This is kinda dumb. It's like suing the highways for rush hour traffic being slow during times of congestion.

No it's like suing a toll road that says you can drive whatever speed you want, but if you go too fast you have to wait an hour at the rest stop until everyone else catches up.

Both analogies suck and are not needed unless either of you are trying to position an alternative argument to make throttling sound ridiculous.

It's exactly like being a heavy data consumer and they slow you down in high traffic to prevent interference with other normal data users.
 
The only weird bit about this cut and paste article is that it is the FCC that got on T Mobile's case. I would think this would have be the FTC (Federal Trade Commission) as they usually handle cases of false or deceptive advertising. Other than that, meh, I don't see how adding or changing the 6 point wingdings script that all carriers use to explain the exceptions and limitations of a plan (and the associate fees) is anything than a marginal improvement.
