You buy them if you need them. If you buy/have AirPods or simply don’t use headphones your EarPods are just waste. Think about numbers.I'm curious what "rare-earth" elements are used in the EarPods... internally they aren't any different than some cheap Chinese junk that you'd find on Amazon for $7. The fact that they still sell these in their stores and online tells me it wasn't about that at all, and more to save cost.
Same here. Never used the ones that came in the box.I haven't used wired earphone in over 5 years! And never have I ever used that is shipped with the Phone (iPhone or not). So if there are more people like me, then having them in the box is just another e-waste! I strongly believe a choice has to be provided to customer while purchasing. Like a check box or something for "ship with basic earphones".
That legal mindset is more akin to risk of strangulation with included charging cable. YMMV.France will next declare that the EarPods cable is a choking hazard and require EarPods Pro instead.

How are portless phones able to comply with this law? Are they just not legal in France, or are Airpods acceptable? It seems a little odd that the antennas in an airpod are acceptable while those in an iPhone are not...
