Time to drop a lawsuit on him, take him to small Claims court and sue him and make him Pay all the fees.

You also need to file a BBB report if you haven't already, so it can effect his future business.

Since you mailed it to him, which I'm guessing was UPSPS - couldn't you also look into him committing mail fraud? The post office usually doesn't take things like this lightly.

Just another angle to pursue.

Where is the mail fraud in this case? A package was allegedly sent assuming that it was received. To the OP, is there documentation to back up the postal transactions? Was it sent certified, signature confirmation? Without documentation backing your claim you will likely have an uphill battle, and get nowhere.

My opinion is at this point is that you will never see the said iPhone prototype again. I hope I am wrong, but this has been dragging on for quite a while with zero positive results to the desired outcome.

I'm still here, I don't have my motherboard. I recently called a number which I found which when called says "Frega Household" but I do believe it is the parents house.
I have the rest of the chassis and everything else.
I will try my best to get it back and hope I do.

The fraud in this case would be the OP sending the MB to the person with the intent of receiving it back repaired but instead said person stealing the MB. You could easily argue that the person obtained property by false or fraudulent promises (by promising to repair said MB).

But your right, some sort of proof of delivery would be needed. Apparently it covers private carriers, such as FedEx or UPS - which I didn't know until now.

For reference mail fraud is:

Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122)), or affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both

The best thing to do would be to contact Frega's local PD and have them sort it out...or nail him for mail fraud, as was already suggested.

I just re-read some of the mail fraud stuff.
I sent it with a tracking number I believe, and I'll have to dig it up.
I'm pretty sure I will try and report Frega with the Raleigh Sheriffs department for Mail Fraud. Are there any specific procedures to reporting a case of mail fraud that I should be aware of? I'm going to make another phone call to the Frega household under my actual number and not a blocked one, sending them a fair reminder on their voice mail box that if I do not get contacted within 3 days I will proceed to report their (presumably) son for Mail Fraud.

I have dozens of chat logs in which we discuss the procedure he will do, and how long it will take him. I saved all the chat logs, so I have more than enough evidence to back up my claim.

Does this sound like a good plan?

I just think of where in the world my motherboard is... and it makes me sad. I really hope it is in at least the condition I sent it as, though it is unlikely.

He stole something from you. Call the police. Even if you have to give the thing back to Apple at this point, it's now about not letting this guy have it.

The mail fraud claim is on a federal level with the US Postal Inspection Service. See the following link for more information. If you pursue this route you need to have all of your documentation lined up, printed, and ready to present. This will need to include all of your shipping proof as well as emails and chat logs.

WOW. Just caught up with this thread after nearly four months. Defiantly not a fun situation you're in right now. As others have mentioned.. Goodluck with receiving your MoBo again.
 
And another wrinkle in this story.

Today out of a sudden inspiration I decided to call a number which I found through a background check website. Who picked up, was his mother, and I was immediately greeted with a hostile tone from her. In essence she told me to "grow up, and get a lawyer, and to not call me again".

The best part is I had left a voicemail earlier in october to that same number and Ms. Frega told me that Carl Frega had told her that she had been in contact with me.

The last time Carl Frega answered any of my communications was on September 25th.

So that's that, and I have just finished completing the Mail Fraud report. Let's hope the law can help me solve this.

An empty iPhone 4 Prototype shell sits on my desk waiting for it's motherboard...
 
Small claims court. People's Court. Local news station. Newspaper. Get this story out. It's a high profile item with an unfortunate story that can be sensationalized and used to get viewers. It's the holidays. People want to hear about evil doers getting the what fer and good people getting justice. You're wasting time with mail fraud. FILE WITH SMALL CLAIMS COURT. Provide all necessary documentation and hit him where it hurts. Act fast before the statute of limitations runs out (I have no idea how long that is, but better sooner rather than later).
