Yeah this confused me. So Apple is copying your patents but you’re saying the technology they’re using is ineffective? So does that mean Masimo’s technology isn’t good?

Masimo's Medical Grade Oximeters are considered the best on the market by most medical professionals and hospitals from my experience.

Apple has never claimed the AW6 Oximeter is Medical Grade to my knowledge. It's no more accurate than what you buy for your finger in a drug store.

Is Apple actively pursuing a Medical Grade Certification??? If so, I could understand this a little more, but.........
 
In certain sectors that is not allowed without a period of "gardening leave". In Formula one, key members of teams don't from one to a direct competitor without upto 18 months out of the sport to stop technology/information being transfered.

The fact that this does not seem to happen in the technology sector truly baffles the mind. Employess may do it without even realising what they are doing.
That would be if you were made to sign a "non-compete" clause

It would be interesting if the judges in these cases would not only halt Apple from selling products, but suspend the company with the complaint from filing more lawsuits, when it's a patent troll with no products.

This company has produced equipment and I'm guessing that their market share is minimal, even though they're probably charging high prices to continue to stay in business.

So, does this mean that the series 7 watch will be doing things differently and not included, or just that this process was started before talks of a series 7?
 
Masimo is not the only seller of these things. There are lots (medical grade) and lots and lots. Everytime I go to the my annual checkup they have a new one. If you include the ebay specials (I own one and it works) and apple's (which doesn't work all that well) there must 1,000's of them. Just one lawsuit? BS

The sloth, the laziness, the expense of medical devices, largely fueled by govt involvement and rules, may soon come to an end as more innovative companies finally come for them.

But if they Apple did accidents infringe in their patents they are likely going to make lots of money.

Can this be because folks aren’t buying Masimo’s mighty sat at 300$ because they are buying AW instead?

That said, if Apple is infringing Masimo’s IP it should pay. If former Masimo employees breached any NDA or NCA they should be held to account. Glad this is what we have courts for.

Otherwise Masimo can go bite it.
 
Yeahhhhh! Good luck with that. That’s not going to work. Already got my series 6 AW. Definitely will be ordering series 7 AW.

Masimo, and its spinoff company Cercacor, claim that Masimo's technology for non-invasive health monitoring helped Apple overcome performance issues with the Apple Watch. Apple allegedly relied on Masimo tech when developing the light-based heart rate sensor used in the Apple Watch, among other technologies.

According to Masimo, Apple first contacted the company in 2013 and asked to meet for a potential collaboration, with Apple asking to "understand more" about Masimo's products to potentially integrate Masimo technology into future Apple devices. After what Masimo considered productive meetings, Apple began hiring away important employees.
 
Apple's typical m.o.: steal trade secrets from others, implement them as "new features we innovated" and then when sued over them tie the offended party up in litigation and settle for pennies for their theft.

And people have the nerve to complain about Android....

I suspect that if they allow Apple to use it for non-medical uses and Apple goes through certification to be considered a medical device they won't be able to fight it later.

Fyi, Masimo approx. 9 days ago announced a wearable thermometer that will give continuous temp readings and will include Bluetooth connectivity. This is aimed at the healthcare space.

Hey, imagine if one day they could encompass several health features in one wearable?

Agree that the only ones who ever make any money out of this sort of thing are the lawyers, but that doesn't detract from the fact that a company genuinely believes that Apple has infringed on its patents - tell me if you were the patent holder in this case would you just roll over, drop the proverbial prison soap and let Apple do you over?
We don't know that they legitimately think that the patents are valid. There are plenty of patent trolls—probably the majority of patent infringement lawsuits these days. If Apple's correct that their patent shouldn't have been issued because they were given for things that already existed, then they're just trying to get attention or a settlement.

If they are the rightful patent holder, you're right and they should absolutely pursue it. Even a moderate settlement from Apple would be more money than most companies make from their products.

But our patent system is (patently) broken, and many companies spend huge resources just fighting off suits from companies that don't have rightful claims on the patents.

Their site shows that they make a fingertip pulse oximeter. I can't imagine with all the pulse ox devices on the market, that they rightfully own the patent to using light to determine pulse ox. That's how all of the units work.

Apple makes people compete. In this situation Mosimo may not be able to further “innovate” but they can lower the price of their hardware.

Apple including EKG, oximeter and possibly having a BG meter may actually drive medical prices down which is good for the general health and welfare of society.

So the pulse oximetry functionality is "not essential" and the Watch is "not a true medical device." Doesn't this undercut their argument somewhat? How are they being harmed?
