Okay I know this is elaborate sounding, but I feel like someone should create a 20 questions game with this tethering situation.

Basically it could work where the first question is whether or not the person has been caught...the next one would be what program they use (tetherme, mywi, pdanet). The next would be how often, then how much data, ect.

I feel like this could be really helpful in finding out what group of people have been caught tethering.

I'm also extremely drunk right now and this may make no sense to anyone reading this post. So sorry in advance. But I still feel like this would be a really good way to collect definitive data on this issue.
 
This post doesn't help with figuring out what ATT is doing but just wanted to update and say that I'm glad, even if I had to pay the ETF, that ATT had texted me saying they would change my plan to the 45 tethering plan when I had the unlimited plan. Since then, I'm able to tether with unlimited data AND with a better speed at 1/3 of the price I was paying ATT from another carrier. :eek: If I didn't get the notice, I would have kept with ATT and that would have been a bad move on my part. If ATT likes losing customers, they can continue doing what they want. Thank goodness for competition. :D

We’ve gotten word from some readers that AT&T is moving forward and removing unlimited plans for users who jailbreak iPhones to tether or hotspot off of AT&T’s unlimited data plans (for those grandfathered):

I was just informed that as of Thursday August 11th 2011, if you use MyWi or any tethering on the phone or using the phone as a modem, AT&T will automatically change ur unlimited plan to a 2Gb tethering plan for 45 dollars without the customers consent. This is for those who received emails or texts about the use of tethering without an AT&T tethering plan.

An AT&T spokesperson has confirmed this, but not August 11th as a hard cutoff date, saying:

Earlier this year, we began sending letters, emails, and text messages to a small number of smartphone customers who use their devices for tethering but aren’t on our required tethering plan. Our goal here is fairness for all of our customers. (This impacts a only small percentage of our smartphone customer base.)

The letters outline three choices:

1) Stop tethering and keep their current plan (including grandfathered unlimited plan)

2) Proactively call AT&T or visit our stores and move to the required tethering plan

3) Do nothing and we’ll go ahead and add the tethering plan on their behalf — after the dated noted in their customer notification

Is this fair of AT&T? Well, it is certainly fair that people pay for the data that they are using and unlimited tethering turns your iPhone into a data sucking monster. AT&T’s service to others is obviously affected, so they have to do something about it and this seems like a reasonable solution. The obvious retort is that some may have purchased their unlimited plans back when unlimited really meant unlimited, jailbroken or not.

The matter doesn’t appear up for debate however. MiWi users: get your free data this week and hope AT&T doesn’t decide to move you over early.
 
Have they found a means of identifying all the jailbroke offenders?

I have been using just under 2GB of data each month via MyWi and have not been caught. I mean, if I get caught I'm happy to go to the tiered plan. Just sort of surprised that I haven't been flagged as of yet and it makes me wonder if this is just another scare tactic by the company to get people to call and confess.
 
If you have not got a notice yet! You should e good to go and they will not change your plan, they are going after the BIG users 5G and more.
 
They changed mine as of last night. Used it quickly for the first time in weeks. Average data usage WAY under 5GB. Hardly ever over 2.

Using TetherMe but was also caught using MyWi in the past.

I removed it and put a 2GB data plan (no tethering) and removed all texting.
 
I don't use MyWi very much and I don't think I've ever gone over 2GBs and, probably unsurprisingly, I've not ever received any kind of notice. Though, as a precaution, I've set my phone up with an encrypted VPN service which I'll now turn on anytime I intend to tether. Though, it sounds to me, at least from some reports in the past, that they're merely making assumptions based on usage (derp). But, if they are looking at the actual data for signs of tethering, have fun peering into 128bit encrypted traffic. ***** you ATT.

Even if AT&T switches people to one of the tiered plans, can't they just do the unlimited data trick with the original iphone to get unlimited back? I'm sure they'd catch on to it eventually if you kept doing that, but you should be able to get it back at least once or twice if they switch you (assuming that trick continues to work of course).
