i just hope you had written down the imei number etc of the phone just incase he sends you back a different phone

i say this because i always write down model number, serial number, mac address (where possible) etc to save on fraud

i had one guy on ebay buy a 360 off me on ebay, a few days later he said it didnt work, and had got the 3red lights.
so i nicely said "ok, it was working fine when i sent it to you, just ensure you send me back the one i posted out to you. i say this because i took the serial number, model number and mac address of the console, before i sent it out to you and have photographic proof of this! and if i receive it back and if the details do not match up with what i have, i will take it up with paypal and the police"

i got a reply a few days later saying "oh its ok now its been working fine since i emailed you the problem. sorry for any hassle caused"
 
No they can not. I know this for a fact because I had an issue with paypal where something got delivered to the wrong address and I never got the item back and the buyer never got it so he opened a dispute I provided all the info I had and papal couldn't make 1 god damn phone call to verify and so they put a negative balance on my account. and since I didn't use that account again it remained a negative balance. the only upside is that it has not shown up on my credit report, as I have bought 2 cars and a house since then and that being said I have no incentive to pay this.

Just because they didn't do it to you doesn't mean they can't, haven't, or won't. They absolutely CAN and HAVE pulled funds from sellers bank accounts before.

Google it.
 
You should have put Sold as is and no returns on the auction.
If its still under the 1 year Applecare warranty tell him to bring it to Apple and they will replace it for free.
But there's tons of scams on ebay.
I wouldnt be surprised if he doesnt send you back an empty box and still get his money from paypal.

Even so, if I were the buyer and he had put that as excellent and I found out it had scratches on it, I would not be pleased. And I may not try to return the item (depending on how bad it was and if it was not cosmetic mostly cause I'm lazy) but I certainly wouldn't fault some one less lazy then me for wanting to return it even if there was a no return clause. Mainly cause the item was not as described and therefor I do feel they are entitled to you returning it if you sell them something they didn't agree to buy (She agreed to buy an iphone in "excellent condition". I'm sorry, but cracks on the back is not excellent condition).

And I certainly wouldn't fault them at all for giving you a negative rating if you refused and they had to get paypal to force you to refund the money. In fact I'd feel thankful to them for warning me about the fact you aren't very accurate in your descriptions (as a buyer two things will get me to neg rate some one, not recieving the product or product not as described <- though this depends on how far off the description it is).

Mine has been pushing 2 years and nothing, and they can not take the funds with out authorization, or if you initiate another transaction. I just opened a new paypal account under my wife's name.

Like I said, that's great it hasn't ever happened to you, but it does and has happened. It's happened to me twice in roughly 8 years. There are posts all over the internet about it happening and no, I didn't give them authorization, they just reverse the charges.

I have been selling on ebay for years, there's pretty much nothing you can do. It's a big scam, you can pretty much get a free ip4 on ebay if you want. Ebay and paypal will always side with the buyer.

So if you don't want negative feedback, just let him return it for refund. But most of the time, you will get back a diffrent phone, or a big rock. Just make sure u open the box up in front of the carrier.

The carrier isn't going to know it's a different phone. Better to make an unboxing video of it to sent to eBay/paypal if necessary.
 
Op issue the refund; you have no choice as paypal will do it for you. They HEAVILY favor the buyer. I had an auction where something similar happened.

In the case of the OP, I would say Paypal is actually doing what they should be doing. Because he was not honest about the condition of the phone.

Sure, smart buyers would ask (or check out the guy's feedback) but it still does not make it right to call it *excellent* when it has cracks (excellent when buying used items usually denotes it is in practically perfect condition all around). Especially not to even mention the cracks ("excellent condition. It does have a few hairline cracks but they look more like scratches" would be more appropriate if he wanted to get the point across that other than that it was in really good condition). Honestly, he didn't even just leave out a detail, he lied when he said it was excellent condition (excellent condition implies no cracks or even not many if any scratches).

And he'd deserve the negative feedback if he didn't refund the item willingly (rather than having to resort to Paypal strong arming him). Personally, I'd kinda hope he'd get at least neutral feedback regardless of if he willingly returned it or not for not describing the item accurately (after all, feedback is supposed to help buyers decide if the seller is trustworthy. I know I'd like to know the guy has a habit of leaving out details when buying from him).

Now, I do agree that even so, he should be wary of people trying to scam, but given his own admissions to condition of the phone here and what his ebay auction says, it sounds like to me that this time it is an honest buyer and that the seller needs to learn to have better descriptions next time.
 
They can take it from your bank account. You agreed to that when you signed up. If you have no money there they will turn it over to a collection agency. They will get their money!

Not really. My friend owed Paypal for several years. They gave up.

One thing to keep in mind is not all paypal accounts are "verified," meaning you have it linked to your bank account. You can get paid by requesting a check (for a fee) and they have no way of getting the money back.

They will send you to collections first because they will charge the negative amount back to your PayPal account and you will have to add funds to fix it before you can use your account again. If you REFUSE to do that, your account is closed and sent to collections.

Those of you who think otherwise obviously have not had or used PayPal extensively. I have had them for 10+ years.

Absolutely...You are correct. I remember on another forum several posters saying they had been sent to collections by Paypal. Iff somebody wants to push it, say goodbye to good credit for 7 years!

It's not a rumor as they HAVE done this to me. It's a reversal of charges. I've been an Ebayer for 10+ years myself and a Silver Powerseller for 8. Thanks!

Thats the problem.
He shouldnt have put it as excellent condition so Im not sure how minor or major the scratch is.
But I dont think the buyer really cares about a tiny scratch but is more likelly trying to rip him off.
Even if there was no scratches or it was perfect if he wanted to screw him he could have said its scratched and dinged and send him back an empty box while getting his refund.
So either way with ebay you're taking a big gamble.
But selling it is as in conditition described and with no return policy should help avoid scammers in general.

You are probably confusing it with something else then. PayPal - for the last time - CANNOT reach INTO your bank account and remove money without your permission. Period. It's illegal.

I'm not confusing it with anything as Paypal is the only payment method I use. If the payment hasn't cleared your bank they can reverse it, idk if it's legal or not, but I'm telling you it's happened. If you google you'll see it's happened to lots of other people too. :)

Are you talking about withdrawing funds from your paypal and putting them into your bank account?

What? I know how to withdraw money from my paypal account and transfer it to my bank account if that's what you're asking.

You know that little box that says Completed in the transaction part? Well it's said Reversed before. They stop the money from clearing your bank account and put it into escrow, or whatever they do with it, till the complaint is resolved. AFTER you've begun the transferring of funds which usually for me takes 2-3 days.

I don't care if you think I'm lying or have Alzheimers. Like I said you could always google or so to Seller Central and you'll see people saying the same thing has happened to them.

This happened to me. The guy didn't send me everything back either, but they didn't care. Eventually I had to pay them and still never got my stuff back.
 
Why not offer a partial credit, 10-15%? Admit your mistake and the buyer keeps the phone. It was your fault, make it right.

Excellent suggestion.

I have purchased a TON of items off of Ebay, and in the one instance where something appeared damaged, the seller agreed to refund a small amount back and I was happy.
 
paypal cannot take money from your bank account. The only way they can do this is called a piggy back - If you have autopayment on with ebay that withdraws from paypal each month, they paypal piggy backs the payment when ebay request paypal to withdraw from your bank.
