More on topic...has anyone heard much on whether or not Apple had stuck to BASH instead of the tcsh that they've used as default for all this time in terminal? Also, is the case sensitive HFS+ partition still there? I haven't heard anything on these two things in a long time. Figured I'd might as well try to get this thread back onto the topic of Panther 😉

Okay, now that the morality discussion has been put to rest you go right on ahead and bring up case sensitivity! 😛

Don't worry, law's easy. You don't have to learn anything as such, just how to look things up in a law library! Anyway, the point is (before I further infuriate those poor souls who seem unable to discuss anything except computers and don't like to hear one word more than necessary 😀 ) that CDs - music, software, etc. is all down to licensing.

You buy a CD which gives you a license to listen to the music for 'personal use', be that feeling suicidal in your bedroom or hosting a private party. Even using it in iMovie could be a problem. The principle is clearer with videos/DVDs because they spell it out at the beginning.

This does all raise a practical issue which will upset the moral minority, in that if you use a film soundtrack you know in an iMovie, then put that on your webspace so your friends an watch it, you're actually committing a copyright violation unless you've secured the permission of the holder, as you've effectively 'published' their music to the world (even if you didn't tell them where to look).

In reality, of course (so long as you bought the CD) the record company doesn't care, and would rather not waste staff time agreeing the use of the tune with you.

Panther pre-installed?

Now for another 'sorta' on-topic question? When do you guys think we can expect Panther to be pre-installed on newly built Macs?
If I remember correctly, last year, with Jaguar, some people received their Macs with Jag pre-installed a couple of days before the official launch. Am i right?

For gpl if you made any change to source code, you need to publish your change. But if you take bsd license, the only think you have to do is not put your name on it ... this is exactly what apple did. They call it darwin ... not apple darwin or apple bsd.

and finally, did you ever ask mac os X to not show Blind/logo startup or try "dmesg" from terminal? if you do that, you will see some copyright from darwin base system.

from my startup console

and i realy think 129$ is a good price for an os. If you're not happy with it go straight to linux world. Everything is free and pretty good, you have damn fast system with weekly(should i say daily) free update. I run dualboot Max OS X/Gentoo (wating till portage being porte to os X). You complaining about cie. who want you to respect there license and you want cie. to respect your license. It's kind of absurde non stop circle. You know i think i exagerate a little bit because i'm with you for one thing, I do love opensource software. I'm developper and i release my developpement under gpl because i think it realy worth it.

Peoples are only buying software on os X because they like to buy. You have plenty of pretty good free software but people always think because it's free, it's just a bunch of ...

one small exemple there is a software call DesktopManager to let you have multiple desktop(pretty good). but i have to browse for about 5 or 6 pages before i found link on google because everyone just talking about "Virtual Desktop" (not free software). And you know ... they both are nearly identical.

While this is true, if anything is GPL and distributed in OS X then OS X is subject to the GPL. I never said I wasn't happy with paying for the OS because I think Apple does deserve money for adding things like Quartz, etc...I was just stating what I said "technically" and not as it should be...also I did try dmesg in the terminal and I didn't see a copyright date but I did see a listing for a Radeon 9700, but my computer should only have a 9600, what's up with that? I was looking in system profiler looking that up (couldn't find it there) and noticed that my modem is listed as v.90 there yet it's most assuredly a v.92.....hmmm weird things...

And for my closer to topic question that no one has yet answered anyone who has asked. Why are there different shipping methods for Panther? When does it ship exactly? It seems to state that it's going to ship on 10/24 but then Apple talks about having it on the 24th (and not just at retail stores) so what's up with this? Did I order 2 day for nothing? It doesn't seem like this option would be there if they'd all arrive on 10/24 but then again who knows with the way shipping has gone for Apple lately....

While this is true, if anything is GPL and distributed in OS X then OS X is subject to the GPL.

This is absolutely not true. If you don't link your code against the GPL code, you can distribute your code (with or without other GPL'd tools) without your code becoming GPL'd itself.

I always read these forums, but rarely post. However Apples panther policy ahs really bugged me, however not in the way it seems to be affecting others.

The one thing I find really annoying is their pricing policy, for us students in the UK, I expect to pay more for everything in the UK than you lucky people in the US. What has really riled me though is the difference in edu discount.

A single user in the US pays $129 in the UK that’s £99 ($165) so that’s about 28%, it’s less of a difference than a lot of products! But then with edu discount its $69 in the US and £69.33 ($115) in the UK so that’s 68%.

I just find it ridiculous that the difference in prices between countries is significantly different for a normal user and someone with edu discount.

Anyway rant over apple are just lucky I love them so much!

Bring on Panther 😀

Boot in Verbose Mode (Apple-V) and you'll see the copywrite message right at the start of the boot.

A few questions posted here (including some by me) were not answered, so I tried something I'm not used to: I lifted my fingers off the keyboard and dialed the phone to get the answers from Apple!

Q: Why does the online Apple Store offer Panther "for delivery Oct 24 PM" and then offer you next day shipping, 2-day shipping, and 5-day shipping?

A: Because all items in the Store use the same checkout screen. Pick the free shipping and you'll still get it on the 24th.

Q: By when do you have to order to get Panther delivery on the 24th?

A: The order must be processed (not just placed) by October 21st.

Q: How will they be delivered?

A: Fedex.

Q: Will there be giveaway goodies at the Apple retail stores on Panther night, as there were for Jaguar night?

A: "Maybe. We haven't been told of any yet."

Q: Will the Panther Family Pack be in stock at the Apple retail stores on the 24th (i.e., in addition to the Individual version)?

A: First store I called: Probably, but "I'm not sure". Second store I called: Probably, but "I'm not sure".

Q: Is the Panther Family Pack (a) the same box as the Individual one, but with a "Family Pack" sticker on the outside, or (b) a box with different license paperwork inside?

A: First salesperson: (a). Second salesperson: (b).

Well...

That's what I got from reading the actual license....it says nothing about linking the code but simply distributing it....and we weren't talking about distributing code, we were talking about charging for the OS...

Does this mean the shipping we paid for will be refunded? You had to select one of them....and since that was the case I opted to get 2 day since it was only 3 dollars more...

You've gotta be careful when you read the GPL. It was expressly designed, from the beginning, to obfuscate and confuse.

The bottom line: if your software links to GPL-licensed software (where "links to" has a very specific technical meaning), then your software is covered under the GPL whether you want it to be or not.

None of Apple's operating system code, however, links to GPL-licensed code. So none of Apple's operating system code is covered by the GPL. The copyright is held exclusively by Apple, and only Apple has the right to distribute it.

That's what I got from reading the actual license....it says nothing about linking the code but simply distributing it....

OK, then this is the part of the license that you missed:

"In addition, mere aggregation of another work not based on the Program
with the Program (or with a work based on the Program) on a volume of
a storage or distribution medium does not bring the other work under
the scope of this License."

I was simply stating what this means in real terms.

and we weren't talking about distributing code, we were talking about charging for the OS...

I was replying to the statement you made earlier:

While this is true, if anything is GPL and distributed in OS X then OS X is subject to the GPL./
Sorry I wasn't more clear, I just wanted to point out that there's no argument for OS X being GPL'd. You made an earlier comment that they may be charging for a "warranty" or something of the sort. Not true, they're charging for the product they made and they're not breaking any license by doing so.

OK, I didn't miss that but I thought that OSX had been "aggregated" with componets of software that was GPL and that it was based on it...i.e. OSX based on FreeBSD.....but anyway I get it...I'm just not sure how it isn't linked since what Apple has written is an enhancement to the mach kernel and a frontend that came from Next....which they owned or I guess still own though it's dead...my friend is the major proponent if this theory because he's angry that Apple would base their OS off of a free OS and just throw a frontend on it....my argument was that they added major components like quartz, etc....but eventually this did irk me a little...

Neither FreeBSD nor Mach were ever covered by the GPL.

No offense, but perhaps your friend is a little confused about what "free" means?

I think you'll get charged what you indicated unless you (a) call to change the shipping method on your order, (b) cancel the order and place a new one with the free shipping choice or (c) call to complain later.

If Panther is all that you ordered, choice (b) seems easiest, since you can do it online and it won't delay your delivery date.

iDVD 3.0 is well over 1 GB. Won't fit on a CD-ROM.

I haven't read the last couple pages of this thread, so I apologize if this has already been addressed.

But it would fit on a DVD. Couldn't Apple throw iDVD onto a DVD in the Panther box? For $129, I'm sure they can afford the media cost. And, conveniently, anyone who has plans to use iDVD will have a drive that can read the DVD!

iDVD is a ultimately a $45 upgrade. All of the parts of iLife are available for a free download other than iDVD. To get iDVD, you need to buy the iLife package. iDVD is packaged when you buy the SuperDrive. It's provided with the hardware, not the software, which is why it's not packaged with Panther. (Panther will be installed on many more computers that *don't* have a SuperDrive than *do*.)

iDVD is only available to people who have a Superdrive. I have no idea what the ratio of Superdrive to non-Superdrive Macs is out there, but you have to think that if Apple included iDVD in every Panther retail box, a significant number of customers (half? more?) would be unable to use it.

If you have a Superdrive, go out and spend the $50 on iLife. If you don't, however, I'm sure you're going to be glad that you don't have to pay for it when you buy Panther.

(On a slightly different note, I'm getting pretty sick of the "Apple should give me more free stuff" mentality. It's disgraceful.)

When I called my local Apple Store to ask, the guy there said that HE THOUGHT that systems with 10.3 preinstalled would start coming in in early November, but he admitted that it was just a guess - it all depends on how quickly existing stock diminishes. I would guess that systems rolling off the assembly line now are having 10.3 put on them, but who knows how long it takes those machines to reach store shelves.

If you purchase a G5 at your local Apple Store, you also get the Apple Pro Card for free. Once your get your upgrade to Panther and have a Mac Genius install 10.3. Would it not be just like it was factory installed?

Well, except for the lugging of equipment back and forth from the store to home and then back to the store and home again. 🙂

Plus, the folks I'm buying for aren't looking for a G5.

Whern I did it there wasn't even a selection for free shipping...the lowest was four so I opted for $7 2-day.....I was just wondering because some people seem to have gotten reimbursements yet I have not...thanks for your help 🙂
