Yep, we should arrest the telephone company CEOs because those same illegal acts are and have been happening using the phone since the phone was invented.

Maybe we should also arrest all of the newspaper CEOs that have ads for escorts, drugs, etc. Oh, we need to arrest CraigsList CEO, for the same reason.

This arrest in France is nothing more than an attempt to enforce the governments will to spread propaganda and kill free speech.
I think we should arrest France for all the terrorism, drugs, escorts etc. that goes on there. They should really moderate it better.
 
This is absurd, it's like arresting the CEO of a car company because bad people used the car to do illegal things such as terrorism, drug trafficking, money laundering, fraud, and child exploitation. I guess this has more to do with the ever increasing attacks on freedom of expression in the west and how Telegram refuses to give governments backdoors to their user data more than anything else.
Is it also absurd when the government goes after a bank and/or its CEO because the bank was used to do illegal things such as money laundering, fraud, illegal arms sales, sex trafficking, tax evasion, etc?






We don't fully know why Pavel Durov was arrested. How about we all wait for details before opining?

What complete ignorance.... It genuinely is sad to read how much folks want the government to dictate their lives. We have laws about prostitution and drug dealing on the streets, and yet it happens. Weird. So are you going to arrest the police officers or city/state leaders for not preventing this crime? I mean...'they have a responsibility'. Should law enforcement be setting up cameras inside our homes to monitor and make sure nothing illegal is happening? Where would YOU like to draw the line?

I think everyone can agree that terrorism is bad. That doesn't mean folks (at least in the USA) should have to give up their freedoms. It's not only about what you gain, it's also about what you are giving up. I don't think a company's CEO gets to make the call about what I can say.

But seriously. I think Durov will be released very soon. He's in investigative custody where he can remain for up to 96 hours. A judge will have to decide if it's reasonable to hold him longer. I don't think they will. But let's see.

Depending on country or local laws, I think it would be more like taking legal action against a car company or its CEO for not turning over "black box" information related to cars believed to be or have been involved in illegal activities.

If phone companies monitor or capture discussions regarding illegal activities and refuse to turn then over to authorities, they could face legal consequences depending on country or local laws.

So, people keep saying, it is because he won’t moderate the public groups. If they are public, why aren’t the police/anti-drug groups joining them and then you know doing undercover work to catch the crook.
It’s like holding the local manager for a store libel for the crap that goes on in the company’s parking lot - a public space.
Not a great example since a parking lot for a store is unlikely to be public property. If someone gets mugged in a parking lot at night, or people are falling due to poor lighting, and the owner knew about the conditions and failed to address them, then they may be held liable. Premises Liability in the states.
 
Totally agree with you. If the basis of the arrest are as described by MacRumours, is ridiculous. Furthermore, it implies that companies should tap in real time all the time private conversations. Is my believe that telegram does strong E2E encryption and are deleted after a short after, much like a phone call, making next to impossible for a non participant to unlock it.

Such tap, should probably be possible but always done by judicial authorization specific to case being investigated. Not through mass surveillance, much less privately run with no supervision.
The legal argument is they do not have sufficient moderation and safe guards in place. They don’t have to “tap” conversations, but simply show a good faith effort to moderate.
 
Wonder what the actual reason is. It's easy to say that any company isn't doing enough content moderation.

Telegram is widely used in Russia and Ukraine, and with the situation over there being what it is, I can see them wanting to squeeze access to intelligence out of Durov.

At least, in America, these big companies can hide behind Section 230. Maybe Durov should've looked into American citizenship rather than French.

The difference is trying. I’ll step away from all the legal examples and do one I think might be more relatable. If I try to make a deadline, and put forth my best effort but miss that deadline by a day, I’m unlikely to be fired or penalized. But, if the reason I missed the deadline is because I sat on my ass and did nothing, I’d fully expect to be canned.
