Legally, the original poster is entitled to keep the nano if he had no prior arrangement with the neighbor to receive it.

If an unordered item is addressed & delivered to you, it's yours to keep. You are under no obligation to return it, pay for it, or give it to anyone. This is actually for your protection, as it prevents companies from sending you unordered merchandise & then billing you for it.

Of course, he'd be a jerk to keep it, but legally, he could.

It is not a criminal act. Mail packages that are addressed to you (whether wrongly or otherwise) are legally yours.

This act was enacted to protect consumers from businesses that literally "spam" their products by mailing them to people and invoicing them, go google for it if you are curious.

I'd say keep the Nano, stick it to the man!
 
Yeah keeping it is not criminal. As said above it is addressed to him. If it was addressed to someone else he would be in trouble.

Regarding fingers vs keepers. In Australia (it would be the same in the US and the UK). If you find something, say a $50 note on the floor at the supermarket, go and give it to the head of the supermarket and say that u found it. And tell them that if they do not find the owner (and they won't of course) you would like to claim it. After a week or two go back, the supermarket won;t have found the owner, and you can claim that $50! So honesty is the best policy in those circumstances.
 
get a cardboard cut out and put it in there then give it to the neighbors.


ohh my god how funny would that be to open the nano box and find a piece of cardboard in its place.

of course you would give them the real one later

My mother purchased a book through a 2nd hand store in the UK many years ago, it was to be shipped to my aunt in nth ireland who would send it on and reduce the postage cost. She was told it would be a few days for delivery, no big deal really, except before my mother called the package arrived way early and as no package was expected and limited or no sender info my aunts sister was thereatening to put the package in a bucket of water outside in case it was a bomb. My aunt was a head teacher at a catholic/prodestant school and back in the days that could be quite a problem.

So if you do send something to someone and don't give the heads up you may be surprised with the end result.
 
Technically, you never received it 'cause you didn't sign for it, right?
And it's Xmas, right?
And it's a FREE NANO?
It may be wrong and immoral but I think I'd keep it :p
 
I like the fact if it were me that I had neighbors that trusted me enough that they were comfortable with doing this. I sure would not want to screw up that trust for a measly $200
My character is worth so much more than that.....

Weird! Yesterday I received two items from ebay that ordered but only one was mine (a guitar stand). Both were addressed to me. The other package is from the same store and is a some sort of acoustic guitar mic amplifier. I thought WTF!!! I just read about this sort of thing on macrumors and it is now happened to me! I found that there was an invoice attached to the box. I opened and read it was someone else's order. I don't know how they messed up. The guy didn't have a similar name or address to me. It was meant to go to a different state!

So I contacted this ebay store and told them about the mistake and asked them to arrange collection for the item. They had the audacity to ask me to re-post the item COD (cash on delivery). So I have to take out my time to carry that huge amplifier box up to the post office and send it back to them. The least they could do is organise a courier service to pick it up. They said 'We apologise for any inconvenience this has caused you will be happy to make it up to you on any future purchase you make.' They could offer something a bit more concrete like a discount on the item I purchased or a discount voucher.

I feel sorry for the bloke you ordered the item. The date on the invoice was sometime mid last month. He must be really pissed off.

I don't mind doing the right thing and would hope someone would do it for me. Its just a pain that I have to take time out of my schedule to fix their f*** up. Should I tell them to organise a bloody courier to pick it up because I have to work too?

I would ask them to do it courier, unlesss you plan ordering there again. Hauling an amplifier to the post office is pretty time consuming, and expensive if you dirve.
 
They could have given you the choice. Sometimes waiting in all day for something to be collected is annoying, and queueing at a post office at this time of year is just as bad. You're right though about something more tangible in recompense. Perhaps they can afford annoyed customers.

Note that if you find it in the supermarket, or on a train etc., the item is not actually _lost_. It is in the posession of the supermarket or the train company (they don't own it, the rightful owner owns it, but it is in their posession), and taking it when it is not yours would be theft. If you find it on a public road, that is different. Probably some different crime, but not theft.
 
so has anyone actually called that 916-399-5246 number listed earlier in the thread?

my friend just had the same thing happen to her. an ipod nano got delivered to her which was addressed to her and she didn't order one.

so i called that number and it was very odd. the conversation went like this:

him - hello? (yes, that is all he said)
me - hello, is this apple?
him - umm, yeah.
me - ok, i got the wrong number (and i hung up)

i'm sure apple doesn't answer the phone that way.

so i then called apple, from the number listed on their website. i spoke to a rep and explained the situation to her. she said apple can track where it is supposed to be based on the serial number. my friend will have to call and give it to them to find out where it is supposed to be. but, the rep sis say that if they can't determine where it is supposed to go, that my friend can keep it! woohoo!

very odd! :confused:
 
Did the neighbour even ask his permission to say if it would be alright if they shipped this product to his house or were they waiting to see the surprised, yet shocked look on his face when he opened the package. ;)

In any event, I believe the neighbours should have mentioned something much earlier, it only takes what 2 weeks or something for a Nano to be shipped. :D
