If you had this great plan to sell the droids to pay for the iPhones what did you do with that $$???

The only one guilty of fraud here seems to be the OP. And heck, I'm guessing I could have gotten my iPhone as an insurance replacement, but just did an upgrade to have it done and over with.

I think calling his actions fraud is a little overkill. If I purchased an iPhone today I would be entitled to warranty support for one or two years, depending on whether or not I had AppleCare. If I got a new phone nine months from now, I would still be entitled to warranty support for my iPhone. The old warranty doesn't expire just because I got a new phone.

The thing is he sold the Droids, and tried to keep the iPhones at a subsidised price. He can pick one or the other, not both. I guess fraud may be a bit harsh, but either way it is still wrong

It does when you're offered the new phone as a replacement. He had broken DIncs, and Verizon gave him iPhone 4s as replacement since he declined having them repaired/replaced again. You can't go back and say, "Oh hey, I'd like to have this repaired after all."

Well he did and VZW is sticking him with the bill. This kid, who has been very quiet now, tried to swindle VZW amd VZW out smarted him. Now, if they just so happened to have added the charges sans refrub Droid delivery then I'd be on his side but that is not the case here. And sticking it to the old lady is repulsive. This kid f'ed up, not her. Sure, she didn't notice the texts but it is reasonable for her to believe nothing is wrong because she likely had little to no part in the transaction.

Not true...I purchased a black macbook a couple weeks ago, along with an ipod touch 16gb which i paid 400 plus tax for. Received the $299 rebate for my ipod about a week later. I exchanged my touch when the new 2.0 software came out, just a couple of days after i purchased it, being as I wasn't down to pay $10 after I had already spent nearly 2000. They gave me a new receipt for the exchange, and the new ipod touch. About a week later my girlfriend and i decided we would buy new iphones (3g). Went into the store, asked for a refund on my touch, supplied my exchange receipt, and received roughly $430 on a gift card, which i immediately applied towards our iphone purchases. Pretty sweet deal if you ask me...oh yeah, not to mention the $100 discount i already received on the computer for my student discount. :D
 
Seems like the OP is infamous for trying to worm his way through loopholes just to save a buck. This time it bit him in the ass. I would feel sorry for the old lady, but I believe that's all made up and he avoided the texts on purpose.

Actually, I did come back...Fortunately, unlike some of you tools, I have a life, and do things other than spend every waking moment of my life on the computer. Turns out, Verizon did screw me, I called about this issue prior to the 90 day period that they claim existed and no one told me about it, I found this out by calling and asking for a CSR to check previous call-ins, something I hadn't even thought of. Actually I even called in a couple of times after I supposedly didn't sign the contracts when we activated the phones. Either way, I figured a solution, getting the charges taken off now that I went into the corporate store and signed a couple of contracts.

For all of you questioning my decision to get refurbs and get the iphones...ARE YOU KIDDING ME?

You do realize that I had to sign (2) 2 year contracts to get those phones.
You also realize that I have a 1 year warranty on said phones.
You also realize that Verizon OFFERED to replace those phones, prior to me complaining that the problems was with the droid incredible, not my specific piece of hardware.
They had the choice to NOT refurb those phones, and also to NOT allow me to do alternate upgrades using other lines that actually weren't even eligible for new every 2's at that point which resulted in me getting the iphones.

What I did was use my head, and at no point did I break any rules, commit fraud, or anything other than what was completely within my rights.

What they did was:
(A) Sent out text reminders to an elderly individual who doesn't know **** about SMS or anything other than answering the phone.
(B) Failed to deliver manual contracts by mail, which would have informed me of the mistake with the new contracts being signed. (EVER HEARD OF CERTIFIED MAIL??? -- A contract is worth money, to claim you sent something, and then to have it result in the customer having to pay close to a thousand dollars because said customer never received the contracts is UNACCEPTABLE.)
(C) I called in multiple times in between the activation of the phones of March 31st and when said 90 day period was up, and nothing was indicated to me of the contracts having not been signed or that i would be charged for anything other than the unsubsidized price on the phone
(D) Wasted 4+ hours of my time when everything I did on my end was completely within my rights
(E) Completely out of no where placed said charges on my bill and failed to call or send any sort of letter with the PAPER BILL the primary receives every month, which could have indicated the need for us to sign the contracts
(F) Acted like complete jerks until I found out that I had proof I called in and asked about the equipment charges before the 90 day period and was told I would be sent a contract, which never came, even though that call was on like the 89th or 90th day, which would have meant the CSR should have informed me the need to get my ass immediately to a Verizon store to sign contracts, like I now have done.

For anyone wondering where I got the phones, I bought them subsidized from Verizon, after they agreed to pull some strings because of all the problems we were having with our DROID INCS.

For all of those who think that companies should just be allowed to screw the customer, becuase they are huge and I am just one person, well, I guess I now know why so many of you choose apple products...:apple::p

Word. I spent all yesterday traveling from NYC, haven't really had time to respond because I was dealing with the issue on my own, and most of the people on this thread are flamers and trolls who just assume they understand the entire situation. Given it was my responsibility to explain said situation, I don't think its very cool how everyone just assumes I am committing fraud or breaking some law.

I'm also wonder where the Droid money went. OP is trying to cover his ass after he committed fraud.

Explain how it was fraud. Please.

Yeah, too bad I can't do that anymore now that they aren't offering ipods with comps. Ha, its funny, you think that its wrong that I was able to sell apple their product back, versus paying ebay/paypal fees to sell it. If it was wrong, they shouldn't have let me do it.

Furthermore, whats with everyone on here having such a hard on for apple and their billions, your just pissed you couldn't pull off the same thing when you bought you most recent apple computer.

I think that when a company charges outrageous amounts of money for a product, finding a loophole and exploiting it is hardly the fault of the customer, it is the fault of the company for not guarding against said loophole....think I was the only one in the world that tried to return my ipod that i got with my comp? Except that somehow this kid is getting a bill and somehow he gets the bill but not the letters that VZW sent? I call BS. The kid got the bills and thought VZW can't do a thing and now look where he is.

As it was already said, the upgrade to the iPhones were "subsidized" because the kid rejected the refurb Droids. However, once he went back and took the refurbs the iPhones were seen as out of contract purchases or "early upgrades". Either way, the kid owes the money. Best bet is to sell the other phones and pay the bill. These things happen when you don't fully control your own finances or take an active role in them if you're sharing responsibilities.

It doesn't matter I got the droid refurbs, we were doing alternate upgrades, meaning using new every 2's from other lines, the droids are irrelevant, I had already signed 2 year contracts to get those phones, I legally own them, and legally have a right to exchange them under warranty because they were defective.

Literally 4 different 2 year agreements, no double dipping involved. Sorry if you didn't understand my entire explanation/if it was explained poorly.

Would they be removing the charges if they thought I was scamming them? No.
They realized they made a mistake and they are correcting the mistake. As well as giving me at least $25 for the inconvenience.

From what I can tell, it sounds like 4 phone lines were involved and you signed 2 new contracts on 2 lines to upgrade the phones on 2 others. Am I correct? Actually, sounds like you screwed some old lady out of upgrades on her lines to give them to you and your gf. But that's just an assumption since I know your history but don't know all the facts in this situation.

Didn't screw anybody. She was fully aware of the upgrades. Please ask me to provide any information you are unclear on, as there is no way that you would interpret me as having screwed anyone if you knew the details and understood the situation.

The situation with VZW and Apple have nothing to do with one another, except that both situations involved me and my purchasing power.

And who are these people I have convinced? A bunch of internet blog readers? Do you think I care what your opinion is of my character?

I won't be posting anymore in this thread as all that is/has happened is a bunch of flaming and trolling. I resolved the situation and I am happy with the outcome.
