All set, everything is taken care of. They're paying the return shipping and sending me a SoundID 200. They would've caught on to it eventually when someone activated it but there was no record it was sent to me.

I could've hawked it on ebay and got them in trouble, but that's not me.

And he didn't get gypped... he did the right thing. The reason the world is so screwed up right now has a lot to do with people who share the mindset you do. Morals are going out the window, its disgusting.

They can certainly make you think you owe them money, but you have rights. You didn't know that and they walked all over you. You should be happy that you know otherwise now. Like the right to free speech, or the right to an attorney if you get arrested (or is that "shady" too?).

The world is screwed up because there are citizens of the United States want their rights to be protected and honored? IMO it's screwed up to think that standing up for your rights is "disgusting" or morally wrong.

HE ORDERED THE PHONE! It was an HONEST shipping mistake that they sent two. This is NOT like some random thing showed up at his house! Have you NEVER gotten bogus CD's in the mail then a bill later? There is a HUGE difference between those two. This is like trying to reason with a brick wall.

They were not trying to get him to subscribe to some monthly CD club... this was an honest mistake to the tune of $700. Get that through your skull would you. It is morally wrong to keep the item.

Federal laws prohibit mailing unordered merchandise to consumers and then demanding payment.

He ordered one phone. He did not order two phones. The second phone would be what... that's right, an unordered item. Hence, if you receive an item "that you didn't order", you have a "legal right to keep it as a free gift".

Whatever company sent you an unordered item and then demanded payment for it violated federal law. Not only is it legal to keep the item, it is illegal for a company demand payment for such. Yet you are arguing that it is morally wrong to do anything but pay them or send it back? Welcome to America, buddy, the land of the free.
 
The shipping mistake is causing an inconvenience for the customer who ordered the product. The customer does not have to return the product. He is not required to work to rectify apple's problem thus leaving him in a position where he has to supply extra effort that should not be required while ordering from an esteemed retailer/manufacturer like Apple. Convenience is a very important thing. There is no moral wrong in keeping it and who can really define what someone's time is worth. A skilled craftsman or other position could be using the time that Apple so rudely stole from him to make even more money than the product is worth. And as the FTC says, you are under no legal obligation to pay for it and Apple cannot force you to rectify their own mistake.
 
Good move pal, I will feel sorry for the other party who is waiting for his or her iPhone 3GS x 2 if the Fedex delivery guy just send him or her only one of it.
 
Hey man, you didn’t the RIGHT thing whether you legally could have kept it or not there’s a good chance that the second phone you got was meant for someone else. Ultimately you have a clear conscience and a little bit of a reward for doing right! :)
 
Well done, OP. I would have returned it too, it just doesn't belong to me. I'm glad there are laws protecting consumers, but I don't think they were intended for a situation like this.

Yup - thanks for replying more timely than I could... I was too busy being pwned by everyone here.

Of course you should for "good karma" and what's morally right make every effort to return the phone.

But legally you're OK to keep it.

That's not saying that Apple & AT&T can just charge your card and make your life hell trying to force them to take the charge off (but they'd never do that, as they themselves are completely full of uber-karma and follow the letter of the law totally).

Nah, people like to just call people thief's and immoral people rofl, when it all actuality the law was on the OP side if he wanted to keep said phone. A lot of ignorant people on their high horse in here. Expect nothing less from some stuck up mac owners though. I would have kept it and slept soundly knowing I DIDN'T BREAK ANY LAWS.

Jesus Christ get off your ****ing high horse. He wouldn't be any less honest if he decided to keep the phone. He was under any legal obligation to return it.

You did the right thing...because if you didn't they would of ask for it back...they would had charge your account since you order it online...AT&T has a return policy you should check it out sometime....it's good to read the company policy so you know what to expect...Believe me nothing in this world is free...

Except when there's a shipping error and there is FEDERAL LAW that stipulates you have NO obligation to correct their error; they cannot LEGALLY charge him for the extra phone, and under FEDERAL LAW this is classified as a FREE GIFT.
