I agree that greed and stupid are two different things...but has it occurred to anyone who is arguing compassion that greed may have precipitated this "accident"?

Guess what, some people can't see very well, especially when they're 80. Apple can't put death traps all over their stores. No different to putting pot holes where blind people walk, or spikes where wheelchair bound folk roll. Tim Cook might as well have smashed her over the head himself.

Why was she out on her unaccompanied if she's ancient and can't see?

BTW what was she doing in the Apple store anyway?!? They don't make an iAbacus or iTypewriter....

Sue your body for choking.

No, sue the beverage maker for not having a warning on the container that clearly states "This beverage may present a choking hazard! Use under extreme caution and always with a medical professional present as your spotter!"

Alternate headline: Birds Smarter than 83-Year Old
Actually, birds sometimes fly into windows by mistake too. However, they don't try to sue the owner of the windows. That part can indeed be debated that it's a sign of a higher form of intelligence.

However, the plaintiff's lawyer says that any markings that were on the glass are insufficient, saying his "client is an octogenarian. She sees well, but she did not see any glass.
This is so funny. Not even those awkward, ugly white markings are enough? And here's news: Glass is supposed to be transparent! Stuff you see through. Glass windows usually are. So she did see the markings, but they were "insufficient" because she assumed the markings were floating in air?

Why sue Apple when Windows broke her nose?

(hehe Saw it on a Norwegian forum, so not mine, just thought it was funny (despite the fact that she seems to have crashed a door and not a window).)

No doubt - I buried many birds that crashed into our large living room window and died when i was a kid. :p

Since Apple is rich...:p

$75,000 to surgically repair a nasal fracture is probably dead-on accurate (cost is an element of health care in America that no one seems to understand). However, since she's 83, she'd be covered under Medicare, so her out-of-pocket expenses were probably around $100-$200 tops. So, yes, this is BS.

Guess what? When people are at they're 80's, everything would easy be a death trap for them. Sad but true. An 83 year aold person out and about is always prone to so many hazards. That's why is allways good to have someone walk them around.

Lots of jokes about this woman I see. Of course, let's see how sharp and clear you see when most of you are 80+. The truth is, older people lose vision acuity, even if they have no vision disease or other loss. While I always decry our sue-happy culture, Apple should consider being a little less trendy and a little more practical when designing their stores or anything else that deals directly with customers.

Guess you haven't been to England lately. All you see on the t.v. during the day is commercials for lawyers. I know Americans are major Dbags but we didn't invent it.... remember most of our people came from European countries such as Denmark

Every country has its quirky laws. I know in China of a recent car accident that killed a child. The Chinese judge ruled the bystander helping her must be the perpetrator because he must of felt guilty. Then a Chinese baby was run over and everybody was afraid of helping due to being blamed.

In Turkey if your husband owes money that is not paid, his wife can be forced into prostitution in jail until the debt is repaid.

In Japan you have to support a persons family if your responsible for a person death.

Getting silly and abusive...

I can't help but notice that the comments appearing on this thread are abusive towards a poor soul who has been injured.

I remember being a kid in the 1970's walking into a glass door on a family holiday... It hurts! Also, I noticed in the following years that glass doors would be designed with opaque sections and marks, obviusly to avoid this sort of accident...... It is all too easy to trivialise other peoples misfortunes.... If Apple being sued, makes them take notice, and stake seriously that their obsession with the Zen can cause problems and then do something about it, fine...

Wow, just wow.

I'll admit it, while not paying attention, I've walked into a sliding screen before because I thought that it was open. The last thing that I'd do is point the finger at someone else and blame them. The normal reaction is you look around to see who saw your doofus move and then slink away.

I'd like to see the security footage. This smells.

The disrespect that you kids here show for old age is disgusting. Here is my wish for you all: That you will reach 200 years, gain a pound of weight every day, soon enough lose your eye sight and the ability to walk without help and eventually depend on a young one of your own school of thought. That ought to be the perfect punishment for you.

None of you should forget that it were those old people that gave birth to you and shaped the world that allows you to live.

You seem far crueller than the people that think its wrong to blame Apple and demand 1 mill $+ for making a mistake...

Only a matter of time. I hope that the judge just throws this person in jail for a lawsuit like this.

It's as dumb as the hot coffee mcdonalds thing. Somebody is just looking for a payout.

The drowning will pull down and drown anyone near them they can latch onto.

You can apply the same behavior to those at the end of life and the poor or desperate or insecure. Whatever the story is with this woman, she should be legally eligible for a bandaid and a shot of brandy, maybe a hug, a pat on the back and little else.

...wow. You showed them. You are superior to these hateful snipes.

The 'have it all' generation

Pensioners is used as an emotive term. Poor pensioners. Can't do anything to the pensioners. Reality is they have creamed it. Retired early, great social security provision. Who pays for all of this ? Those who can't afford housing now, have to pay higher taxes and will retire far later (by which time the benefits will have eventually dissipated).

#$#@#

there should be a law that puts people ( and their lawyers ) who file dumb cases like this in jail. also strip the lawyer of his license for taking the case.

this case is a waste of tax payer money ( time of the courts ).

Apple should sue windex for making their windows too clean that people can't see it.

Or sue the janitorial service they hire to clean the Apple stores for making the glass too clean.

Or it can sue the lady for putting a face mark and causing trauma on their expensive glass.

well who cares if that grandma wins... besides Apple has got loads of cash

When old ladies win frivilous lawsuits, it opens the door to other old ladies winning frivilous lawsuits. The more old ladies that win lawsuits, more people will sue. The more people sue, the more expensive Apple's insurance gets. The more expensive Apple's insurance gets, the more expensive your iPad becomes. Or something like that. You don't want the old lady to win more than her medical expenses--if anything at all.

I'm surprised at the bile here (ok, maybe not surprised, but disappointed).

Large glass windows/doors injure lots of people that aren't expecting them to be there or can't see them. Arguing that the lady should have been looking for a door is a bit harsh - lots of stores have open doors or automatically opening doors, so you get trained not to look for handles etc.

It is possible that the design and layout of the glass made it difficult to notice when the door was closed and that she injured herself as a result. It doesn't make her an idiot.

Yes, this does sound like a frivolous lawsuit, but no need for quite such hatred.

But the thousands of people that visit this Apple store without walking into the glass front doesn't count that the glass is easily seen and marked! It's always the one dummy that ruins everything for the masses! Why do we reward people for not being aware of their surroundings? Why is there people that always look to blame somebody else for their own incompetence? America has become the place that rewards stupidity!!!
