iTunes stuff always shows up a "APL*ITUNES" on my card, if it is anything other then that, I would say it is fraud. Either way, if that $40 amount is not on your iTunes account then it was not because of what you bought on that account. If you were on WiFi when you signed up, somebody could have grabbed some packets with your CC info.

Dispute the charge and get a new card number, move on with your life. Credit Card issues happen all the time, if something is on your card you didn't put on there, dispute it as quickly as possible, never try to go through WHO made the charge first, just call the Credit Card company, ALWAYS.
Guys I am yet to recieve any information from Apple with regards to the money and reasons as to why they charged it. However I did get my card and amount blocked from my bank they were swift at it.

Also would like to take this opportunity to thank everyone who helped and took time to read my issue and respond back. I cant express as to how much I do appreciate that. Thanks a lot again ! Thanks everyone !

I think this is the actual apple support :) and this is one of the reason why everyone keeps saying Apple has a wonderful community and support :)

Apple DID NOT charge the amount on your card. as Squid7085 stated Apple charges on a credit card with the business name:
"APL*ITUNES" NOT "ITUNES" as your bank statement says.

as far as the Apple Support you complaining about:

1) it was a holiday weekend.

2) when they did reSpond they apologized foir the delay related to the holiday, then went a step further and gave you a direct email for you to reply back to. When in the end they never had any part of charging you. Instead the $45.33 was charged by another company altogether

Apple iTunes charges on my American Express card are charged as "ITUNES MUSIC STORE IAUSTIN TX".

Well i appreciate that your comments in support for the Apple ITUNES support even i would do so for some of the other companies which I feel very strong about.

However in response to you points

1. They say web support is 7 days and 24 hours somewhere on the webpage and i am not sure if that's not applicable for holiday weekends.

2. I did check with my bank the request was from Apple Itunes.

However the matter has not been resolved from my end atleast.
