I've been following, it sucks that you have to grow through all this. I've had something similar on a projector a while back. As long as you follow everything for buyer protection PayPal will side with you.

Don't be relaxed with paypal and eBay

I have been buying and selling on eBay for just over 5 years now with 420 100% feedback score and agree with the guy on here who says paypal and eBay are reluctant at giving away even a penny!

Every situation i have had with eBay/Paypal claims i have lost including:

Counterfeit items
Buyer's Unconfirmed address
Faulty items

If you receive the iPad and it is a fake - paypal will only refund you if you get Apple to look at it and then have them sign a piece of paper declaring that item is a fake. For my situation i had a fake Hugo Boss jumper that had numerous spelling mistakes and pay pal's response was that i could of created these mistakes on purpose by using a program like photoshop - Are they CRAZY?! It is actually an offensive to mail a counterfeit item so i was braking the law sending it back to the seller whom agreed to refund me my money.

At least you had the wherewithal to ask a forum for help. The seller probably saw you were new to eBay and could pull a fast one on you. I'm a long time eBay user and it's actually not bad at all (aside from the fees) when you know what to look for when selling/buying. But I agree with everyone else, you will get your money back if you never receive the item listed. I've also delt with PayPal a few times and their customer service is great so don't be afraid to call them too. $560 is nothing to shake a stick at.

I found out something interesting only yesterday. Sellers are not allowed to leave negative feedback about buyers.

I would alway refrain from leaving negative feedback as a buyer as I thought they would retaliate. Now they cannot.

Sounds like you got some guy who was trying to resell them for a profit, and he ran out. He probably ordered you a new one from apple, and thats why its taking so long... I'm trying to remain positive about this.

Because, in all honesty, paypal/ebay are on YOUR SIDE 100%. If you never get the item or if it comes and it is different than what you were told, you fill out an affidavit and they refund you the money. It is a SUPER easy process and I couldn't have been happier when I got a broken pda that was supposed to be a new one.

On the reverse of that, if you are a seller on ebay... there is very little you can do you keep them from yanking money straight from your bank account if someone files a complaint against you.

I've been on both sides of this issue, and it is definitely in the buyers favor every time.

BOTTOM LINE: Do your research next time... and you didn't need to go to an apple store for an iPad, they're literally everywhere!

This. Update:

There's been activity from USPS.

Looks like he shipped it to his location and was not there to sign. It is looking like he ordered it through apple, Is there an apple factory in shanghai? Still he couldn't provide any receipt.

But the thing is, Apple doesn't ship via the postal service, Chinese or US. They ship via Fedex or UPS. If this is an iPad and really is coming from China, then I'm willing to bet this was not a legally obtained device.

Not sure where you got that info, but it states right on the Apple page they use USPS: "*Items shipped Standard via United States Postal Service deliver within 5 to 7 business days after shipping." http://store.apple.com/us/help/shipping_delivery

Stopped dealing with Ebay years ago. Too much of a hassle, especially for sellers. Not worth it.

OP, do you mind telling us how old you are? There are some major gaps in common sense and basic online transacting safety knowledge here that are worrisome, and I'd be interested to know if that's simply due to inexperience or naïveté.

An iPad will require a signature for delivery. USPS doesn't do this with Apple packages, a fact that Apple even notes on that page you linked to. Therefore, an iPad is going to either come UPS or Fedex.

No need to belittle the OP. Many people who don't know the ins and outs of eBay have been fooled and, honestly, as far as sketchy listings go, this one isn't anywhere near the worst I've seen.

Just now received an email from eBay informing me the seller has requested to cancel the purchase reason being; "it's out of stock"

According to eBay: You should only accept the cancellation request if you haven't paid yet or you've already received your refund from the seller. If you haven't received your refund, contact the seller.

I'm given until April 4 to respond otherwise he can cancel without my consent. Theres also been some activity with my paypal claim, so far they have asked him for tracking information, no other action required yet on my part.

"Out of stock", and yet *something* was shipped to Great Neck, NY. It can't be both. Obviously something fishy going on.

The good news is, the more conflicted and fishy the e-paper trail appears to be, the easier it should be getting your money from PayPal.

Wow. So how much were you going to save on this versus just buying from apple or bb?

$10 more to receive it in 3-7 days, rather than 2-3 weeks from apple. Did not think about authorized resellers like Walmart, BB, Target, etc. Obviously I was not thinking. :(

It's a knock-off. You saved a lot of people a lot of headaches. Is he still selling or has his account been suspended? You can notify Apple too that you suspect he's selling fakes...they will investigate him.

His account is still fully online. I doubt account suspension will stop him, can't he just make another account?

I'm glad other people have been following my struggle, hopefully others will now be better equipped when considering eBay to buy high end items. I feel bad for the other 8 people he sold iPad's too, I wish there was some way I could contact them?

Don't blame ebay, i bought many items and no problems...

You should blame the seller, but if you pay by paypal you can open a case and get a refund

My main issue beside feedback is the lack of a seller, personal item description.
When They dont bother giving a description, I move on.

Have you tried phoning eBay? Although they trade separately, they are still the same company therefore sharing the same processes. If you ring eBay, they'll be able to assist especially if you already have a PayPal claim open.

You'll want to get the refund from PayPal before cancelling the sale.

I really hope this all works out for you.
