Thanks, so that would prove my point. If an item continues to make money for the company it came from, the OS update will be free. If the item only made the company money once (buying it) then you have to pay for the OS upgrade. It makes sense to me.
 
Damn, wish i got one delivered to me for free. Your under no legal obligation to return it, and it is legally classified as a "Free gift" from Apple.

No. Apple can check their inventory to locate a missing unit, BUT they cannot legally charge you for it under federal law. ATT will just see another paid phone.
 
I came up with a quick list:
1: use both and act like a total prick and be like "I have two iPhones you can't even afford one".
2: Get a video camera set it up in front of you take the phone out let the crowd look at it, then put it on a plate cover it in gasoline and set it alight. Post it on YouTube, See how many crazy comments you get. That or just eat it whole.
3: Find a hobbo and give it to him with a full explanation of how it works, then call the police and report it stolen just to have fun
4: Call apple and tell them you created a cloning machine and you have proof.

Um.. Idk seriously though just return it and get a headset and an iTunes card, good credit for new accesorys for a new item especially If your like me and buy the thing without anything.

Yeah, Apple mistakenly sent the original poster two phones; we established that. The original poster is not within his legal rights to keep both phones without fear of being charge, as his deliberate disregard of the duplicate's arrival puts him on the losing end of a quasi-contract. There's a decent chance that Apple will find out that two phones have been delivered to the original poster and, if they do, they will undoubtedly charge him for the second phone. Think of it this way... if you accidentally paid twice for the iPhone 3GS, you would want Apple to refund you for one of the payments and, if they didn't, you could take them to court and win.

I swear, we'd be a better country if some of you fools were just forced to attend mandatory technical schools without access to non-laborious portions of the internet.
 
Then if you wanted to do the right thing, you would return the second phone to Apple. Otherwise just sell it to offset the price of the other phone...

Agreed, but that's just me, I would contact apple and try and return it.

for all you know they might not bother collecting it and you'll get it for free :)

either that or they might even give you something nice for your honesty.

Sell one on Ebay.
Take one apart.
Keep em both and when you scratch up the first one, you have a nice shinny replacement one.

Just put it in a coffee shop with the word free on it.

Trade it for a year supply if pizzas.
Use on as an iPOD and one as a phone.

The karma references are ridiculous. He could easily just think to the most recent time he was screwed by ATT or Apple and say the reason he got two phones in the FIRST place was karma hahaha. I would. ATT screws up my bill all the time.

Not intentionally. The right thing is to return it. I honestly don't see how you can't tell what the right thing to do is. It's like you go through life thinking that everyone owes you something. Most of us can differentiate between what is right and wrong, why can't you? This is a really easy situation to deal with. It's a clear choice.

The way I see it, Apple has screwed you all over intentionally by selling you phones with cases that are guaranteed to crack. Keep the phone, they owe you.

So the Apps, Music, TV shows and Video's you BUY for your iPod makes them no money? Funny because my iPod has a iTunes and App store icon just like my phone does.

Hey guys, I didn't want to make this whole mess....

I was so happy to get my first iphone, waited 6 months...

Yes... but suddenly, Happiness was gone when I realized there is another iphone...

I really admire the one who post today morning got two iphone and just returned it..

(He had same tracking numbers of two iphones... could be a perfect crime..)

But I have two different tracking number, and two different order number...

Ordered AT&T online, one in June 9th and canceled in 15th, re-ordered 16th..

There are two different phone-number-stickers attached on the seal....



Me, of course, morally, I have to return it back as soon as possible...

But... I didn't even have a time to activate the iphone... (Finals.... goddamm essays..)

I waited 28 minutes to talk AT&T representatives tried twice but keep saying high volume of blah blah blah..


By the way..

And I wonder is it possible to sell it..???

AT&T won't be notice..???

you realize you most likely going to be charged for both right? Since there are 2 different order numbers etc. Im sure they will charge you
 
heres what I would do.

Keep it sealed for a few weeks, see what happens, if your not charged for it or they dont get in touch, super you have a free phone to do what ever you want with.

If they don't about it, they can hardly miss it, and I'm sure two multi billion dollar companies are going to miss one piece of hardware, because lets face it, there not worth what they sell them for, they sell to make a profit, Im sure they cost far less to make.

I know from my own experience in retail (i'm from the UK btw) that a company has 14 days to rectify any faults and can legally charge you for it, after 14 days they can't do anything about it, after all its there fault.

If they get back in touch with you, just say is there a incentive for me to bring it back like a case or a iTunes voucher for lots of apps!
