haven't read the 2nd page cos the itouch thing was shi:confused::eek:ing me. ITS A TOUCH OR AND iPOD TOUCH *FULL-STOP*

try to only use the one they were ment to send u. and if u take it in to get repaired u probably gonna get screwed. some 1 is probably missing a touch somewhere but yeh apple gonna get u if u take in the one u not ment to have. do u really need 2?

sell it late August as a brand new 1 to have money for a 2nd gen ipod touch, i would. Or am i just immoral?? (rhetorical question)

Keep it if they don't ask for it back.

A few years ago I ordered some wine by mail. I informed the company that due to delays at their end I was going on vacation so not to deliver until after a certain date, they agreed.

When I returned from holiday I found a box of wine. The same week another came! I rang them explained what happened and arranged for them to come and collect one of them. I took the day off work and they never came. Rang them again they said they would collect it and they never did. So I drank it all!!!

I put myself out being a honest person and in the end wasted a lot of my time.

If Apple make mistakes then they have to pay for them and I am sure they must run their business being aware that these things happen.
 
Ok, so I just got the itouch, it finally shipped. BUT! ...There were two. And according to my account, I was only billed for one. Does anybody know what's going on?


yes.... i'm the one who packed your order. that was a mistake. could you mail it back?
 
In the UK the extra one would be 'unsolicited goods' and become legally yours after six months. If you tell Apple they would have thirty days to collect it from you, otherwise it would then become yours after thirty days. What you can't do is sell it until you are the legal owner.

but i really don't think this comes under the definition of unsolicited goods. whilst it's true that it's an offence in the UK to demand payment for goods known to be unsolicited, it means they were sent to a person without any prior request made by them or on their behalf. in this case the op expressly made a request for an ipod to be sent to him but an error occurred and two were sent. this is not the same as an item arriving out of the blue that you have never asked for along with a demand for payment.

by the way the thirty day period for collection following which ownership passes only applies to goods received before 1 november 2000.

i have no idea what the US law is, but i would guess that the same principle (that it applies to items which arrive but have never been requested AT ALL) applies.

none of this takes anything away from the ethical point that this second ipod was sent by mistake, has not been paid for, and should be returned (at apple's expense).
 
I can't believe some of these posts promoting abosolute dishonesty. Since when does the relative size of a corporation affect your decision to be honest or not? If your grandma/father/friend accidentally gave you two iPods, would you keep both and sell one on eBay, hoping your grandma/father/friend doesn't find out, or would you return it to him/her so she can give it to the intended recipient?

If your answers on what you would do differs whether it's your grandma or Apple, you've got some serious integrity issues. Whether you're stealing from a company or stealing from a family member, it's still stealing.

BTW-not giving the OP a moral lecture-just appalled at these previous posts.

They said that they can't ask for something back that they erroneously shipped to me, and they congratulated me on my acquisition of a free ipod. I then told them that they didn't ask for it, I was volunteering to send it back. He just repeated his congratulations, and asked if he could do anything else for me.


So woo! free ipod. Deciding what to do with it...

oh, and they were both engraved. With my engraving.

They both had your engraving? Obviously wasnt someone elses then, and they def couldnt resell it. Good for you!

No wonder they didn't asked you to return it because both has engraving on it. Lucky you!
 
I myself got a Logitech Z-10 speaker set once. It was getting really hot and I called Logitech if I could get another set free, if I returned the Z-10. They send me the Logitech Z-4i for free, and told they would get the other set on a later date. That was 4 months ago, they never came. Sold it on Ebay for 100 euro's.

Congrats on your free iTouch!.............................................Ok iPod Touch, just joking;)
 
I got an extra Dreamcast once by mistake. I meant to call them about it but got too "busy" (no, really). I never got billed anyways and by that time, Sega had discontinued the unit...
 
wow, you really lucked out. if i were you, i'd give it to someone special.....unless you really need the money. just think how happy you could make someone.

There is only 2 options I see.

1. I give you $50 and you send the touch to me

2. Goto a local apple store tell them that you want to return it. Then they'll give you store credit, buy something else. Consider a return reward. then you can say "I returned it, Apple was so happy they gave $--- "

I bet what happened was there was some minor flaw, they redid it and decided to send you both units. I would be willing to bet money on this. What can they do with a unit with your name enscripted? They send you both and they have an extremely happy costumer... Apple does it again:):apple::apple::apple::apple::apple::apple::apple:

Um, actually they will NOT. Customized/ personalized or "built-to-order" products are NEVER returnable. If there is a problem they will be repaired or replaced with the same likeness but they're never outright returnable.
