I'm not saying it's AT&T's fault and I know I signed a 24-month agreement. But I'm not happy that others received an earlier upgrade eligibility than I did.

And I understand that it's a business decision for AT&T...but that works both ways! When the next iPhone comes out we'll see where I stand with Verizon on the next upgrade. If it is beneficial to me...I'll go back to AT&T.

With the porting of phone number to other carrier I don't really care who my carrier is...in cases...there is little (to no) different in coverage or service.

EDIT/Note: And I was 16 months (not 1 year) into my agreement...

Others received "an earlier upgrade eligibility” than you, because they pay more per month than you do (basically they pay over a $100 a month for their plan).
 
Not quite.. ETF is $175.. not $90. $90 is for cheap phones for "advanced" phones it's $175 if you bought on launch day.

I called AT&T on two seperate occasions over the past week...and even talked directly to their cancellation/termination department...and both times I was told ETF would be $90 for me.

Guess we'll see on Oct. 14th...the process will be performed automatically when I activate the new iPhone 4S. I gave Verizon my account info and cell number to port.

What is the prorated (declining) Early Termination Fee?
New and renewing AT&T wireless customers who entered into a 1- or 2-year Service Commitment prior to June 1, 2010, have an Early Termination Fee (ETF) of $175 less $5 for each full month of Service Commitment completed.

New and renewing AT&T wireless customers who enter into a 1- or 2-year Service Commitment on or after June 1, 2010, and include certain specified equipment, have an ETF of $325, less $10 for each full month of Service Commitment completed. Otherwise the ETF is $150, less $4 for each full month of Service Commitment completed.


If you consider the 1st paragraph (prior to June 1, 2010)...and 16 months into my current contract...then..

$175 - 80 (16 X $5) = $95 which is very close to the $90 I was told.

If you consider the 2nd paragraph (after June 1, 2010)...and 16 months...

$325 - $160 (16 x $10) = $165

or

$150 - $64 (16 x $4) = $86

And I was told $90 so AT&T better stick to that!!!
