You don't seem to get it. When alcahol and minors are involved, burden of proof falls away. There's zero tolerance where minors and alcahol are mixed.

fair enough. You do sound like a smart dude. My bad on judging your friends. But I'm just saying, even if there is no DUI, just the fact that you would have to deal with a cop when there are college kids, alcohol, and driving involved I would stay away from that situation.

No your definitely right, it wouldn't be the smartest idea... it just annoys me when people get on here and judge over text... but it's all good man.

I'm pretty sure your friends can last the ride without drinking. And plus you're going to be in New Orleans right after... why not wait for the night to drink and party:D

Breathalyzer is not needed at all. I graduated from high school in \'02. One of my friends was in much the same situation as you. He was charged with DWI and underage posession, open container etc...listen to the advice the cop posted a few pages back. He\'s dead on. The law has already been quoted. Read it, folks.

The legality isn't even in question here. It's definitely illegal. I thought we were just discussing possible repercussions and how severe it would be if you were caught.

Please don\'t get upset for no reason. It is illegal if you decide to do what is in the original post. If there is no alcohol, then you\'re good to go.

IF the cop decides, he can give a DUI, it's that simple. He doesn't have to take a breathalyzer becuause when he goes to court his only proof necessary will be the open containers.

Go back and read the cops post and the interpretation of FL law posted earlier.

Haha, they just want to have a good time... and I'm totally a believer in the "you don't have to drink to have fun" thing but seeing as how it's going to be 8 hours just driving there and back they thought it would be fun.

You want me to post some facts? Here's some more about underage DUI in Florida:

Violators could face a fine of $1,000 for an initial DUI conviction, along with additional penalties including jail for six months and revocation of a driver's license for up to a year.

Yes, but there is still a ticket written. Either way, the cop can choose to handle it however they like. It will be up to the courts to make it stick.

And as mentioned earlier, a minor driving with others in the car drinking....case closed. This isn't a jury case, it's a judge that will decide that it is very unlikely that a minor did not drink in this situation.

Honestly if I got a DUI I would challenge it ... My argument would state how I realize the laws and must reap the consequences of what was done wrong open container, speeding, etc... but no hard evidence of me being UNDER THE INFLUENCE which is what a DUI is... also, at the scene I would request he let me blow to prove it. Yes there was HYPOTHETICAL illegal activity (ie. open container) but I'd be damned if I got charged for DUI and that went on my record when I was DUI!
