Maybe this was the iPhone 4GS prototype and the 4g just looks like a regular iPhone

If they already have the next next gen phone made, then that's not very productive.... why not give those features now and give the people whatis newest when it is newest? Very counter productive. They'd be behind

it wouldn't have been bad if they found it and they gave it back.. however, it was obvious to them since they paid 5000 that it was private secret property and instead of giving it back they chose to flaunt it around in a selfish way to gain attention. they are nothing but attention seeking hogs that should be looked down upon

Finder keepers is not actually a concept that the laws of the state of Californa recognizes.



They admit to knowing the circumstances under which it was acquired. Those circumstances are theft in the State of California, no matter how you want to sugarcoat it. They paid $5,000 for property they knew was stolen. They committed a crime. Given the dollar amounts, it is a safe assumption the crime is a felony. It actually has nothing at all to do with it being the next generation iPhone. It could be a 3GS and it is still a crime.

Um.....no. It was not stolen. The phone was lost. The "finder" attempted to find/contact the owner. He called Apple several times. They did not respond. The finder did not know it was a prototype until later. Gizmodo could reasonably say that it did not know it was a genuine Apple prototype until AFTER they broke it down (There are MANY iPhone knockoffs floating around). They did NOT reveal any trade secrets (which many of you have complained about. There's a reason why they didnt go into too much detail about the internals of the phone.) They contacted Apple and told them they had the phone. A good lawyer (or a good paralegal, which I am) would tell you Apple has no case.

Not months later. YEARS later. They float a concept car, pick up the reaction, go back to the drawing table and then after a minimum of 2 years they unveil the end result, e.g. the cool concept car with all the cool parts removed by a nervous committee.

Typically those cars are dummy mockups that can't even be driven.

This phone, however, is about to be released in 8 weeks, and Steve will probably want to say "available today" at the Keynote. The specimen found is fully functional. But the most important clue is the fact that this picture (and others like it) have emerged from China:

That design is identical to the Gizmodo phone.

Now, the iPhone equivalent of a concept car would not have been manufactured in China, it would've been hand made in Cupertino. Why would Apple A) go through the trouble of having prototypes manufactured in China, and B) trust such a prototype to the Chinese when history shows that they leak like crazy?

The prototype stage is looooooooong gone. Mass production should be starting up as we speak -- the manufacturing date of any freshly launched Apple gadget is typically a few weeks before the launch date, and all the depots around the world need to stock up well ahead of the launch date.

Yes, the Gizmodo phone is not FINAL final, or else it wouldn't have placeholder text on the back, but it is *not* some early prototype or test bed.

As for the poor guy who lost that phone...well, I don't think there will be much left of him to find. Steve will take his organs, wear his face like a mask, and devour the rest.

Lol! Nah, too many people watching right now.....but give it six months and I bet you'll find he's mysteriously disappeared and Steve Jobs would have acquired a new patio with a slight bump in the middle in his back garden!

This is a manufacturing sample. Not a prototype.

The case design would be iterated with non-working dummies.
They would not start making working phones until the case design was signed-off.

I love how people reverse engineer the universe the way they want it to be.

i see it that way as well. maybe the facebook profile pic was a bit far, he probably has hundreds of messages and requests etc now, but with this much publicity i think apple will find it hard to fire him without some negative feedback from the media; especially since they gave him the sympathetic write up (that he deserves) and highlighted at every possible opportunity how easily anyone could make that mistake. plenty of people do, just not with an unreleased device i guess.
 
After all the information I have read, I have come to the following conclusions:-

1. This "accidentally left behind" iPhone in a jacket to disguise in a iPhone 3G / 3GS, seems too convenient for my liking. If you had a iPhone on you would would take many precautions to ensure it was not left behind, and the guy did not even return to claim it, even when people waited for him to.

2. This cafe just happens to be in relative proximity to Apple's Head Office. Makes it very easy to ensure a new iPhone was "accidentally left behind". Digital Bait :)

3. This "leak" appears days before Android and other OS annoucements and after Windows Phone 7 - very convenient indeed. Also, its been months since we have heard anything about the upcoming iPhone. The first hint was that leaked iPhone frame which was taller and the digitiser and screen were all in one unit (MacRumors). After this we heard nothing until this new iPhone pic spread like a viral marketing exercise.

In summary, all of this seems to have occurred like a well oiled machine. Someone "forgets" a brand new iPhone, doesnt even return to pick it up, its then sold for US $5,000 and then its plastered on the web like a viral exercise on steroids. All this free advertising / PR for Apple and it didnt cost them a cent, what a bargain. Oddly enough, Apple then ask for it to be returned, no demands and not a thanks either.

I firmly believe this leak was initiated by Apple to stop mobile owners upgrading to Android based / Windows based mobile phones. Whats a better way to stop people straying from the Apple iPhone, than to leak new iPhone info? Its simple and it works.

Since when do you work at apple and have the means to say it is a manufacturing sample? No one knows anything, and yet people keep stating what they think to be truth as truth............

Not saying you're wrong, just saying it still doesn't mean anything until launch day, so nothing is set in stone

Because it wasn't "stolen". Of course Apple would say it was, especially if they plan on setting up any future litigation. However proving that it was stolen would be on Apple, and if the guy who found it can prove that he attempted to call Apple (which would be easy with phone records and his customer service ticket) their case is weak as hell.

Not necessarily. I think there have been eBay auctions of Apple prototype hardware that they have had pulled. Actually, now that I think about it, they have those pulled because it's illegal to sell someone elses property-Kind of like how it was illegal for Gizmodo/Gawker to pay for the stolen/lost iPhone.
 
I would actually much prefer the modern looks of a more squared phone with slightly rounded corners and a dead flat back.

And of course a screen that goes as far to the edges of the unit (in all directions) as close as possible.

I hate fat black bezels around the screen and I think the rounded, "tubby/chubby" look of the old iPhone is pretty dated now.

The HTC-HD2 is the most impressive phone I have seen (looks wise) even though some say it's a tiny bit big.

Hardly needed to do all that considering this phone will be available before Windows 7 Phone Series.

Good observation Klyph and well presented case. I love how people on these forums think that they have some sort of duty to Apple to defend their incompetence! It should be looked upon as one of the biggest &&&& ups ever by Apple.

They have no option now but to release this phone as is. Its what customers now are expecting. If they pull the design and drop features just to spite anyone then more fool them. In my view this is the iPhone i have waited for. It looks a cracker. Apple should be grateful about the hype and free publicity I look forward to June. These things are gonna fly of the shelves. That is if Apple doesnt spit their dummies out.

News reports say, Gizmodo is making plans to return the official device to the Apple fixer. :)

I think we should all go on a million Apple fan boys march and picket Cupertino for not giving us immediately what we want the way WE want it.

While we are at it we should also make a strong stance that we are no longer willing to accept that Apple FORCES us to buy their products (as somebody posted: Shoves them down our throats)

We want it all ...we want it now and BTW it's all SJ's fault!

Personally, I just lost all respect for Lam and now consider him a bonafide idiot. Granted, who WOULDN'T want to be the one to break the disassembly of a prototype iPhone? But to make public the efforts of another person/company when you know without question that it goes against their wishes and has cost them millions of dollars in development is completely pathetic, IMO.

Honestly, I hope that Apple sues the pants off Gizmodo and I hope they win big.

Oh what compromises the media and bloggers will make simply to break a story. :rolleyes:

BTW, does anyone know if any laws were broken by not immediately returning an item that you know was lost or stolen?

From a legal standpoint I don't think they knew it was stolen or someone elses property other than who they purchased it from until Apple sent the letter.

I think it would be very difficult for Apple to prove.

How was the guy to know that people were waiting for him? Wouldn't you have thought someone would have legged it with your phone by the time you realize that it was gone???
