They have produced a tablet computer which is:

A different size
A different aspect ratio
A different screen resolution
Stereo front mounted twin speakers
Different internal circuitry (CPU/GPU)
Different operating system.
Different camera units and resolutions
Different materials used in construction

How much more "Different with their own ideas" does it have to be?

As with car models from different companies. the only thing it has in common are the fundamental things that make it a tablet/ c car. Four wheels, glass windows all round, a steering wheel and seats.

Firstly, this just deals with the injunction, and not the patent case itself. That will still be heard next year.

If Apple lose that patent case, then Samsung will presumably sue them for lost income as a result of the injunction, presumably with damages on top.

In the meantime the injunction has been overturned, and apparently should never have been granted. Keeping track of the sales was all that was ever required to assess losses for Apple should Samsung be found to be infringing.

It's nearly too late for Samsung to sell their current tablets in Australia, the window of opportunity has nearly closed for the product's lifespan.
 
Not quite.

Apple appealed it, and this will cause further delay.

In context:

1) Apple has already had courts side with them on injunction matters.
2) None of Apple's products have been successfully banned for any length of time.
3) Apple has already done damage to Samsung, and with the granting of the stay, will continue to do damage.
4) Meanwhile Apple's case has legs enough for an appeal.

One more perspective :

1) Apple lost 9 out of 10 patent claims in Netherlands, US Judge is skeptical about validity of Apple patents, Appeals court overthrew Apple case in Australia, Galaxy tab is selling even in Germany as a new variant.

2) Apple is shaky grounds in Germany. In case they do not bring better defenses, products might be banned there more sooner than later

3) Negligible damage has been to Samsung as only one of their product ( Galaxy Tab 10.1) was banned in two of the countries of world and that too for a two three months. And again you might have read how these tablets are getting sold even after injunctions in these countries.

4) There is nil chance that Apple will be able to increase stay in few days time in Australia. High court appeals take much more time and this time onus is on Apple to prove that Appeals court did error in overturning the ban.

False. Unless you can cite the actual law that was 'broken'.

I like Apple as much as the next person, but this whole incident was petty.
 
I dont think the similarity of the design should matter in this case. its to simplistic. the design is a screen with a single button. so what no one else can have a screen with only 1 needed button now? thats freaking stupid.

At a moments glance maybe they look the same, but if you look at them for longer than a few seconds it is pretty obvious they are quite different. They both share a tablet form factor (because they are tablets) but beyond that it's hard to pick out any real points of similarity.

Anyway, why are we even discussing how it "looks". This is the Australian case. There is nothing in the Australian lawsuit and injunction that was based on design.

Are you people even following these cases or just blindly commenting on them based on what Steve's opinion "du jour" was ?
 
It's just nice to see some sensible judgements finally. Samsung is infringing no more on Apple than Apple is on Samsung.

Let people decide what they like / want and perhaps think about the damage these companies are doing to their own reputations as a result of all the lunacy.

A bold claim since none of this has been tried yet. Both parties still have infringement claims going and trial isn't set to begin until 2012.

Both Samsung and Apple may yet be found in infringement of the other's patents.

Kinda off topic, but why is the High Court of my nation dealing with this ****. I KNOW they've got better things to do. Do other countries deal with this rubbish through their legal system or do you have other bodies whose time is better suited to these trifles. And yes, in the grand scheme of what what a High Court is there to do, these are trifles.

With all due respect entropys, the Samsung Galaxy 10.1 is:
1. thinner
2. lighter
3. has a bigger screen
4. is not confined to the Apple ecosystem

Any Android tab is much more versatile than the iPad. It just so happens that we promote the SGT as that really is a serious threat to Apple.

Please understand that we don't give a stuff if ppl use an iPad or any other tablet. We sell both and we make $$ each way. However, we feel that the Galaxy is far better than the Apple iPad and the recent court cases can be seen as Apple's attempt to limit its competition so as not to erode Apple's marketshare.

False advertising is when someone states as a fact something that is false. The user you are replying to is stating a subjective opinion. The only way this could be false advertising was if he was falsely representing his opinion.

Which device is superior is not a matter of fact. It's purely subjective and based on the individual you ask. Every device has its strengths and weaknesses and will appeal to different crowds.
 
I went to a Samsung retail store. They have Galaxy Tab 8.9s and 10.1s on display. To be honest, I can't recollect holding an iPad when I hold a Galaxy Tab. Though you might argue it looks similar (it is, as it's a slab with a glass screen and tapered sides) it doesn't "feel" like the iPad.

The UI's entirely different, the port locations are different, the Galaxy Tab is also lighter, a higher resolution screen. I will be more concerned if it's a 1:1 replica. :rolleyes:

There is no confusing the two. Apple is just scared of the competition so they "innovate" by litigating.

The Apple "ecosystem" with all it's apps is listed by almost anyone of being a key feature of all the iOS products. It's the "soul" that drives this products and makes them best sellers and you say that being part of it is a bad thing? Hilarious...

If Samsung had access to it it would most probably drive sales up like a rocket.

It's not like the iPad is twice as thick or twice as heavy as the Galaxy Tab so this specs only matter on paper.

Anyone who dismisses these points in the legal system is a brainwashed Apple fanatic who loves their iPad and is using personal feeling to dismiss the facts.

Microsoft and others had been trying to achieve this form factor for a long time but the technology simply wasn't there yet.

Apple can't expect to win this in the long run
