You own your phone. Period. Your contract is basically an agreement that says that the service provider sold it to you at a subsidized price under the condition that you stay under their plan for the specified period of time. Thus, you may sell the phone (which is fully your property) any time you wish and continue the service for the duration of the contract on a different device.

I dont know if this is on contract, i tried to contact att, and they could not tell me if the phone is on contract, and that the only way to know s if i contact the original seller, but i cant seem to contact them.

on another note, its a coincidence, but your user name is very similar to the user's name that i bought this phone from on ebay, not saying a link or anything but i just noticed that.

right now i feel ripped and dont know what to do.

how do i check on this phone with att to see what actual kind of way it was bought? if it is on contract?
 
So you weren't the one who bought the phone on contract from AT&T? How long ago did you buy it?

no i was not, i bought it off someone off ebay, I bought it in late September of this year, when i tried to insert my t mobile sim, it said it was not a supported sim.
 


um, am not sure what is here, there is no text, maybe it did not come out, or you are making a snarky comment with your avatar, if so, not funny, like i said if anybody does not have anything positive or helpful to me, dont reply. We dont need this thread to get nasty needlessly.
 
You should not be buying used phones since you obviously don't know to check an ESN before buying. That simple check would have prevented all of this in the first place.

1. Sell it off on ebay as is. Clearly mention that it is locked to AT&T

2. Search online for other iPhone activation services. But they will ask $100-200 depending on the service.

I personally do 1.

If I sell it off on ebay, and it is on an att contract, could att come after me for payments? even after I sold the phone? would they go after the buyer for payments?

they'd go after you for payments. I assume your going to pay the payments and or the remaining contract in one payment?

Like I said, i dont need i told you sos, i know i made a mistake, and in the original listing, there was no imei visible for me to check, this was not an esn phone.

Well i dont know since I dont know the exact type of plan the ebay seller got the phone on, so how can i make payments if i dont know for how much or what plan the phone has, how do I find this out? I am having difficulty getting in contact with the seller.

I bought it off somebody on ebay, it was listed as unlocked, but it is actually a locked iphone on an att contract, (I know I made a big goof here)

I have tried to contact seller, am having some difficulty, and tried to contact att, but they were no help, they would not tell me what kind of plan the phone has, I have my own att log in, and there is no iphone listed among my devices, or purchases. The phone came with an att sim card, but has no phone number.

You need to call ATT and tell them were you got it from mate and force it on them to help you put your new iPhone on your own ATT plan. At this moment I'd imagine the person you bought it from is currently paying the contract (unless they have paid it all off) - Which that way its means its locked to ATT and you need to do the above, which is get a new contract with ATT

I know this whole thing is bizarre and very frustrating, why would they sell the phone to me and continue making payments on a phone they no longer possess?

i just dont to get surprised by a bill for a monthly payment on a plan that i do not know about on this phone, i want to use it on t-mobile, that is why i bought it, it was listed as unlocked.

you won't get a bill, unless you gave him your bank details and home address etc.

I'd imagine the bill is paid in full. You just need to force ATT to help to ether unlock that iPhone or put you on contract so you can use it.

He might have my home address, because it was printed on the package that was shipped to me, but I have not given any bank details, I paid for the phone through my paypal.

You want constructive help. Don't try to unload your mistake on someone else on eBay by selling this same phone again. Keep the phone set it in place you will see it daily to remind yourself. Stop trying to recover on your loss by cheating someone else.

Based on the information you provided in this thread ATT cannot come after you. There is no contract between yourself and ATT. They can only go after the person that you bought it from on Ebay.

for your info, if you read a bit further on, I have taken the phone off ebay, I am not going to offload it onto someone, so before you get snotty with me, i am not going to cheat someone.

I am sure you would be fine being out a bunch of money on this, but oh yeah, your perfect and would not make any mistakes.

Believe me, if someone ripped you off or was dishonest about something on ebay that you bought, you would be angry too, so forgive me for being human and a bit mad about all this.

your post was not helpful to me, you were on your soapbox about buying off ebay, even if it was not directed at me, it felt like it was, it was a comment in response to this thread. There was sentence with the word you in it so it was directed at me.

Selling the phone itself is fine, but the trick is what if the person you sold it to want the phone unlocked later? That, I wouldn't know.

It would seem your biggest mistake was to settle for a partial refund through eBay. My suggestion would be to take it up with eBay again through their telephone support. Explain you mistakenly settled for a partial refund when realistically the phone is contracted to someone else & the company it's locked to have refused to unlock the phone.


Also HEK is right, don't pass this onto someone else. This could be solved through a long phone call to eBay.
