At least Apple isn't waiting like 5 years to file lawsuits anymore. God on them. I hope the dude get's smashed in half. Anti-Poaching laws need to be written specifically for the tech sector. I think the FCC or the FTC killed this back in like 2012 or something and it's been nothing but an infringement jungle ever since.

What exactly is your personal interest in having laws that skew in favour of the rights of corporations rather than the rights of employees
 
thats different, thats a state entity, apple is not a state agency nor its enforcement agency.

Of course it's different, I know that, but they do have their investigations into their employees. You would be surprised what they think they can and can't do. Remember the stories with Retail employees having their stuff searched daily? It only gets worse from there.

Are you serious? Do you expect him to get a slap on the wrist for what he did? Dude didn't take a few Apple tshirts with him when he left the company, he stole company secrets about one of their projects.

Perhaps he was simply keeping a personal archive of his own work

Employees hired in key positions can be required to sign non-compete agreements to prevent them from jumping to a competitor right away without the employers consent. Those grandfathered in could also be incentivized with a bonus if they agree to sign an agreement. The noncompete could require a separation of 6 months to 2 years before they’re allowed to sign with a competitor, or they could take any other job not directly related to their specialty right away.

However, in some jurisdictions, anything in an employment contract that contravenes local employment standards laws is unenforceable

Apple knows that a large amount of data was downloaded from their servers.

Apple knows that their data was downloaded to a computer that Apple owns and this guy uses.

Apple has Device Management software running on every computer they own.

This DM software allowed them to verify that data was downloaded and erased, with additional steps taken by him to disguise the unauthorized taking of Apple's data.

It is a crime to steal property, therefore there are consequences of his theft that must be paid. And pay them he shall.
sure, california penal code 487 capped max value for grand theft at 950 usd, first time offender is considered a misdemeanor. that is if the state prosecutor even bother prosecuting this as its almost the same level as stealing an iphone.
