Apple might be infringing some patents since they are set as a standard which everybody must follow. There was only one way they could choose. This is the reason why FRAND rule exists.

The reason why FRAND exists is explained in the article. Its not so you can copy rightful tech. patents without paying license fee. You can build your own standard, make your own CPU (ie Samsung), or your own memory, radios, receivers etc. There is no must. The must you are talking about is called free market.

Samsung has been infringing some patents because they just thought it looked nice and they didn't want to spend time to develop their own design. There were so many ways they could choose.

The dutch court said the gallery app infringes on one software patent as I remember. And the German court stated that the reason why they've banned sales is because they look similiar and there are other ways the tablet could look. I am not sure it was a patent battle. It was a community design.

Yep. My point was that what you were talking about was irrelevant to Apple's claim. Manipulating the images to emphasize the similarity of the relevant elements is not deceitful, as long as the manipulation is acknowledged. The courts lack of reaction to the manipulated photos demonstrates that the issue was overblown by forum lawyers.

You know, these types of legal battles happen every day with major corporations. Why is it that more the 50% of the stories on MacRumors are about Apple's legal battles?

MacRumors used to be a positive site with rumours about Apple products that would make us geeks all giddy and interested in participating. These days, the negative connotations involved in legal stories about who's suing who has turned this site into a gloomy place to visit.

How about making a Legal tab where you can put all these stories? This is not front page news. It's routine, a (boring) part of running a major corporation like Apple.

Why ? If the court judges Samsung's patents as being necessary to the implementation of a standard that Apple implements and that a standard body has ruled that all patents covering said standards must be offered under FRAND rules, then... Apple will end up paying Samsung.

Why would he explode then ? Samsung isn't suing Apple because they aren't paying enough, they are suing Apple because they infringe on their patents without offering compensation for them.

HTC got patents from Motrolla and those graphics ones to crush Apple with. The power of Android is unstoppable. Apple should just try and supply Android on their phones.

The real issue here is that Samsung wants Apple to treat some of their very specific patents like the more generic FRAND patents that Samsung holds... So they don't have to pay to license them...

Apple would still have to pay for RAND patents, it's just the amount must be the same for all licensees and must be "reasonable." Apple already pays to license a huge number of patents on RAND terms for the iDevices.

Samsung has itself said these patents are basic to all cellular communications, and knows they'll apply to the iPhone 5 even though Samsung has never seen one, no matter what the phone's actual specs end up being. If you can't build a cell phone without it, it needs to be RAND.

First Nokia tries to bully Apple into accepting non-RAND terms for their RAND patents, now Samsung. It looks obvious, everybody just wants to suck more money from Apple because Apple is the only one making real money.

It was a smart move from Google indeed. I am no legal expert but it is weird to allow a company to buy another company to use their patents for something that was created before they bought them out. *shrug* just saying.. it might not work in favour for them after all if you look at dates instead of just patents

Why ? What does it matter really ? I have a Samsung monitor, a Samsung Fridge and a Samsung stove. My food tastes just as good today as it did yesterday, my Macbook Air still displays it's shiny nice graphics on my monitor and all is well in my little world.

Why should we feel bothered by what corporations do amongst themselves ?

Samsung is not like Apple. They have a bunch of different people working on a bunch of different things - anything from washing machines to smartphones. They're an excellent example of how asian manufacturers can and have diversified their abilities.

Point in fact, Samsung are top-tier LCD manufacturers. You'd be hard pressed to buy an Apple product that doesn't have a Samsung or LG panel in it, and LG aren't doing anything different. These guys have some very, very talented engineers doing all sorts of clever things that Apple will probably end up buying as a component. Don't be so quick to bite the hand that feeds you.

All that said, I'm pretty sure Touchwiz deserves whatever legal attention it gets. Form factor? I'm not convinced you can claim that.
 
If Samsung blocks us from getting the next gen iPhone, there may be a lot of consumers pissed at them, like me!

I love all the silly comments... just let the lawyers have their fun.

The way I see it, this is just a flushing out of who owns what and who really owes who. It's just all part of the process and in the long run a good thing once it's all done.

All the silly analysis going on mean nothing unless you're a patent lawyer and have access to case... in which case, you're not here commenting.

Just enjoy the show.
