minus the fact that Apple App Store as not the first App Store. It was generic when App first used it. Just most other companies before hand were smart enough to not try to use a generic term. They used other names. I know there was a palm App store back in the day (Handgo or something like that never really got into it)

I am more amazed that people keep trying to defend Apple.
Apple made several critical mistakes. One it is never put any type of generic term out there.
In Apple OWN PRESS EVENTS they called other Application stores APP STORES. Hmm that goes to show that even Apple is treating it generically. That is a problem. Apple uses the term generically and they never should of. They screwed up and now they are getting hammer for it.

Tell me how will you deal with this question from a judge if you are a Apple. "How is the term App store not generic if you yourself used the term generically to describe other application stores in your own press release and press events?"

Come back to me when you can answer that question.

Read your own link, that's not a "store" that sells TVs at all :

It's an ad agency. It's not at all related to the "App Store is just an app store" story here.

I think Microsoft should call its app store "The Microsoft Bing Store."

They've already named it "Marketplace". Why would they change the name ? This is not about Microsoft looking to call their app store "App Store", it's already been named, and it's in operation as we speak :

I'm with MNN, some of you need to READ before REPLYING. Most of you are just plain wrong in your eagerness to defend Apple.
 
So what you are saying is that "TV SHOP" is not a shop that sells tv's. Therefore it is not descriptive and is not pertinent to the discussions.

I'll admit that it is not the most descriptive name for what they do but they still are a televised shop hence TV Shop.

I believe someone else previously mentioned that "App Store" isn't the best name for what the app store actually is and probably "Software Market" would be more appropriate.

Anyway, I'm done debating... this is one for the courts to decide ;)

None of those are descriptive of what they represent, which is the point here. The "App store" is a store that sells App.

Ms want to try and dilute the ongoing terminology which can be connected back to Apple technology.....ie ipad, ipod etc etc. It all reminds people of Apple.

Microsoft aren't selling windows called Windows, they're selling an OS called Windows. It is a generic phrase, but it's not a generic phrase for the object it describes. App Store is (to me at least!) a generic phrase for an application store.

I agree. It's not like Windows is actually a shop that sells Windows. The App Store is a store that sells apps. The name has become very popular recently, mostly down to Apple of course.

It would be OK. However, Apple would not be allowed to prevent other companies from using "app store". For example, other companies would be able to say "Find your favorite game in our app store!"

My + Space = A space for individuals, hence using the possessive adjective, my.
Ever + Note = Notes you can always keep with you. Ever
Four + Square = hahaha. four squares. I dunno bout this one, but the words are generic.
Kentucky + Fried + Chicken = fried chicken made (or the recipe is supposedly from) Kentucky
General + Motors = general motor vehicles
Walk + Man = Not very descriptive, I concede, but the "walk" is a definite giveaway... man probably came from Panglish.
Touch + Pad = a pad you touch
Angry + Birds = very angry birds
Sketch + Book = an app which simulates a book where you sketch on
Photo + Shop = not a shop, I agree, but considering it was for digital manipulation of photos for professionals, not very original
Light + Room = possibly coined as the opposite of dark room, but same thing, like the walkman, real easy words indirectly implying the usage.
T + Pain = he inflicts pain on listeners. :)

How about the MS Kin? That's a good brand name... considering it's for socializing so naming something "kin" isn't reminiscent of the purpose at all. hehe.

Simple easy words in a unique enough combination to reflect its usage.
And not being used by anyone else.

The "App Store" is a place where they sell apps. Yes. Which is pretty good branding.
 
Even if Apple were to lose the suit and have to allow others to be able to use App Store (I do find that many people here have presented very reasonable cases against the use of App Store as a TM), I wouldn't see it as too big of an issue for Apple's own App Store. As it's been stated, App Store tends to be connected with Apple, so even if others can use it, the term may go the way of the Xerox.

App Store is definitely descriptive. It very well might have achieved secondary meaning. Should be interesting.

I've been using the term application since 1990 (since the day I first had a computer) and I've been a PC only user. Program and application have been always interchangeable

Here's a quote from a news article in the 80s (Toronto star)

"Microsoft says "most" MS-DOS applications can be run under OS/2, but only one at a time. MS-DOS applications won't run under multiple windows"

Hell... Run windows 3.1 and click on the about for program manager - it describes it as something to sort your applications and to top it off... I notice there is an apps.hlp In my windows 3.1 dir- guess what's in it? References to Applications ZOMG

App is just short formed application, and I've been using that for 20 years too... So has Microsoft as referenced above... So has everyone else

App store is generic. Apple should lose the mark. Apple App Store is ok.... App Store is not. If the name is a descriptor for what it is, while also being applicable to others... That right there shows how bad of a mark it is.
