Apple Care told me on the phone call, that they admit the low battery usage time as a defect/deficit and as a consequence of this, they would exchange the iphone as many times until I am satisfied with my phone, irrespective of the return period.

They didn't admit, that there is a difference between the Samsung and the TSMC processor, of course. But they admitted that I have a problem with my iPhone, that causes low battery usage time, whatever it is. And as long as that problem exists - (and we know, that it always exists with a Samsung chip based iPhone) - they will exchange it for me until I am happy with it.
And after the 2nd or 3rd time of exchanging the device, I can have my money back, but I think that has a legal cause here in Gemany: the manufacturer is allowed to correct deficits 2 or 3 times and if the deficit still exists after that, then you can bring it back and get your money back, irrespective of the return period.

So I would be correct in assuming you didn't have to burn one of your Applecare replacement "incidents" for this?

That sounds about right.
Quietly replace the problematic devices if asked, do not admit the fault, hope not too many people come forward.

I won't change it solely on the basis of the benchmark results. My last unit was giving me unsatisfactory battery life in terms of day to day usage. I'll use this for a while and if it performs sub par I will return it.

Alright. Please let us know, if Apple is still as accommodating as now after a few weeks/months. ;)
 
Now everyone who exchanged for TSMC, you all need to go back and exchange for Samsung.



Weeks later, when new benchmarks show the TSMC being slightly faster in 3Dmark you can exchange it all over again! The fun literally never ends when it comes to annoying the !*$% out of your local genius bar.
