Not sure what the laws are elsewhere, but certainly in the UK that policy would be very illegal. If a product is defective, then you are entitled by law to a repair or replacement at the very least.

Think it would all come down to who is deciding how you define defective.

Well for a start under UK law, a product sold must be fit for purpose.

I think you could quite easily argue that issues like the reception problem, the proximity sensor issues etc etc make the iPhone 4 not fit for purpose if your phone suffers from them, as it impedes its ability for it to be used as a phone.

More specifically, "It must be as described. It must be of satisfactory quality, sufficiently durable, free from any defects". Thanks to the BBC for that nice description.

I don't think there's any wiggle room in that for apple.

I have a wiggley home button and a yellow spot on left corner part of screen. Im afraid to get a replacement bc my reception and proximity is perfect.

Any ideas what I should do?

the reception is almost certainly caused by the design. If you cannot replicate it in your everyday use, you most likely will have great coverage and the replacement phone wouldn't perform any worse.

the home button and the yellow spot can definitely be gone in a replacement phone, though.

so, go get a replacement

If you have more than one apple store in you state you could always try to go to a different apple store and see what their genius bar says. Sorry if this off topic. I have white 13 inch Macbook with the intel processor, the problem that I had with it was the bottom part where the keyboard is, by the mouse area it was starting to yellow and started to crack, so I took a new apple store at the Fair Oaks Mall, in Fairfax, VA and my computer was not under warranty, but they did replace whole bottom part with the keyboard free of charge, and did it the same day I did not have to leave it there was like only a 10 minute fix.

I have three apple stores near me. So I can probally get three different opions if I wanted to.

So I would say go to a different apple store if you have that option.

same in the US, and if something is shown defective more then 3 times they are requried by law to return the product for you if you wish...

It's amazing when I see threads like this because I have had no problems with mine, and neither have any of my friends...

Really? That would have been awesome to know while I went through my 17 3GS's...

I can tell you this much, I would never get to the point where I went through 17 of anything trying to get it to work. I would have quit after the 3rd time and switched brands or carriers. :D

The sad part is that is only a SMALL exageration... I went through 14 iPhones in less than one year.

I also agree, I tried many times to give up and move on but unfortunately nothing ever felt as good to me.

Now that I am having a problems with my iP4 (dead pixels) I am determined to give up on Apple camp but again the hardware is so damn nice im having a hard time migrating away from it.

yea I feel much the same.
Whats the Tech equivalent of a hypercondriac ?

Yeah, it sounds like an episode of Lost. :D

Off topic, but I'm seriously gonna miss that show.

Anyway, I'm still waiting for Apple to contact me regarding my French iPhone reservation and I'm hoping nothing's gonna be wrong with it..

Wasn't aware that it's a limit on how many times you can swap out a defective product. I'm on number 5 on my iPhone 4 and no one at the genius bar gas said a word yet. Looks like I'm going to hold onto this one until apple says something. Gas is to exspensive!

Usually really easy to spot by the Apple logo on their kit, and their tears in their eyes as they examine a slight blemish with a jeweler's loupe. ;)

Just curious but what did you return the iPhone 14 times for? Was it the same issue? I cant fathom how one person can get 13 bad iPhones when many other people pulling from the same batch/store can have perfect ones.
Are you so picky so as to return it if it had one minute barely noticeable hairline crack in the plastic, like what was common with 3G/3GS backs?

This is the third iPhone 4 I've had since launch and when I told him what was wrong [proximity sensor, bluetooth disabling, signal] he said that this is the last iPhone 4 that he could exchange for the same reason. I said WHAT?

You can't sell me that has these problems and not replace/exchange it until I get one that works, correct?

Here's an idea...stop returning them. Every iPhone has these problems, so why do you think your going to get a different result by getting a new one? Why are you wasting your time by going there to get a new one every week? If I worked at an Apple store and you came in every week for a new one, I'd probably me more harsh with you then he was. Go get an Evo or something else.

whydo u insist on keep on returning the phone for **** that you know hasnt been fixed yet? doesnt make much sense to me. are you that bored that you feel like u need to go to the apple store every week to bitch?

Dropped calls / Poor battery blah blah... The majority of the replacements were swapped because the cases were delievered to me cracked or with light leaks.

I'm sure the retail employees are encouraged to find ways to convince people they don't need to exchange. When I bought my first iPod (I think it was the 5th gen- the first ones that played video) way back in the day- I took it home and the thing was crazy buggy. The screen would glitch out, the audio skipped, it froze routinely. So I took it back and the dude actually tried to tell me that he couldn't find anything wrong with it. I said "well, how about you try playing a song" and the second he clicked on a song the thing went haywire. Even then they were reluctant to replace the thing, and this was 2 days after I bought it.

It's just how retail is- it's not really the employees "fault," they are just doing as they're told and I'm sure they are being pushed to their wits end with this iPhone fiasco. I would definitely recommend just calling Apple if you are having problems exchanging in store.

This is why I can't even imagine having to work at an Apple store because you have to deal with people like this. I feel like you only get this problem with people using Apple products. If the phone isn't perfect (it wasn't designed perfect) they will return it over and over again, when the "fix" that they are looking for just doesn't exist. It's incredibly annoying and the rest of us can thank these people for the high price tag that Apple products come with.

I went to the Apple store to exchange my phone for the signal issue when I first got it and the Genius told me to go **** my self!!:(

Yeah it was my brother he works there hahaha:rolleyes:

Wow, some of you people are so damn neurotic.

Returning phones so many times.

They have medication for people like that, go get some.

YOU are clearly doing something wrong if you have to get your phone exchanged more than maybe once or twice.

I didn't crack the phone before it even touched my hand
