It's larceny. They didn't steal it, they are just in wrongful possession of it. If someone gave you a stolen car, you didn't steal it, but it's still not yours to keep.

And don't get so mad on here, it's not worth your time, a lot of the people here talk out of their asses half the time.

True, but nobody gave the person said phone. They took it after we called it to tell them to meet us to give it back. And I am not positive but, I think if you are in possession of a stolen vehicle you can still get in trouble regardless.

Like I said, it's larceny. Still a crime, but it's different from theft.
 
Show me, counselor, where is statute, case law, or other jurisprudence that "legally" says this?

Typically there is no duty owed to return lost property.

A. A person commits theft if, without lawful authority, the person knowingly:

4. Comes into control of lost, mislaid or misdelivered property of another under circumstances providing means of inquiry as to the true owner and appropriates such property to the person's own or another's use without reasonable efforts to notify the true owner; or

You guys shouldn't have kept calling it. You should have just tracked it through MobileMe (or at least locked it).

but luckily he only payed $50 for the phone.

The main problem is not the $50, its that he is stuck with a 2 year contract and will have to pay close to full price for a new one.

I'm not anal about losing/getting my phone stolen, the only thing I worry about is my personal info/pictures/etc.
 
Sorry man but if the phone slipped out, then he did not get robbed.


A lucky person just found a phone....
 
If someone finds someone else's property and decides to keep it instead of turning it over to the police and/or trying to contact the owner then their actions legally become theft.

That person is just holding onto it just in case the person that lost the phone irresponsibly decides to come looking for it. I jest. It is theft if the person that finds the phone doesn't take at least the basic steps in returning it, or at the very least leaving it where it is.

Sadly, I've found phones lying in malls from time to time, and I personally leave them right there.

well if you found a money bag outside of a Brinks truck and it had identifying marks on it or an iPhone that had someone's personal info on it.

Funny, but it'd be like saying the guy put his phone on the table at a cafe, and someone just came by and snatched it. If the Brinks truck left the money bag on the corner and drove off, and no one was around . . . .well ;) I am sure they' love the bag back.

Yeah, but seriously speaking, it extremely irresponsible for someone to just leave an expensive phone lying around. It's theft and it does suck, but your friend was asking for it.

Tell him/her to wait for the iPhone 5!

He did not leave it lying around. It slipped out of his pocket and 10 seconds later he noticed and we went back. And it was gone. We called the phone 15 times and finally someone answered but then proceeded to hang up and shut down the phone.
 
That does not seem to be a problem in Europe where they do blacklist IMEIs and people resell phones there. Generally the only time a phone's IMEI would be blacklisted is if the phone was reported stolen or lost. Someone would have to be a giant douche to request that a phone's IMEI be blacklisted after selling it to someone.
We are talking about the US. A LOT of people are total douches here.
 
For people saying it's not theft, I can't wait until I find your lost car keys. What a lucky day that would be for me. A free car. :D And I bet your attitude would quickly change.

It doesn't matter if someone lost an iPhone, car keys, wallet, etc. If you take it without taking the proper steps to return the property to the rightful owner it is stealing. Sometimes I wonder if some members get their ethics from Gizmodo. :rolleyes:
