Come on, with the nature of software an how fast it changes that's not hard, it's impossible.

How is it impossible? If there is an iPod with OS 2.1.1 in the box, slap a 2.1.1 sticker on it. Or list the software as OS 2.X on the back of the box.

What are you talking about? The software that's already in the box doesn't evolve while it's in there.

But the software outside the box does. I thought that's what we were discussing here i.e. why does someone who buys a new touch have to pay for 3.0. It's because the touch was boxed up well before 3.0 was released. I'm sure some touches are boxed before and some after, Apple just charges everyone in order to be consistant.

Come on, $9.95 for 3.0 is a deal :)

I am trying to do my part in bettering the world by helping people understand why things work the way they do. Sometimes, its like trying to reason with a wall.

I hear what you are saying- I even understand what you saying- but you are just plain wrong. How can you argue against properly informing potential customers about what they are purchasing? What is in the box should be listed on the outside of the box.
 
So when Apple updates OSX they don't always wait for a computer revision do they?

ON the Apple Store page they don't make it clear in the specs what software is coming with your iPod Touch. They could easily fix that.

They don't do this for Refurb's either. I know because I bought a refurb. 1G for my wife, it came with 2.0+, then when we had problems with battery life. We took it back to the apple store and they exchanged it very nicely. The Apple Genius however didn't look to see what OS the replacement had- it has 1.0. So we went in with a 2.0+ iPod, and left with a 1.0 iPod. Unfortunately the Apple store was 2 hours away from our house when we tried to perform the backup to restore the data- it woudl not let me without paying the $10. So I called them and after complaining they gave me $10 credit off things I bought that day at the store to compensate for the OS upgrade cost....the plus was we got 3.0. :D HOwever it was a hassle to exchange the defective iPod and all so I think that was equal compensation.

I also agree it would be a good customer service thing to include it with all new shipping iPod touches. Don't they do this with new Macs when OSX is updated? At least ones from the Apple Store?

I know it isn't much money but it is the principal of the thing that they are still producing/assembling (I assume) new iPod touches that include 2.0+ software. Although we are close to the update so perhaps they are not.
 
Had no idea myself that Apple are still shipping v2 on the iPod Touch. That's rubbish, IMHO - they should have started shipping them with v3 when it was released.

Ok, so if they say it's v2 on 'em then that's fair enough, but it doesn't make it any less rubbish.

I dont' think they say version 2.0 on them....I think my invoice at the apple store said 1.1+but that was after the purchase and in my situation the genius should have checked to be sure it was an exact replacement I was getting. especially since I would have had no option but to upgrade if I wanted to use my backup from our previous iPod.

Ok, seriously. Apple isn't going to include a new software on an older product (2nd gen iPod touches). I hope than you all don't think that Apple just makes these products as people order them, no, they have a pre-made group of them with the software that was available at the time they were released (OS 2.1.1).

When the new 3rd gen iPod touches come out they will include 3.0 because that is what is available at the time and so on...

You can't expect Apple to go through their entire line up of old unsold products to update them.

Yah, maybe they can put on a sticker that says, "includes OS 2.1.1" but that's basically like saying to the customers, "not the new operating system, don't buy this, wait for the new iPod touch".

Apple knew when this update was coming out=- they could have anticipated when to packed the new update with the new touches being shipped or else just included a code to update for free once the new release is announced for download. Simple simple simple- no cost really, just a loss of a small amount of revenue...I have no problem paying for a major upgrade...no matter the cost.

The real problem is they need to be CLEAR with what OS is shipping!!!!!!! THey do for MacBooks:

I entirely agree with you when you say they should have posted it clearer on their website or something, but I stand by the new software, old hardware, pay $ idea.

Does apple ever put a new OSX upgrade on "old hardware" or do they always wait to ship the new OSX on a new revision?

I agree. They should list it on the outside of the box, and of course, we know why they "don't" do it for the average consumer - Apple is looking for more sales, just like any other corporation.

A proposition... would be to have a lower price than $10 for consumers that actually purchased the unit after the 3.0 software release date.

...that's my two sense of 'fair game' ;)

Um.... no.

Here's something to think about: just because you say something is true doesn't mean it's true.

Unlike you, when I buy something, I like to know exactly what's in the box. If it says 2.1.1 on the box, I'd have no problem paying extra for 3.0 after my iPod purchase. At least I would know what I am getting before I spend my money. No surprises. The fact that I wouldn't find out that I have to pay another $10 until AFTER I buy it, open it, and sync it for the first time is really bad form on Apple's part. Especially since 3.0 was released back in June. Again, how hard would it be to print up some 2.1.1 stickers and have them placed on each box? I mean, Apple's website doesn't even explicitly say which OS the Touch comes with currently.

I hate to say it, especially about our beloved Apple Corp :p ...but they can be discrete at times, and are quite smart with their wording on the site(in general)!

Are they unfair for doing this, or do we just expect better of Apple?

Truth is, they are driven by sales, like 99% of the world's corporations...

So, I can't blame them always, but in this case, they might make an exception. OP, give 'em a ring ;)

To play devil's advocate, they kinda do. The second gen touch has a sticker placed over it in the box showing the home screen layout. If Apple put 3.0 on them then they would also update the packaging sticker to add, for example, the Voice Memos app and a bluetooth icon. Correct?

That's pretty vague for the casual customer.
 
It's just one more thing to stick it to you. I remember when GOOD headphones, a couple of chargers and the dock would come with an iPod. That was back when they weren't grubbing to rape you of every cent possible. Now you are lucky to get the box it comes in.
