...and that's the problem. Six or seven figures for the lawyers, coupons for the "affected class", and no admission of guilt or anything. I'm an Apple stockholder and I hope Apple takes them to court (or just buys them outright and fires their asses in the parking lot one Monday morning).
 
I was confused when I got this email a few days ago. I contemplated being excluded because even if the lawsuit had a point I'd only get a few dollars. But I didn't want to waste my time on such a pointless thing.

Well Honestly, I'm happy with my iPhone 4S, does everything but make coffee, although a device being made that you can control coffee maker via iPhones. There's an app for that! LOL. It's made my life and business much more fruitful. I make more money with apple products than ANYTHING else. So, I'm pretty content and don't need to be nickeled and dimed, even if the law suit was to receive $10,000, I wouldn't do it. I've actually never had problems with my apple products. So.... A stupid lawsuit. Nobody I know of complain about Itunes or ipods. If they don't like it, they didn't buy an iPod. And it's the same story. You don't need to buy Itunes. I burned music from CDs and imported from other sources other than the itunes store. These people just want free money.
 
Everybody was happy with their iPod when they got it - this is just a case of people seeing a way of extracting money from Apple.
I wish they'd just leave Apple to it - let them make great products at what ever price they want!
 
So how was it any different than satellite radio before the merger?

You couldn't play Sirius on an XM radio and vice versa, causing me to buy both receivers if I wanted both.

Also why has it taken 6 years for these guys to grow the balls to sue? Oh everyone is suing Apple now, nevermind I got ya.

I've owned iPods almost from day 1. I think I've bought about 10 songs from iTunes, the rest have been ripped from my cd's, bought from other services (amazon for example), etc. Somehow, I've always had the music I want on my iPod. The only stuff I couldn't play was one song I foolishly bought with amp security, I pretty much consider that my own fault.... What was this update that blocked other stuff? I guess I missed it.

Moronic. Apple, with all its cash, attracts these sort of things. Go sue google for all the times its "accidentally" invaded privacy, at least that might have some worthwhile consequences.....
 
Is the iPhone included in this class action? Because an iPhone can do everything an iPod can do, right?

No it wasn't, it was simply the most popular mp3 player. You need to read up on what monopoly means.

No it wasn't. iTunes works with the iPod - if you want to use different DRM, buy the appropriate player.

This is no different from what Microsoft did in the early 90's.

That's just stupid.
 
They might subpoena you to go & give evidence :D

The Court decided that everyone who fits the following description is a Class Member: All persons or entities in the United States (excluding federal, state and local governmental entities, Apple, its directors, officers and members of their families) who purchased one of the iPod models listed below directly from Apple between September 12, 2006 and March 31, 2009 (“Class Period”).

No. Not even because of the money either way. Because the results are necessarily 6-12 years after the fact.

The fact the lawyers ALWAYS make more money than the alleged victims doesn't help one little bit, but doesn't address your question. Only the defects in the legal system.

Two problems with the lawsuit, if their goal is to make Apple change:
  1. iPods play MP3 and AAC audio files (and a few other formats)
  2. Music sold on the iTunes Store no longer has any DRM
  3. Music sold on the iTunes Store can play on any device that supports AAC

There's no monopoly or lock-in in any of those three points. Apple will also probably point to the music industry as the reason why there was DRM in the first place.


Well one way I could see if requiring Apple to remove DRM from all music bought before they went DRM free and refund any money people spend converting their music to DRM free from Apple.
 
Class action lawsuits, although frivolous endeavors that seem to only serve the purpose of filling the pockets of a select few, are actually quite important to American society. Without it, companies and corporations would feel less inclined to follow through with environmental, health, safety, and fair practice that many Americans have grown to expect. As much as I hate to admit it, class action lawsuits such as this tend to help in the long run. Obviously, too much of this bad thing can lead to problems. Fortunately, we seem to have struck a balance though I feel bad for the "usual suspects" that lawyers have decided to their list.
 
I'm going to sue to cable company for no longer allowing me to record TV using my old TIVO.

When FairPlay came out, there really wasn't any other way to buy music online legally without DRM. And DRM had its flaws too. Apple use FairPlay to shut the mouth of the music industry complaining their downloadable music was going to be pirated right away. At that time, Apple was getting into this, so they had to follow the music industry's request. Later, when Apple was more powerful, they pushed towards getting rid of DRM.

Keep in mind that not all MP3 players that supported DRM were able to play DRM music. There was a compatibility nightmare going on.
 
Not happy with what all that Apple does, China Syndrome being one, but this is stupid and reeks of marginal legal ethics.
 
(Since this involves older iTunes technology) NEWSFLASH: Human females sued for entrapment! In a court in North Carolina a federal judge gave class action status to a group of males who are suing all human females for offering Adam the apple and thus forever condemning all of humanity to pay for that original sin. All males are automatically included in the class, as are all females in the defendant class. Damages are rumoured to be in the billions, with a suggested settlement of one date, a tree born fruit, and a plastic mockup of a human rib bone.

And, have they never heard of Amazon? I've bought literally tons of CD's from there in the form of MP3 files, and they play 'just like real CD's'... Sounds like three people in No Cal need to get out more...

To be included: You are already included, if you want to money fill the easy and fast online registration form.

To be excluded: Write a letter in a paper and mail it by regular/snail mail.
