I am not the original owner of the contract, it was sold to me this way I dont know what needs to be paid off, so how could I with the sale money from it?

Knowingly selling a stolen item? Eventually it'll be labeled as stolen or lost as the person will eventually stop paying in it

This is of course assuming some sort of eip

You are desperate here. Invent your own reason to exchange. Best one would be "extremely poor battery life and phone getting hot even after full software reset."

It is hard for the genius dude or dudette to argue. It's your word against ohis/her so they will give you a new one.
Be a little aggressive so that they will offer least resistance to exchange.

Others in here please provide good suggestions to OP to get his phone exchanged. Come on. We gotta help this guy out!

thanks for your support, if I take the phone in or mail it, should I take the att sim card out? I would think it would be better to avoid them just giving me a new one with the sim card in it again locked.

It's not illegal to sell the iPhone while it's under a contract. You'll still be responsible for the payments you agreed to pay to AT&T though.

Also, AT&T is under no obligation to unlock the phone because contract terms have not been met. If you use a third-party unlock service, like the one you mentioned, the phone will become locked again to AT&T once a new software update is released. AT&T has to release the IMEI number so iTunes can complete an unlock process. If they don't authorize an unlock, whoever you sell the phone to would be out of luck. You're better off just paying off the difference and then requesting an authorized unlock from AT&T.

Contracts are not tied to the phone so doing whatever you want with the phone that you own is perfectly fine.

He didn't sign a contract with AT&T, so he isn't responsible for any payments to them. Which is an issue, because if the person who DID sign a contract with AT&T to get the phone doesn't make them... And that person has no incentive to make them any more, since he has his money already.

He also can't find out how much is left to pay off, since he didn't sign the contract with AT&T (see #1). So even if he wanted to pay off the balance, he can't find out what the balance is. And he can't get an official unlock until the balance is paid off...

That person has the same incentive to pay as was there before selling the phone--not going into collections or getting their credit damages.
 
Why are people giving wrong advice in circles? For f sake..

Once and for all,
1. Get a replacement iPhone from Genuis bar (Invent any reason to get it replaced)
2. Do not tell them it's locked to AT&T unless specifically asked.
3. Keep the AT&T sim for yourself (Just in case the replacement is locked as well and to activate it)
4. Once you have the new replacement, go to the AT&T unlocking portal and submit an unlock request.


People have gotten phones unlocked this way.

Once I had gone to Apple Store in White City, London. My phone on Three UK network was locked under contract. I merely replaced it due to some actual fault with the screen brightness. They gave me a new one.

To my surprise, it was already unlocked.

If you read this thread more carefully you would know that I was not the original contract owner of the phone I got it from someone else who got it on contract, how can I make payments on a contract that I do not know about? I don't know exactly what is owed on the phone, because I have as not there when it was first bought from the carrier

Thank you, I been starting to feel like I am being made out to be the wrong one here, I was ripped off, and some are saying I am slimy and deserve this, with some posters getting on their high horse lecturing me about paying off the freakin phone when for the umpteenth time I have said I was not the original signer of the contract!

Apple genius bar will not divert from your main complaint. If they ask you, tell them that you dont know about locked or unlocked. But quickly and smoothly bring them back to the topic of your original complaint.

Main thing is to get it replaced. From here I can tell that your phone is overheating and is having crap battery life. You must get a replacement. :p
 
Yeah, the only thing illegal in this is Swift Unlocks actions in recruiting AT&T employees to install malware on AT&T computers in order to allow the owner of Swift Unlocks to illegally gain access to submit unlocks.

That's why they (Swift Unlocks) and three AT&T employees (now since fired) are being sued by AT&T. Not the mention the 50 other AT&T employees AT&T is aware of.

And AT&T has recalled the unlocks submitted by Swift Unlocks. So. Take your chances there.

As already stated, stop paying though and the IMEI gets blacklisted. Not a nice surprise for the buyer if that happens.
Seems like the scenario of the seller not paying for the phone anymore will not happen a lot

Most people are upgrading and just want to use the current phone to offset the cost of the new phone and will keep paying on their contract line.

Yeah, I am getting very nervous, if they look at the serial number or imei, won't that tell them everything?

I recently calling apple support the other day, and they wanted to run diagnostics on the phone while I was on the phone with them, I told them I could because I did not have the phone in my possession. From there they would not go any further with the phone, when they asked for the imei, I told them that and they go the phone has not had an iOS update and to try that first.

I do not drive, so I would have to get someone to drive me to the Apple Store, and I do not want to involve family in this I could get a bus or something.

But this seems like my only option, I have never been to an Apple Store before.
 
You realize that by lying to Apple to get a replacement on a non-defective device, you're attempting to commit fraud? Ethically, morally, legally, it's wrong. Apple didn't do this to you. And even if you take it to the store, they're going to do the same diagnostics on your phone as you apparently won't let them do now. All you'll be doing is wasting your time and bus money.

Have you attempted to re-open a case with PayPal or eBay yet? That's your legitimate route.

i sold my galaxy s6 on optus [australia] on contract, in less than 4 months of use lol because i didnt like the phone and samsung were announcing price cuts so i had to sell it asap to get maximum value. then eventually just changed to iphone 6s+ unlocked outright...

I'm still solely responsible to pay for the outstanding charges if that helps but because i got an offer which included 0$ phone costs [right now is 16$/month phone extrs] and the mobile plan is attractive alone. might as well use it because personally cancellation fees are so expensive and you might as well use the service while u at it...

and prepaid is almost if not near exp as postpaid plans [just prepaid u can bust ur data usage without worrying thats pretty much it but postpaid may not warn u so yea]

Most iPhones usually aren't locked so far if i recall hence why they don't have the carrier bloatware which android always does put in from what i experienced before.
 
Ok guys. I apologize. OP, If there is any problem with the device then only get it replaced.

Else it would be nearly impossible to get a refund again from ebay or the seller once the initial case is closed.
 
If you bought the phone on eBay, I don't understand why it is in contract. So why is it? If it's locked to Att, that's not really a big deal. Being locked to ATT is different than being on contract. I sell my phones in eBay every year and they are locked to Att. It's never been an issue. If the seller had a contract with Att, then that's their problem. They are responsible for those payments. The only problem is that Att could decide to turn off the service if the payments aren't made.

They can also (AFAIK, since I'm not an AT&T customer) black-list the phone internally and refuse to activate it on their network if there's money owing on the subsidized amount. And they can stop it from being unlocked. Basically making it a nice iPod.
