so being that apple has changed the iboot on the 3gs's and are now updating firmware at the stores before the customer leaves (which they never did before-they're only supposed to activate it) it seems like the Cat is beating the Mouse...

The mouse has been on top with the new 3GS since 3.0 was released all the way till 3.1.3
A tethered JB might be an inconvenience but its still a JB.
For 2G and 3G iphones its still simple to JB.
Seems like the Cat has put out 3.1.3 to flush out some more remaining exploits untill the next 4.0 firmware betas are released to developers.
So those careless enough to update their JB iphones to the latest firmware or the unlucky ones to receive new or refurb unit with 3.1.3 preinstalled have to wait for the next JB to be released. The Mouse always has something up its sleeve. They dont think 3.1.3 is worth revealing an exploit that might be used to JB the new 4.0 firmware or even one that possibly could be used on the new iphone released this summer.
 
I'm sure this is a stupid question, but this is the first time I noticed the 5.11.08 baseband in your thread. I thought there was only 5.11.07. So, what is the 5.11.08?
