So your saying its fine to copy Google's I.P. only because it's part of the AOSP... Otherwise it's wrong.. Google could have patented but they give it away for free so its ok.. talk.about double standards..

Copying concepts such as notification center and control center are not the same as copying IP. It has nothing to do with the fact that Android is open source. Google did patent specific implementation details of notification center, however Apple did not use those patented methods.

Look for some primers on copyright law and patent law to gain some understanding about the difference between copying IP and copying unprotected ideas and concepts.

Really? There are no other search engines? Online maps? Video hosting sites? The world of internet moves fast. Remove google from the equation and in couple weeks we won't even remember it. Same with Apple. No company in tech is irreplaceable, that's the great thing about tech imho.

But, there's a big problem in your comment:

1) Apple designs their own chips, sends blue prints to the Samsung and Samsung manufactures them. They DO NOT design them, so iPhone has APPLE technology not Samsung

2) I am pretty sure he was trying to tell that he would never buy a SAMSUNG BRANDED product like a Samsung TV, Galaxy device etc. Because they can use their nasty business strategy on their own products not manufacturing

3) Only Apple A7 is manufactured by Samsung in new iDevices. As I know, screen is manufactured by LG, Camera is manufactured by Sony, Apple M7 is manufactured by TSMC, and most of the things are assembled by Foxconn

4) I would be very happy to see Samsung going bankrupt. Because now, it's not a war between Samsung & Google vs. Apple, it's like Good vs. Bad. If Samsung wins that war, a lot of companies will follow Samsung's non-ethic way and it will kill innovation, we will have some non-innovate, corrupt companies that would do everything for getting more money.

Thank you for clarifying on the second point. This is exactly the rationality behind my choice to never buy into any other Samsung product again. Even after using Samsung components in their devices, this is still ultimately Apple's end product so they control the conduct of which they do business in selling those said devices and how they handle customer relationships. Not Samsung.

And I couldn't agree further with your fourth point as well. But punishment should be more severe, as to deter any untrustful companies in the future trying to pull a Samsung again. Like others have previously said, $119 million is just a "slap on the wrist" for them. Unfortunately, I doubt this will be their last time in court being accused of a patent infringement.

It's not about the legality of it all, its about the hypocrisy if it all. Samsung is the devil for copying Apple.. but Apple is allowed to copy android because it wasn't patented..
 
So, before Apple filed lawsuit Samsung wanted to settle for $200-$300 Mil, now don't want to pay $119 Mil.

This should stop. This fight actually has serious impact on Apple's supply chain. It tried every third rated supplier in the world just to stick it to Samsung. Didn't won't. Time for truce. Good for both companies. Good for iPhone customers, they could use bigger screen.

I find it rather sickening that you are so ******** in your role as a corporate fanboy that you would advocate the US backing down on its defense pact with SK. I mean NK could for some odd reason finally snap and you want the US to pull out and no longer defend SK and let people die just because you are so rump frustrated over Samsung. Ridiculous.

The issues being that its ok for one company to do whatever they please... "We shamelessly stole every idea we could in the creation of the Mac", but anyone else "takes inspiration", and they are the devil... The legalities are secondary.. how can this forum host good debate when half the posters are so blinkered..

Because you just made all of that up, so you had an irrational position to argue against. It's so much easier for you than actually trying to understand the issues.
 
Every single company in the history of ever appeals after they are told to pay damages.

Not only every company, every plaintiff or defendent in the history of court trials that has had a ruling go against them has appealed.

199M$ fine on a company like Samsung, and a business the size of its smartphone business, is no slap on the wrist, it is more akin to a wink and a peck on the cheek.

- Schiller's Ode to Joy poem (1785),
- Beethoven's 9th (1824),

wherein the last two both "steal" and build on the ideas of their predecessor.

It is in the abstract inspiration provided by a predecessor, as opposed to outright misappropriation of their work, that the quote speaks to.

If you read other articles on other sites, and read all the various quotes from the foreman, you'll see that everyone except Apple, Samsung, and their various hangers-on think the whole thing is pretty dumb.
That in itself is dumb and shows how our society has become a get something for nothing plague. When someone is actually willing to earn their keep, like making better products, silly people think it's ok for others to just appropriate their efforts as their own. I wonder how many of these Einsteins would go along with a coworker taking credit for the extra work and late hours they put in and getting the really large bonus check that goes along with it. Even if they are too afraid to standup for themselves, they won't keep doing it for long. If Apple doesn't aggressively fight these cases the will get run out of business with their own technology. Samsung has a pattern for doing just that. And once you allow one to get away with it you may as well count them out of the market. People complain that Apple is long over due for new product categories, but I believe they are refusing to release new devices without protection. Their future depends on it. You will see them integrate tech in ways that will take years to develop or copy because they will produce these elements themselves and leaks will be minimized.
