I got mine today! I was on Simplicity tariff they didn't update their system properly so I was eligible for upgrade even though i got a 3G last July.
 
Wow. Just been to the o2 store and even though i'm on the £45 tariff and it expires in December i've just upgraded for £37.

o2 said that i'm a silver customer, when the guy in store called CS it looks like they reviewed my account and as most of my bills this year came in over £80 they offered me the deal. I spoke to CS earlier today and they said i needed to pay £165 to get out of my contract. All i can say is when you get a chance pop into your o2 store and see what they can do, sounds like some of the CS guys are willing to review your account and offer a deal.
 
OK, so I thought I'd play along even though I know my contract doesn't expire till next January. I entered my phone number and got an upgrade code by Text. Cool, I thought, I'm one of the ones who O2 are going to let upgrade early.

So, I eagerly entered the upgrade code into the relevant box and...





It said "You can't upgrade yet as you are not in the last month of your contract"


Got to laugh - they had me going for a minute :D

Haha!! We must be in parallel universes because not only am I on the same tariff as you with the insurance, I also tried a sneaky upgrade.

Same thing happened to my dad last night, I think it really does have something to do about whether you had a 1st Gen or not. I would be eligible for an upgrade now if I had kept that contract going (bought at launch). But I upgraded to a 3G last July.

My dad's story.. he got a 1st gen in the March before the 3G came out (so.. 3 months?) then upgraded to the 3G that July, he might become eligible by this weird loophole in another couple of months...

so basically (and this is just my guesswork) if you got a first gen iPhone go by the initial renewal date and see what you can get.

My contract would not have expired till Jan 2010, I was on £45 a month and my bills were very rarely above the £45

I did have a first generation iPhone, so maybe I should try in a few more weeks. I'm not holding out any hope though... Looks like I will have to skip the 3GS and probably just wait until June 2010 for the next model.

This news fills me with excitement. Looks like I will be getting mine on Tuesday then!
If I could ask one thing though... Has your "my o2" updated witht the relevant info? I'd hate for their balls up to mean that I end up running two contracts :-/!!

Well my O2 shows the order, but it hasn't updated to show the phone being delivered to me

I got slightly paranoid that they were going to charge me two tariffs so I emailed them that very question (in a naive, simple me type way) and they responded that I would not be charged two tariffs. So I think all will be well.

this little loophole doesn't seem to be very well known. Tried doing some googles to get a bit more info or stories from other people but nothing. Not even on o2 forums. Glad I come here really!!!

Mum's iPhone 1G contract, which she got in January 2008, is coming to an end this week. Phoned O2 for upgrade to 3G S.

Bare in mind mum has been an o2 customer for about 15 years... is on 35 a month contract with them. Yet still they said that for her to upgrade to the 3G S it would cost £187!

£187!!
 
Mine has arrived as well, hooray! Also spoke to someone who was able to do the same deal in an O2 store. Seems if you are eligible on the upgrades.o2.co.uk website you should be able to do it in-store too.

when i called O2 they said no to an upgrade, but when I emailed the answer was yes

That is a substantial discount on the full price.

It costs £440 for a 16GB model or £538 for a 32GB model to buy outright!

Cost £84+vat for each iphone 3gs 32gb.

The only plus side is I can upgrade every 12 months regardless so makes no odds to me.

yup when I login to my O2 it shows my contracting now expiring in dec 2010.

Interesting. Mine is now trackig as complete. So I should get it tomorrow. But my o2 is not saying that my contract renewal is June 2011. Despite me going for an 18month contract.. Unless they decided to tag 18months on to my existing one? Haha nevermind I've proof of upgrade date and how long I got the contract for
