Wouldn't that be Fraud which is statue not civil law, in that you were misleading about your intent when you entered the contract?

Show me my signature on that contract then, please.

Also, in the privacy of my home, I may do whatever the hell I please with the software itself or its physical media, up to and beyond installing it on my toaster, using the disk as a coffee stand, or copying the disk image wherever I want, inverting every bit in it and XORing it with 0xDEADBABEFACECAFE string.

As long as I don't complain to teh Steve about my toaster not working anymore, or that the disk makes a bad coffee stand, or whatever, it's not their freaking business.

I would prefere to obtain hard copy ( DVD, USB key ) so that i can do fresh install or reinstall easily without worrying about downloads, updates, keeping restore partition safe etc...

I guess they limit the spread of hacked copies of OS X buy having it download only. I can't wait to update! I would love for a speedier OS. Even though it's WAY faster than windows and still flies on this quad core!

Fixed that there for you. Many people aren't interested in the Mac App Store, many others don't have the broadband required for the download, and yet many others just want a physical copy from a store.

Why limit your legit customer base to spite your non-customers ? This isn't the movie industry like someone else mentionned.
