My girlfriend doesn't haven't the receipt, last time I checked and was told that the phone had to be mint and AppleCare plus can only be added within 30 days? If that's changed please let me know. Looking to add it to mine soon just had some things come up had to take care of so not willing to throw down $130 just for insurance

The actual warranty start date was the day it was activated..? Said 12/23/16 was the expiration date, so that would be 1 year from the day it was activated?
Go to the website listed above and check if there is still warranty left on your iPhone. Also use the serial number to check production date on Chipmunk.nl
That should give you a rough idea how much warranty is left on the phone if at all.
You can purchase AppleCare+ within 60 days of the first time the iPhone was purchased.
I have never seen anything other than the warranty being retroactive to the original purchase date. If you buy from an authorized dealer, its the date of your purchase. If the seller is not an authorized dealer than its the date the seller purchased.
If Apple is unable to determine the date, they will ask you to produce a receipt from an authorized dealer.
The time you have to buy Applecare varies by device.

I believe she has upto 1 year from original purchase date to buy AppleCare. So the guy you bought it from could have bought it 11 months ago. Doesn't change the 1 year warranty from purchase date. All that happened is your girlfriend increased the warranty length and coverage by buying AppleCare.
Edit: ok so it is 60days not 1 year for when you can get apple care

Warranty seems clear. Look to see who is the authorized reseller and when the transfer was made from that person to the first end user. That's when the warranty starts.
However, having said this... What should be the case according the clause doesn't necessarily always turn out to be the case since serial numbers aren't always reported as soon as they are sold and resellers sometimes sit on old inventory. So Apple may give reasonable benefit of the doubt and start warranty periods on first activation if they have not logged the device having been activated. (A lot of this depends on the reseller, some are more diligent than others and some don't report at all). Hence your anecdotal evidence. However, Apple may request to see a receipt. And if pressed, the important receipt date would be the one which shows the transfer from authorized reseller to first end user.

If you buy any apple product already activated and it's under a year old the warranty goes with the device. I buy the vast majority of my electronic products used and it's been that way with everything Apple.
NOT going to happen. Warranty starts the day Apple or one of it "official retailers" sold it. Period
