The only mighty mouse/apple mouse had an issue where you couldn't right click without lifting up your other finger. Is this resolved? (I'd think, as it allows for multi-touch.)

Yes.

I am a lefty who does not reverse buttons. My left index finger rests naturally on the left click area and my index finger rests on the right click area. With the old Mighty Mouse, I had to get my middle finger completely off the mouse in order to right-click (without accidentally pulling my ring finder onto the mouse surface). With the Magic Mouse I can click normally.

It gets it that I tapped the right side of the mouse even though my middle finger is resting on the left side of the surface.
 
I really wanted to love the Magic Mouse and ordered one as soon as I could. Alas it was a real let down for me. Sure, it's light years ahead of the Mighty Mouse but it really could be so much more (and still can be with a software update).

Scrolling with it is really nice and general use with it is pretty decent. The biggest let down for me though is the lack of pinch to zoom and rotate. I use these all the time on my MacBook Pro when looking at PDFs and images and I always miss my multitouch trackpad when using my Mac Pro. I was naive in thinking that "multitouch by Apple" meant pinch to zoom, rotate etc like with their trackpads and iPhones/iPod Touches.

I can't quite bring myself to convert over from the Microsoft mouse I'm using at the moment to the Magic Mouse. The Microsoft mouse is more ergonomic and I like having seperate right and left mouse clicks. I can't really be bothered getting used to a new mouse unless it is categorically better and offers more functionality. The Magic Mouse as it stands seems pretty mediocre and offers no extra functionality compared to the competition in my opinion. So for the time being my Mighty Mouse will carry on to sit in the box it came in, lying in hope that Apple will release a software update to allow pinch to zoom/rotate. :(
 
If someone could create a program to enable a third button for expose for us Leopard users, I would probably love you forever. This mouse is amazing aside from not being able to use expose without Snow Leopard. :(
 
I've been using the Magic Mouse for a full working day now and love it. Feels great, right click is much better than the Mighty Mouse, and the form and feeler is ideal.
 
I can't see where the mouse feels great as you can hardly hold onto it. it may work well but if you can't really hold it how does it feel well?

You can hold onto it. its just a bit lower to the surface of your desk than for example the mighty mouse. ( I hope i expressed that good :p )

I like it. Can't wait to use it everyday!
 
you hand has to rest on the mousepad or you end up clicking the mouse.
I am sorry the mouse works well but there is no comfort involved. if you use it hard it is not a great mouse for your hand. again apple is design over function. with a mouse that's not good.
 
Bring an antibacterial wipe to the store and wipe that shiz down before you try it out... just my 2c.... lol

I thought I would hate the Magic Mouse because it's short profile. I usually hold a mouse with my whole hand, rather than just the finger tips. But I love this mouse!

The scrolling is so smooth and the 2-finger gesture makes Web surfing much quicker. When I'm on my wife's PC I find myself trying to swipe on her mouse to go back in Firefox. It's such a great feature.
 
I actually hate the Magic Mouse. And so that I don't catch any flack I meet the OP's criteria for criticizing the mouse:

1. I installed the mouse software, on Leopard and Snow Leopard
2. I have been using it exclusively since it arrived.

The mouse is not comfortable, even when you use it as a "finger" mouse. Even tweaking the mouse curve, etc did not give me the response I need.

The positives? The (limited) gestures are useful, but this doesn't make up for the functionality lost by removing the side button. The lack of buttons in general make it difficult to function.

Expose is a necessity, even with the 3 finger hacks, it still isn't as useful as a trackpad or dedicated button on the mouse.

I give the mouse a C. It is the same old thing with a multitouch top. It removes useful features and replaces them with a semi-useful and gimmicky feature.

The day Apple makes an ergonomic mouse with things that make work easier, I will be the first to buy it.
