There's a consumer protection law here (in the UK, though I'm sure the US and many other countries have similar laws) which states that items sold have to be fit for purpose. A phone that can't get a signal without an accessory isn't fit for purpose.

Ergo, unless Apple fix the problem which they're currently pretending dosen't exist, they're going to find themselves in trouble - they may even be forced to recall the affected products.

Telling customers to hold it different or buy a case won't do.

Point is, even if Apple denies it's an issue, disagreeing regulations could still force them to sort things out.

In this country we may not have consumer protection laws, but we have plenty of lawyers. And they will be after Apple I'm sure. Take a long time for the process to work its way through.
 
I'd imagine they aren't replacing them for the reception issue because they don't know if a new phone will make any difference. Makes sense.

But in all seriousness, Apple needs to recognize that there is a problem with their product and stop denying the truth, and if this isn't fixed in a week or two, consumers are going to be very angry.

This is a big deal. It is a hardware design flaw that cannot be easily fixed.

Apple has given no indication that they plan to fix it. On the contrary they're indicating that they are going to stonewall.

Yes that's what they told me, and that makes sense too, they said it wouldn't make any difference replacing it. The point is though that the technician thought on Friday that the problem was serious enough to warrant replacing the phone (presumably for one that would then function properly) but come Tuesday the problem was no longer considered a problem, just something that you should hold differently. Indeed he expressed that all phones have this issue as if it was no big deal at all. Quite a change from his appropriate concern on Friday. Obviously they can't at the moment remedy the problem so they have limited options but they could have said here's a free case to help with the problem. I'm disgusted at Apple for the first time. The phone is otherwise fantastic.
 
I'm not a lawyer so I don't know crap about consumer protection laws or any of that stuff. But it doesn't take a lawyer or judge to know that if Apple's solution is to buy something extra then something is wrong. Doesn't the consumer have a reasonable expectation to believe that what they are buying will function as advertised? Maybe some fine print that mentions the issue would solve everything. I'm sure in the end this will work out and maybe the bad publicity will embarrass Apple. But I doubt anything legal will happen.

It doesn't say in the iPhone 4 owner's manual, on the ox, or on the website that users must hold their iPhone in a certain way to make a call, does it? I'm no lawyer, but it actually looks likes lawyers may have a case.
 
I had my iPhone 4 replaced on Sunday at an apple store due to a dead accelerometer. The genius was polite and friendly all through dealing with the problem right up to a point near the end of the transaction where he said, in a very different tone and it jumped out at me as odd, "There are no known issues with iPhone 4"

It was clear that this is a line they're forced to tell all customers and it was so out of character with the whole process it seemed forced.

Ahh well. We shall see but there is a good argument right now for redunds under the OP's mention of sale of goods act

This seems to be the only way to make companies/people learn, the court of public opinion. And I doubt the antenna issue will affect initial sales since these people already decided to buy an iPhone. The damage will come later.

Im glad your phone works so well, but then why won't apple replace problem phones with "great phones" like yours? They replaced my old 3G for screen defects...isn't the phone not working when you hold it a defect?

In fact, since Apple's ads show the iPhone getting signal while being held normally, the lawyers may have a case for misleading advertising, too. Though that is more of a stretch.

Some regulatory body is going to have to judge the iPhone 4 not fit for purpose. I suspect that may be difficult, however i'm fully for it. Burn Apple, burn.

I'm sure there are numerous lefty regulatory bodies who can't wait to do this. Too bad all the people who claim to have reception problems don't do us all a favor and simply return them and go join an iPhone Anonymous forum. "Hi, my name is Skippy and I am an Applewhiner."

Well, the way I'm holding my 3GS now is covering the whole bottom of the phone, including where the iPhone 4 has it's antenna, and where the antenna on this phone is, and I have full bars. Hmm.

Don't worry, they are Apple's little disinfo agents with a goal to demean and deter those that criticise or point out a problem.

I wonder if they get paid by the post or by the hour?
 
Total BS! It's a MAJOR issue and I've had the iPhone 4 since 9.30am launch day.


I really hope the UK laws that protect customers can stop Apple from saddling iP4 owners with dramatic signal loss to where calls fail and no data can be downloaded. A case makes a difference, but the issues persist even with one in lots of areas, instead of no data or "call failed" you'll just be slowed down in good reception areas but still disconnected in weaker signal areas, which like I have experienced can be just a few meters apart. It's a real pain in the neck, especially when you have to make a call and are worried about how you're holding the phone.

Apple have chosen to not allow people to replace their phones over this issue and they won't even offer a free case to help mitigate it. That's wrong and I'm ashamed of Apple. Last Friday a level 2 technician at Apple told me they would replace the phone if they couldn't fix it. This week the same guy tells me that they won't replace it. He spouted out almost word for word the talking points in that leaked memo to Apple employees. I have always had good service from Apple and last Friday I thought that it was continuing, this week everything has changed and Apple has betrayed those, like me, who have always put their trust in them.


What have you done to seek resolution to your problem? (Other than posting on the Internet) Did you go back where you purchased it and seek help? Did you call customer service? Did you assume because you read about it on Macrumors and read what BGR claims their support policies are that no one would help you?

I really don't know (or even really care) if there is an issue. The much bigger issue is people simply being bad customers. Posting about things on the Internet or waiting for the government is not going to fix anything for you.

you avoid touching about 1mm of rubber on the band to stop the antenna from grounding. but 'Unfit for purpose' ? hahaha you do make me laugh
