Thanks for all of the input. I have used ebay many times as a buyer and a seller. First real issue.

The seller had a rating of higher than 95 percent with over 50 reviews. I guess that was my first mistake. Although i thought that would be fine. Anyhow tomorrow I start the process for it.

Anyhow to the responder who said to call 911. Even meant as a joke that shouldnt even be mentioned. I work in law enforcement, and with the system clogged as it is, some people would take you seriously (as has been seen on the news) and call.

ps I went on here to buy the phone as she is not due for an upgrade but her phone (blackberry) is dying and she needs one to hold her over till she is due in a year from now.

IIRC there is a time limit for you to file, something like 30 or 45 days. I could be wrong but either way don't delay. :)

I'm curious, was it one of the auctions where eBay Buyer Protection?

Good luck getting it sorted out. I went through a bad transaction as a buyer last year and I did get my money back. Keep track of your attempts to contact the seller and communicate very well and verbosely to eBay.
 
lol yup figures. well he has 11 and a half hours to get me the phone or the tracking so we will see. love ebay though wont let one bad apple spoil the bunch for sure

haha, if I were you, I'd hope he doesn't cancel in the next 11 and half hours and I get the deal. Now, be careful what you wish for. lol.

Wrong. This only happens when Paypal has your account under review. This happens to most accounts under 100 feedback with inconsistent selling history(selling different items or high risk items). The conditions for the seller getting money released are: 21 days after receiving payment, Positive feedback received, 3 days after tracking number shows delivery. Once accounts enter review, they stay in that phase for at least a month at which point they are reviewed again, account may return to normal or stay under review with no provided reason. The payment holds only apply to funds coming from ebay sales, all other funds entering account are available immediately.

Learn what you are talking about. If you ever logged in to Paypal when you are in review you would see the banner at the top saying the funds are temporarily being held.

Personally I avoid eBay at all costs, I am tired of the double dipping for fees by eBay and Paypal. A $100 sale has around $15 in fees. Also eBay is all about the buyer, no protection at all for sellers.
 
Most sellers do not get their money immediately. It can take weeks. It takes a certain feedback score to get it right away.

Also the chance that this fool has done a lot of business with eBay is pretty small because of his business "tactics". It shouldn't be to hard to get a refund.

Also wrong, read above... Feedback has nothing to do with receiving funds. Funds are only held if Paypal puts your account on hold. Although, selling a high risk item on eBay like an iPhone with under 100 feedback may have put the account on hold.

I'm regular buyer on eBay, as buyer I can say I have good experience. I bought around world through eBay, and always I received item as described (usually I buy brand new)

My advice: just contact him, and have patience, I understand when someone is waiting a package, need it fast as possible.

I purchased all Apple stuff on eBay, and more, spend around $5k and always received what I wanted. Also saved lot money, since apple products are extremely overpriced in my county.

eBay is excellent opportunity for me :)

PayPal won't release the funds to the seller until you receive the phone and provide positive feedback. I wouldnt worry, you'll get your money back.

It now depends on the item's price and how much business you do monthly. I have had money held up to me as a seller until tracking confirms delivery or 21 days has passed.

No they don't! I use paypal and ebay almost every day for the past 13 years! Paypal gives them the funds immediately into their account once it's sent to that person. There is nothing that paypal does or ebay to hold those funds till what you say sir. Wow. Stop posting misinformation.

True. Last time I sold on eBay they held my funds until the buyer left feedback. If they don't leave feedback and you have delivery confirmation. They'd release a day or so after delivery.

Seriously if you are going to keep posting this, get it right. eBay and PayPal do not do 1 time holds, if money is held it is because your account has been put in review...like I said earlier. 21 days after payment, Positive feedback, or 3 days after the tracking shows delivery are the only way to get the funds. Accounts stay in review for at lest 30 days. Like I said earlier inconsistent selling history will put it in review.

Yes it was with eBay Buyer Protection.

Good news is I got an email from UPS that it was shipped. Wasn't contacted by the seller though, just UPS because I am a mychoice member. Should be here tomorrow. We will see..
 
excellent thank you. I contacted well over 3 times, requesting tracking numbers and if it was shipped. like I said only got one response, and it was a week ago that he had not and would ship it 2 day immediately. I will be doing this tomorrow. Thanks guys.

Make sure all of your contacts are thru the eBay mail system. I would post this jerk with negative feedback so that other can avoid him in the future.

I always keep it through ebay just incase for this reason.

So can anyone tell me how to activate this? When I give it to my girlfriend she probably won't know what to do (first time getting one not bought through the store). I have Sprint and it was easy for me, just a phone call. What do you do on AT&T? Thanks

If she doesn't already have a microsim take it to the At&t store and get one. Then everything else should be easy.

Another person that knows nothing of ebay... You cant just give negative feedback because it took them a while to send the item, if they pass the designated handling time for the item then you can give them NEUTRAL. Negative is for not receiving the item, counterfeits, broken item, etc...not being slow to get it to the package carrier.

If you have a problem with the slow handling time, you can show that in the detailed seller ratings which you choose from 1 to 5 stars and that also shows on there page. If the seller gets the item out in the designated handling time, they automatically get 5 stars for that. They also get 5 stars for shipping price if shipping is free.

Probably a regular SIM in the Torch. Either cut the sim down to microsim size (google for instructions) or buy a sim-cutter tool or go to an AT&T (corporate) store. Latter shouldn't take more than a few minutes and shouldn't cost anything.

When I moved a family member to my iphone4 after getting the 4S I took their existing phone and the 4 to an AT&T corporate store and in five minutes was back out the door with a microsim in the iPhone4 and no charge.
