Legal System

The legal system in the US is just screwed up – total(!) loss of common sense.

And although I like the USA & got lots of friends there: whenever I read about things like this, I'm glad to live in the "old Europe".
 
So much of the front of almost any apple store is glass. She might have honestly missed it, but it is the suing part that makes this a bit ridiculous.

In my opinion, everything else in the storefront was opaque, then she would have a better case. a sensible conclusion could be that the doors are open. So much of the front of the store is clean clear glass though. Very few people would draw the conclusion that the window displays have no windows in front of them.
 
Only in America, lets sue for more than 10 times what my damages are

well i should label all of America bad i have friends there and I love to go to New York and Florida but man you wouldnt get far with a case like this in Canada
 
I walked into a door once. Got a nose bleed afterwards. So have plenty of my friends. I'm 30. I did this when I was 25. People really need to be responsible for themselves. But then someone got millions for spilled hot coffee, so yeah, America is awesome.
 
The numerous comparisons to the McDonalds coffee incident only prove most commenters have no idea what they are talking about.

The issue here is not transparency or eye sight.
The issue is simply greed on the part of the lawyer and the lady.
People think our legal system should function as a Mega-Bucks lottery.
Rather than working for a living they want to strike it rich in court.
The solution is simple, in the immortal words of the great Bard:
"First we kill all the lawyers."
Perhaps Shakespeare was being a little too broad with his brush but we get the drift that this has been a long time problem.
 
This is my local Apple Store and I find the story to be incredulous. Every time I have ever been there (probably 15-20 times), the door was opened for me by a staff member, unless the doors were propped open. Yeah, I know it's anecdotal.

The real reason I find it incredulous is because the doors have these big ass stainless steel handles on them. You'd have to be blind to miss them.

As for the story, it contains an error, there are not doors at either end of the store, only one.

Being an American was grand many years ago, these days everything seems to be so corrupted. People have become shallow, materialistic, greedy, selfish, etc. and it's not getting any better.

Unfortunately, access to the internet really gives us a view of this regardless of how accurate/distorted that information is conveyed. Sometimes the best thing I can do is simply stay off the web and TV and just enjoy life. When you cut out those two mediums, life is a lot more relaxing. As much as I hate to say it, I visit CNN.com and Foxnews.com each morning to see what ridiculous news they're playing on that day and I always regret it but like a moth to a flame, I keep going back.

The information age is great in certain ways, and destructive in others. :(

If you are referring to the infamous McDonalds case that has been totally misrepresented over the years, you're wrong - she only ended up with about $600,000 which was after McDonalds was found to be 80% liable and had refused a more reasonable settlement for real severe injuries.

Any judge worth his salt would call this frivolous and fine the lawyer. Give the old bird an iPad and let it be done with.

If you walk into a door and blame the owner of the store, you need to be euthanized.

Thank god! It happened to me in my early years that i walked into the glass framing of an automatic door (glass, glass, glass everywhere and you could not see where the door actually was... )

My insurance company had to pay the glass (I broke it with my knee... F=ma) Never ever would it be possible to sue someone for this in germany. You would be laughed at all over again and again no matter how old you are.
 
Oh, give me a break. This is on the "McDonalds Hot Cofee in my Lap" level.

While there are many frivolous lawsuits, and this certainly sounds like one; the McDonald's Coffee case is a bad poster child for such suits despite its constantly referred to in such cases.

Simply put, McD's served coffee it knew was so hot that it would cause serious burns (at trail Mcd's admitted it's coffee was not fit for consumption at the temperature served)) and then, when sued, stonewalled until the lady sued.

Despite many claims on the internet and elsewhere, she did not put the coffee in her lap and drive off and then got burned, she was a passenger in a stationary car that got burned when she removed the lid to add sweetener. She only wanted reimbursement for medical expenses (she needed skin grafts and was hospitalized of r8 days with 3rd degree burns over 6% of her body) and lost wages, McD's balked and she sued. Even though she won the amount was reduced because she was found to be 20% at fault.

There is more to this case than just the headline "Lady burns herself with hot coffee and sues."

I MIGHT be for universal healthcare if part of the provision was that medical lawsuits were disallowed, putting an end to ambulance chasers.

I wouldn't be surprised if she won. The legal system is really messed up. There have been cases where burglars break into homes and get hurt in the process and then successfully sue the owner of said home.

Can you come up with a link to a case where a burglar has sued and actually won? I'd be very interested in seeing this. Anyone can sue, of course, and brugalrs have done that; but winning is another matter.

Without an actual link, this seems like urban myth to me.

There seems to be a tendency for people to want to believe the worst about American civil law. Yes, people sometimes do sue for crazy things, but most lose. And occassionally a jury will order a ridiculous judgement, but those are almost always overturned on appeal. I'm not going to say "always" since I'm not omniscient, but whenver I've looked into a harsh judgement that made it through appeal, it has turned out the award was justified. But people still cling to the crazy narrative as if it is pervasive.

I have to laugh everytime I hear the McD's coffee tale. Twice before this judgement, I bought McD's coffee; and twice I got second degree burns on my mouth, my lips blistering and the roof of my mouth peeling. I never bought their coffee again, of course; I don't know why other people continued to put up with it. But I'm not surprised someone got third-degree burns, and her lawsuit did everyone a service by getting McD's to fix the problem. I guess people are willing to act like sheep by drinking injuriously hot liquids and believing counter-productive urban legends without question, but I think things could be better otherwise.

I just read that whole article and still come to the same conclusion. The lady (or her lawyer) became greedy along the way. They started out with reasonable claims of 20k .. but then rejected a settlement of 250k, when they found out there was more to get and ended up with something like 600k. Greed was certainly involve one way or the other.
And to the point of McDonalds .. 180-190 deg Farenheit (equals 82-88 deg in real temperature aka Celcius) is not "scalding hot" and is not an unreasonable temperature for coffee.

This. I have seen the window. It's very clear. There should have been signage in the window.

I don't think she'll get close to what she's asking for but I agree an out of court settlement.

None of us here know all the facts, yet most will take Apples side? Maybe we'll wait and see before picking on the old lady. Sure there are too many lawsuits out there,but each case stands on its own.

If it was a case about an old lady walking into a Samsung glass door, I do believe that many here would be cheering her on.
It is a shame.
