Same thing happened to my wifes iphone a few days ago.
She was using it without data plan and with carrier data blocked for over 5 months now and she got the same text and they automaticly added the data plan to her account.
You can stick your sim in a regural nonsmartphone and then call them and maybe remove it. But they might add it again later.
AT&T is getting more agreesive latelly enforcing this that they havent been doing for years now.
Not much you can do I guess besides take your number and iphone to Tmobile or something.

It doesn't matter from whom you buy the iPhone or whether it's unlocked. The Terms of Service your mother agreed to when she signed up for service require that if she uses an iPhone on her account she have an unlimited data plan. This is true whether she wishes to use data or not. They are perfectly within their rights to add the data plan, since your mother is in violationof her service agreement.

It is true that many people have been able to get away without a data plan in the past, but they have always been in violation of the terms of their contract...and it looks like AT&T has decided to start enforcing their rights.

do you know what unlocking means? unlocking is you won't be restricted to the AT&T carrier. so you can use it on T-mobile or Any GSM network. I think your talking about Jail breaking but regardless ATT requires a Data plan as -aggie- said they can see what Model iPhone you have Jailbroken or Unlocked as long as you are on there network. but as you said you don't have to worry about it so next thread!

no sorry im a ratard idk what unlocking is....dude of course i do. I didnt want to go to another carrier cause we are still stuck in our contract with ATT and my mom doesnt need the data plan, but loves the iphone....hmmmm..so i unlocked it...does that not make sense?

You mean jailbroke, right? Unlocking means using on another carrier.

But his phone being unlocked would have nothing to do with the phone not having a data plan. Being jailbroken would.

being jailbroken or unlocked is not going to make a difference for a data plan since they are still on AT&T. Either way you have to have a data plan for the iPhone through them.

I meant how he got away with not having a data plan all this time. He must have done something to get it that way.

From my experience with AT&T, you can call them from your iPhone whether it be unlocked or jailbroken and as long as you are the accountholder and have all that information you can do this.

Call 611 from your iPhone
Go directly to customer service by dialing 0 three times.
Explain to them that you do not need a data plan and would like to put a restriction on it, this will prevent your iPhone from connecting to the internet through a cellular data network.

However if you need the data the whole adding your correct data package will not do a thing but allow your iPhone to be up to date with AT&T.

AT&T has that text sent out to phones with old data packages when they update their server. If you pay your bill online or over the phone you can limit the texts you receive from AT&T

oh i see. sorry my bad. yeah i dont know how that would have happened myself.

No need to be sorry, I phrased it weird in my first post :)

This is absolutely not true, and OP don't do this if you want any hope of blocking data on your iphone. You'd need to put the sim in another phone that is not a smartphone. And don't call FROM the iphone for goodness sakes! I think this guy is giving bad advice on purpose. He keeps telling people in other threads they can downgrade to 3.1.2 on a 3gs, they can block data by calling from their iphone, etc.

I like that :D And I shouldn't have accused him of that, when that may be the case. It's just frustrating because 90% of his posts lately have not only been flat out wrong, but they're going to cause people to do irreversible things to their phone (upgrade baseband, etc.)

so i unlocked it...does that not make sense?

No, it doesn't make sense. Unlocking has nothing to do with not having a data plan. In fact, unlocking has absolutely no effect on a phone used on AT&T. The only thing that unlocking does is allow you to use your phone on another carrier, such as T-Mobile. It doesn't remove your data plan or somehow hide from AT&T that you don't have te correct data plan for your iPhone. Nor does it change the terms of your mother's contract with AT&T.

Exactly what were you expecting unlocking this phone to do for you?
