I say well done... anyone who understands the legal system and is able to recognize "justice" without bias knew the jury did a very poor job in deciding this case.

Their findings were ridiculous, and their compensation judgement was even more ridiculous.

Judge Koh is applying law and precedence to this case, knowing that if she does not, it stands zero chance of stability through an appeals process.

Face it fellow Apple fans... Apple is not special, they are not exclusive, they are just another large corporation doing their best to make a buck.

Sounds like the correct decision, to me. These details must be worked out--not her fault. So a new trial is needed to make up for the technical failings of the first decision. Too bad, maybe, but the law is complex.

to paraphrase

So shines a good post in such a weary thread.

Did I call it or what? I told you she would eventually overturn the jurys' ruling. I bet she's also the next judge Samsung hires. Just pathetic.

And I think that people is confused, it is not a new trial to decide if there is infringement, it is only a trial to determine the damages owed to Apple.

Yet Apple has smooth animations while Jelly Bean is still chugging. This is why Apple patent UX and design.

I am in no way saying you are wrong, but how is Jelly Bean chugging? I ask because I own an iPhone 4S for work, and I have a Galaxy S3 for personal use. Maybe it is because I have a 4S, but the Galaxy S3 seems smoother and faster to me.

Just asking. Not saying Samsung is better or Apple is better. They are both companies that make great products (in my opinion).

I didn't even realise you could do that until now. What use is a jury if they are not the final verdict... I thought a jury was to get the average answer from many (unbiased) yet 1 judge overpowers something. She could have been easily bought especially with a nice hidden way of doing it since she would probably live happily in Korea ever after.

When did you call it?

And yes - clearly everyone and anyone that doesn't vote in favor of Apple is going on Samsung's payroll.

How logical and astute of you.

I'm curious - I'm making some tin foil hats for some of my friends. Since you love yours so much - how many rolls do I need to make a really good one?

Don't waste your time

So now that lawsuits are clearly not going to fill the gap where innovation once stood, what's apples next move?

K I have used both platforms and I know which is a better UX. I am a designer myself by the way since 2005.

You missed the entire point of his post. Maybe you need to go back and read it again and you might learn something.

er no. he is talking about UX and I am saying that Apple patents things that lead to good UX. He is referring to UX as being stability only. That is only one portion of UX.

Next headline is "Judge Lucy Koh has been hired full time by Samsung."

No - it's more like "AAPL Shares Sink On News Of Koh's Revised Judgement"

That's not me being snarky. At all. It just that for some reason or another - Wall Street likes to tie share price with things like this - regardless of whether or not it's really all that important.

Next move is to only make products for themselves (in house use) and watch the tech innovation get turned down to turtle speed again.

No point in continuing this line of conversation since his post/account was removed it appears.

We'll see tomorrow I guess. But AAPL just closed at the lowest in the past 52+ weeks. And there's already a ton of headlines from outlets that have picked up this story. I'm betting at least one refers to the drop today/tomorrow as being related.

Judge Lucy Koh needs to pay damages to both companies and to the jurors. She should have gotten this right the first time. If the jury didn't return the right results in terms of damages she should have made them go back in to deliberate.

Some of the misogynistic and racist comments towards Judge Koh are truly shocking to see on a site like this. Fanboyism at its worst.

The reality is that some of the jury's damage awards for specific devices *were* wrong, and Judge Koh is declaring a do-over on those elements the jury messed up on. Absolutely fair and the right thing to do.
