The real issue is that Apple and Samsung can't seem to settle.
Samsung has no interest in settling.
"Patent disputes against Apple will be continue," said the Samsung CEO.

Apple wants a billion from Samsung,
Apple was awarded a billion by a jury.

but only wants to pay peanuts.
Apple offered to pay the same as others are paying for a FRAND license

Not the reason. If that were the case, we'd be seeing more Presidential vetos in favor of US companies.

Really?! Apple is a major US employer, it has major US stock options, major US sales, come on, the only ones that see this as a victory are the apple shareholders, the rest of the world see's it as bully boy tactics at a political level.

I should point out that i agree that Samsung was wrong, but at the same time Apple isn't squeaky clean, having fixed book prices, mis sold Apple Care products to name a few.

At this rate we might as well have a Legal Blog/forum for reporting on and discussing these endless slap fights.

... Then I can put it on my excluded forums list! :D

Funny thing is that if you said this about Apple, you'd be immediately banned for trolling. I wonder if the mediators do this to you in this case or they are OK with such hypocrisy.

Why would I be banned for telling the truth?

And they're on the hook for fixing book prices. Apple is not squeaky clean and when they do something wrong they get in trouble. Stop trying to find conspiracies where there are none.

Not trying to find a conspiracy, the facts are simple US standing for a US company, Samsung and any other company don't stand a chance, which is ironic when nearly all consumer electronics in the USA are made in Korea or China.

Again, apple is on the hook for the ebook thing and were investigated by the US for the not paying enough taxes thing. So your theory doesn't hold weight.

Apple has been in trouble with the US before, and they will be again. The import ban was overturned because it was granted over SEPs. Nothing more, nothing less.

Eh the only thing I think about about when I see Samsung is "Make a comeback Sony" Samsung stuff is good and all just so ****** vanilla. No swag

Besides a couple TV's they make, those silver framed ones have swag.

If you feel this way about Samsung then Apple must mave you want to vomit.

Nobody in the US has or is currently investigating Apple for any tax-related issues. You are confused. Apple was asked to speak in front of Congress about its tax policies, it was not under investigation. This was congressional committee meeting, not an investigative action.

 samsung had already stopped shipping those products, how would this benefit apple. apple should have gone for the GS4 or the upcoming note 3 that's what would benefit them, big time.

The ban is not important. The ruling forces Samsung to actually innovate and not steal like they've been doing.

At long last, "somebody".. won
Weather it was Apple or Samsung, i don't care..

I'm glad this one is all over, (till next year that is)

Innovate, because that's all Apple have ever done. Yeah right.

Build a bridge, kiss and make up, and just get on with working on the current devices and put something decent out. Try that innovation thing, not just a rehash of last years product. So many great looking renders over the years they could be taking cues from, or don't they want to pay anything to the design originators?

Copied or not, many things these days are influenced by products already in the market. Cars are a good one, more and more different models here are looking more and more alike. It's not copying, it's influence.

You see, that's what I mean, you are already of the 'opinion' you were supplied cold hard facts because a website told you so, yet several dozen of the worlds top news outlets do not agree with you, unless they retracted their story's, which you haven't stated if they did.
No point in discussing the topic with yourself as it would go no where.

Top or not, as long as they don't do enough analysis, they become very incredible when a different piece of analysis points out the hole in their guess (not direct report from Apple or Samsung themselves, they simply guessed the numbers out of the reported data).

Not ignorant at all, Apple tried to patent round corners and claim Samsung stole them, Samsung counter claims Apple has stolen from them.

Both are heavily abusing a corrupt patent and courts system to win business advantages and market share, it seems to be their chosen method of business now. Shame but their we are.

At least they are keeping the lawyers employed I guess.

Copying one or two attributes of a product isn't really evil, since the modern industry is nowadays so complex and you have to include resources from a lot of places to make a final product. What made Samsung VERY EVIL is because it copied iPhone (from the first iPhone, to iPhone 3G to iPhone 4) and iPad at almost EVERY EXACT DETAILS from outside to inside, and ADDED NOTHING REALLY NEW of their own, especially when the products being copied by it was still HOT AND FRESH on the market. THAT'S EXACTLY WHY APPLE SHOULD SUE SAMSUNG TO DEATH!!!!!!!! THE MOST SAD PART is, the patent system does not have a way to help Apple set up a legal case based on the percentage of resemblance!

the tax dollars being spent on this back and forth patent battle between these 2 corporations is astounding. i'm afraid to even ask what the real number is. we sit back and laugh and make forum posts but no one is asking the question of how much of our tax dollars are being burned in this fiasco.

it's such a waste of time and attention on both sides. i can only imagine what innovations they could accomplish if they could shift their focus, time, and money back to the products and not to litigation. at this point, both sides are to be blamed.

the entire country needs to downsize the legal profession

I actually suspect that without Apple suing Samsung, there would never be the Galaxy S3 we know of, Samsung's first premium modern smartphone that is not a FULL COPY of previous iPhone models. In that sense, Apple's legal attempt did help improving the health of the industry.
