OP, you are in the same situation as me last year.

I bought an iPhone 6 off eBay, buyer said its unlocked. When I got it, it was a locked phone bc my T mobile sim didn't work.

I contacted the guy who said he bought it off a guy that worked at ATT. I contacted the original guy and he admitted its in contract for another year. I was upset bc this guy could just stop paying the bill, and the phone would be shut down. So I contacted Apple. With Apple, I asked if I replaced this phone under warranty, that it comes with a different IMEI and serial number. They said yes, so I asked them that if the guy stopped paying the bill, would the new one be shut off? They said no, since the replacement will have a new IMEI and serial number that isn't tied to the ATT contract.

So thats what I did, I replaced the phone with Apple, then submitted an unlock request and it worked instantly. The prev one did not no matter how many times I tried.

I suggest you replace it at apple if you have warranty.
 
Replaced with Apple? How about a few details? Did you have to "invent" a few warranty issues?
No I told them I was worried that the guy would stop paying and they said I could get it replaced. So I asked them if I could do an express replacement and they did. It was pretty easy but I never lied about anything. Its all luck with Apple I feel.
 
Isn't that what's meant by "in contract"? If not, I apologize for misunderstanding.

You're right - a subsidized phone = a phone purchased "under contract". In other words, you pay less $$ for the phone up front, but are tied to a contract period, and pay an additional amount each month on your carrier bill until the contract period is up. You own the physical phone, but are obligated to continue paying the bill until the contract is up, or pay an ETF.

So exactly what I thought then. In which case, no, it isn't illegal to sell such a phone. It's yours.
 
I bought it off somebody on ebay, it was listed as unlocked, but it is actually a locked iphone on an att contract, (I know I made a big goof here)

I have tried to contact seller, am having some difficulty, and tried to contact att, but they were no help, they would not tell me what kind of plan the phone has, I have my own att log in, and there is no iphone listed among my devices, or purchases. The phone came with an att sim card, but has no phone number.
Open a claim on eBay and return as lying in description of being unlocked
 
It's not illegal now to sell it on ebay but it will become illegal when the original seller stop paying.

I would call eBay. You may not open a case because it's already settled but you can still call them. If they don't help you, sue eBay. Call paypal also.

well I just got a reply from the seller saying they cannot afford to pay off the phone, so I dont know where tbat leaves me now.

so I guess they cannot get it unlocked for me.

That is completely messed up if he didn't state that the phone wasn't already paid for
Open up a claim through PayPal and or eBay before it's too late for sure

Well it looks like your gonna have to pay the phone off than, no one will buy it and pay a few hundred than also pay the 700-900 to pay off the phone to have it unlocked

I dont have enough money to pay it off

Duh. That's why you're supposed to ask for it. No one willingly publishes a serial number due to fraud. If you didn't ask, that's your fault. If the seller didn't want to provide the ESN/IMEI/MEID, then you would have known that it was a bad deal.

Really. Stop buying used phones since you don't know what to do.
 
I would examine it with a microscope if necessary to see if you have any of the famous screen issues. Maybe the dreaded blotch (I think that may only be on the 6s+) or maybe the uneven backlight or yellowing problem. Check for loose buttons, bad headphone jacks etc. Then take it to Apple for a replacement. The replacement may still be locked to AT&T but since they will have no record of it they will unlock it for you. Problem solved. :)
 
@Sossity Do what these guys are saying about replacement.

You are desperate here. Invent your own reason to exchange. Best one would be "extremely poor battery life and phone getting hot even after full software reset."

It is hard for the genius dude or dudette to argue. It's your word against his/her so they will give you a new one.
Be a little aggressive so that they will offer least resistance to exchange.

Others in here please provide good suggestions to OP to get his phone exchanged. Come on. We gotta help this guy out!
