just trying to prove a point that their not 100% original. And if everything is fair and fair now then how come people are still bitching when someone borrows an idea from Apple!?!

Google Android - doing extremely well. I was just in a Verizon store and they can't keep the incredible in stock.

I'd say Google is focusing on what they do well and is for the most part firing on all cylinders.

Oh please got greedy, the same accusation could be brought on apple. They saw the money being made with Ads and created iAds. Apple is just as greedy as any other multibillion dollar corporation, google included.

More like Apple went control freak. Apple is making a bunch of enemies theses days. Google got greedy ? I doubt it, they are the ones with the wall full of partners and they are the ones making 140 million $ acquisitions only to release what they bought royalty-free, open sourced and open specced.

Adobe, Nokia, Google, Apple is firing at all of them over the iPhone. App store rejections with no sense, Walled Garden, etc..

Google bought Android in 2005. Apple knew about this going in for iPhone. I don't see how Google got greedy. Maybe you should explain yourself a bit. Your story seems a bit polarised in Apple's favor. Maybe you should take a look from an outside perspective.
