They aren't competing for Sales..

By that logic I could pirate – instead of license for a fee – a piece of commercial software, an image by an agency, a commercial font… and that would be fine and dandy, just because I wouldn't use it in a way competing with the rights holder's sales? Come on!
 
I'm sure Apple will happily pay the $10 in damages. How could this possibly "hurt" them? I see that it is licensed, but I can't imagine this appearing on the iPad would impact them outside of them wanting the lic fees.

I do however believe this is an identical copy. I wonder how Apple gets their images. If an employee creates these, someone is gonna be fired for not doing their job and actually creating the icon and instead they copied.

It doesn't hurt them. Having a game, let's say Halo 5, full of sound effects ripped from Super Mario Bros would not hurt Nintendo. It's still illegal copying. If you want to use someone's design or IP, you have to pay up.

There's really no dispute here, but c'mon, a clock face? Are we going to start accusing Maxis of copying Sherwin-Williams' wallpaper because there's a similar shade of blue in the Sims? :rolleyes:

If you haven't noticed, Apple's clock design is the exact same as the real clock. It's completely copied. Apple has to change it.

People here are seriously trying to defend Apple in this? If you want to make the overused comparison to Samsung, this would be like if Samsung produced something that looks exactly like the iPhone, a completely accurate replica. Apple has the same exact design as the clock. Either some lazy programmer copied it, or it's a really, really big coincidence.
 
I'll-conceived correlations??? Wtf? Samsung ripped off apple while attempting to make it look different. This here sir, is a blatant copy! Even dudes making fake Louis vuitton bags would raise an eyebrow on how blatant this is.
Whoa, tex. Put them shooters away. I was just saying that the Apple vs. Samsung lawsuit is over something on a scale so far beyond this clock matter that a comparison between them is ridiculous.

To be more specific, it looks like Apple directly copied that clock, and they're going to need to change the design or pay the appropriate fees to use its likeness.
 
This makes me wonder how Apple goes about checking whether visual elements in their products resemble existing work too closely. I presume that they have some sort of automated way of scouring the web for images and comparing them with proposed designs, but that's just a guess.

In any case, I think that Apple should either license the image or change it and move on.

This is just added proof that Apple is just abusing the patent system to their advantage. Saying something to their competitor one thing while doing the exact same thing behind their back.

It's very, very similar, but it's definitely not a match - the Apple hour marks are too wide, the individual second marks are too narrow and too long, the hour hand is not wider than the minute hand, the second hand has a red circle in the center and the red circle at the end does not very nearly touch the hour marks.

Inspired by? Maybe. Copied? No.

Well thank you for this ignorant comment. Switzerland had a GDP of USD 635.65 billion by the end of 2011 and is holding USD 108 billion in US treasury bonds, which makes Switzerland one of the biggest creditors of the US. But yes, we live in a small country with only 8 million residents. Which makes the number even more impressive.

I bet it's more like "Didn't Apple realize the clock image was trademarked?". And the answer is obviously "No.".

You don't know if they knew or not.

Consider this though - it is specifically the icon designer's job and Apple's job to check that anything they release is not infringing upon anyone else's copyright, trademark or patent. Apple made a very big deal in their recent court case of being a company that only released original or licensed work.

For the answer to be "no they didn't know" they would have to fail on many levels with multiple people.

For the answer to be "yes they did know" as little as one person has to fail/lie/steal.

Not quite. Until that point in time that it is licensed they are obliged to change it.
 
Chisnic, I have already explained: my criticism was about the average Swiss customer and the mentality behind it. Read my post again and you'll see it with different colors.

Ah, the good old average argument. But you do know that this does not exist, it's a statistical approximation, nothing else. And I don't believe in over-simplyfing individuals. And I'm sure you don't want to get to the average US-American discussion here. My point: If you don't like the place you live, the service you get and how the people behave - just leave.

OK, either license it or change it. I just don't want to see Apple steal IP. I was scarred by story of the big auto companies bullying Tucker and the rest of the American examples where big companies break all of the rules and get away with it. I have nothing against big corporations in general, and I think Apple is a model corporation for all the rest to follow in many ways (and they do already). I just don't want Apple to pull a Microsoft here.

I dont get it, i literally see hundreds of clocks like this, it's not a unique design at all, how can you licence it?

There are so many little details that are different, the length of the hands are different, apples has a round circle on the red hand. The smaller increments are longer and skinnier.

There are only so many ways to draw a simple clock.

To me the only infringing part is the red seconds had, everything else is standard clock design. I'm sure if apple could prove the red hand came from another non copy written source they are fine, there is such a thing a coincidence.
 
The hour hand isn't as wide and the minute hand isn't as long.....I am curious to know the specifics on the patient.. its a freaking clock...there are digital and analog, other than that, they all look the same...
