The website puts the stipulation on the white iPhones.
Is the OP dead wrong?
No idea.

Did anyone actually ask them why? I did. This is what they told me:

The proximity sensor was slightly moved on the iPhone 4s. The sensor no longer lines up directly with the hole in the iPhone4 Defender Series Case.

Wirelessly posted (Mozilla/5.0 (iPhone; CPU iPhone OS 5_0 like Mac OS X) AppleWebKit/534.46 (KHTML, like Gecko) Version/5.1 Mobile/9A334 Safari/7534.48.3)

It's because of the relocated proximity sensor. Way to jump right to talk of a lawsuit before getting your facts straight though.

There is no relocated proximity sensor. This is bunk.

who told you that? The janitor that picked up the phone at Otterbox?

TS where in your OP you actually talk about them getting sued already?

How do you know? Need I remind you that many people w/ iPhone 4 had proximity issues and maybe by slightly moving it to the side this helped correct it... Wait until we all get ours to then say something is bunk when you actually hold one.

This whole 4S case thing is weird. From what I know (and correct me if I am wrong) the 4S form factor is going to be exactly the same as Verizon's CDMA iPhone 4, which is different then at&t's GSM model (volume buttons are positioned differently) If that is true, AT&T iPhone 4 cases will not fit the 4S. But when I stopped at AT&T this morning to ask an unrelated question, a guy was stocking the shelf iPhone 4 cases..from 3 or different manufacturers. So i asked him when they expected 4S cases to arrive and he said "their already here...the phone didn't change so all these cases will fit". I said "well I thought the 4S was going to be the same as Verizon's iPhone 4"...he looked at me like I was a joke, smirked and even laughed a bit before saying "u must be a new iPhone user huh?..Verizon doesn't carry a different iPhone 4...Apple makes the phone and Verizon and AT&T just sell it..there is only 1 iPhone 4. And the 4S is the same exact thing which is why all these cases are for both the 4 and the 4S". I said "nope, I am not new to Apple or iPhone and are u serious when u say that Verizon's iPhone 4 is exactly the same as at&t's??..Because they are different. The volume buttons are positioned differently which would be a problem for these cases with volume "buttons" on the side that have to line up exactly to the phone". He looked puzzled and then told me "well, whatever..these iPhone 4 cases will fit the 4S..we had a meeting about it"..

So is this guy dead wrong? He made me question myself because he's been working there since the original iPhone and he seems to have at least some intelligence. I just can't believe he wouldn't know that Verizon's 4 was slightly different. It would have had to come up at some point I would think.

So what's the case (pun intended)? Am I right? (putting proximity sensors aside for the sake of my argument) Verizons iPhone 4 cases will fit and at&t's won't is correct..right?

It could go either way really. The 4S will be the design of the Verizon iPhone with the antenna band positioned on the side, causing the mute switch to move down. BUT, the most case manufactures, to cut cost and make it easier on the consumer, have seen expanded that hole on the left side to accommodate both iPhone 4 models. So unless these were "old" cases being stocked, they should still work for the ATT iPhone 4, Verizon iPhone 4, and both (since both are the same as the Verizon model) iPhone 4S

I spoke with Apple customer service. Not some guy at some case 3rd party case company. I was informed that the iPhone 4 cases would all work for the iPhone 4S (ones designed to work with the CDMA phones). I would expect Apple's own employees to know this. Also, there are other 3rd part case manufacturers who are already saying that their iPhone 4 cases do work for the iPhone 4S (Incipio and LifeProof to name two). Incase is still saying they are waiting till the 14th to say for sure. But I will trust Apple employees any day over some guy at some case company. :apple::cool:

EDIT: Speck is saying their's work as well for both.

So what happens if you purchased an unlocked phone in the UK direct from Apple store? It's GSM only, right? Which means it's AT&T's style phone, and it doesn't work with CDMA. Thus, whatever fits the 4 should fit the 4S, unless this proximity sensor twaddle is true?

No, the new 4S is a 'world phone', so has GSM and CDMA built-in. However, it uses the CDMA (or Verizon) design of last years iPhone 4.

Most case manufacturers now make their cases to work with both the CDMA and the GSM phones so should not be a problem. Only may be an issue if you are using a case that you got when the iPhone 4 initially came out and therefore did not have to accommodate the slightly moved silent switch.

Lets go with what we know.

The 4S is different that the GSM iPhone 4. That is a fact.

Also Otterbox more than likely made minor changes to the case to account for the 4S. Nothing big but some changes.

With what they are putting there they can not be sued for it because they are making it crystal clear they are not promising in any way shape or form the 4 chase will work on the 4S. If they did not put that their they risk being sued for false advertising.

For most people they do not have a iPhone 4 so it is a non issue. It really is only an issue for the guys who get a new iPhone every year and even then it should not be a big deal since most of you all have cases from your iPhone 4 to test it on.

All Universal iPhone 4 cases (Post iPhone 4 Verizon Era) should fit on the new iPhone 4S, If it says "Universal" it will fit... The old ATT iPhone 4 Otterbox cases will probably not fit on a 4S case, but case manufactures been changed most cases to universal fit since the Verizon iPhone came out.

Shame on you Otterbox for being greedy

Shame on this thread.

Regardless if they are lying or telling the truth, the front camera pockets and back camera pockets on the defender series are a pain in the butt to clean and they are lint magnets. These new 4s cases look a hell of alot easier to clean.

Myself I plan on getting apple care + and going with a commuter series just for less bulk.

The white iPhone 4 has the proximity sensor in a different place than the black iPhone 4. Both models of iPhone 4S have the proximity sensor in the new spot. Hence, cases that fit the white iPhone 4 and the iPhone 4S. Not greedy, not hard to understand.

Just ordered the iPhone 4S otterbox commuter in gunmetal grey/envy green. Can't wait to try it out.

Best of luck with that.

It's amazing, last week we were 100% on board with the rumors. A few days ago we were pissed at apple for not doing what the rumors said. This week we want to sue folks for having what may be the right information.
May be an honest mistake.

Gotta love America.

I was under the impression the white is a hair thicker than the black.

It really isn't. The only real difference between iPhone 4 colors is that the white iPhones have had issue with screen protectors and their proximity sensor. For example. I have the same screen protectors on my white iPhone and my wife's black one. Her sensors works and mine never does.

wheres your source on a new location for the sensor? All I got was that they only improved it not relocated it.
