My theory is, the people that have it hate it, and the people that don't just don't realize how atrocious it is.

I have the semi-transparent menubar and I don't hate it. Most of the time I don't even notice it. :p

Some of us are already stuck with the opaque menu bar! I still haven't made myself clear?! Guess I should post this again...

People using old 12" PowerBooks have reported having menubar transparency. Whilst it may be the case that newer core Image, Intel machines seem to have menubar transparency available there are several anomalies that cannot be ignored.

1. Intel users that do not have menubar transparency.
2. PPC users with old GPUs that have menubar transparency.
3. Nvidia GeForce 5200 users without menubar transparency.

We don't have enough evidence to assume anything. All theories thus far have been quashed by conflicting evidence. Users with ATi Radeon X1900s have reported having no menubar transparency when a user with a MacBook Intel GMA 950 reports having transparency.

Hitherto there is no definite pattern. Don't think you've found the answer just yet because I'm sure there will be something to disprove your theory.

Nevertheless I think we are close to finding out the limiting factor unless it is just a bug that Apple needs to fix in 10.5.1 so by no means am I encouraging people to stop trying.
 
i think it's a quartz 2d extreme issue

my poor 12" ibook with radeon 9200 don't support quartz 2d extreme (i got a non-transparant menubar)

try the quarz debug tool:
(you have to install the developer-tools from the dvd)
/Developer/Applications/Performance-Tools/QuarzDebug

in the menubar click tools
in my case there is a grayed-out item which says "Quarz 2D Extreme Not Supported" though i enabled it in /Library/Preferences/com.apple.windowserver.plist
Quarz Extreme itself is enabled - i got transparent menus but with no blur.

So 10.5.1 is here and I take it there's still no solution?
Apparently not. Apple's official response is:
Some graphics cards, such as an NVIDIA GeForce FX 5200, may not have the necessary OpenGL capabilities to display a translucent menu bar even though they are compatible with Core Image. Those cards should render most effects, but not the translucent menu bar.
Others state that the translucent menu bar is rendered slightly differently (with a slight curve) than the contextual menu (right click) and therefore doesn't work on the 5200. Yeah, that sucks folks.
 
Hopefully, it was a deliberate design decision - not just something that slipped through.

Soundtrack, at least, doesn't completely disable it, it just makes the menu bar less transparent.

Turn on the "Aurora" background and open Soundtrack. You can still see at least one of the really bright stars shining through, or at least that's how it works on my 20" iMac G5 2.0 GHz with 2 GB RAM and 128 MB VRAM.
