I used to have the same problem with my old 3G (I now have the iPhone 4). I think the problem started because I was either using it too much or I would press the button too hard. I think the home button wears out if you don't click on it well.

It's definitely a problem. It was frustrating that my clicks wouldn't register. I would have to press the button firmly and more than once for it to register. If you would press it normally, it would click (sound) but it wouldn't register the click.

My solution: sold it and bought the iPhone 4 :p

I have to press the home button a few times for it to work, although it is intermittent but it will do it every few presses.

If it's possible, record a video of your phone malfunctioning and bring it for your appointment: they'll replace it with no questions asked
 
so you are saying the button works if used correctly ?

"dear Lexus I crashed my car because the car would not stop when I lightly pressed the brake pedal. the pedal worked 100% of the time if I pressed it firmly, but clearly this is a hardware issue, please give me a new car"

Sound to me more like an issue of "I've pressed the brake half way down only sometimes does it start to slow."
